Epidemic or Other Public Calamity. Members shall be paid for all time lost when schools in which they are employed are closed owing to an epidemic or other public calamity. To be eligible for calamity day payment, a substitute must have worked in the same assignment the work day before the calamity day. Public calamities shall be determined by the State Superintendent of Public Instruction. In the case of absence resulting from travel difficulties between the member’s local residence and his place of employment, provided these difficulties are caused by flood, storm or other uncontrollable conditions, the Superintendent shall waive the salary deduction if, in his judgment, the member has made every reasonable effort to get to his place of employment. In case of absence due to damage or serious and immediate threat of damage to the member’s residence resulting from flood, storm or other uncontrollable conditions, the Superintendent shall waive the salary deduction if, in his judgment, such absence was imperative to the protection of property and personal safety of the member and his immediate family. The Superintendent has the authority, under highly unusual circumstances, to declare schools closed. When the Superintendent exercises this authority, the following conditions shall prevail: A. In the event schools are closed because of weather conditions, members are not expected to report to work. Members will be paid for time lost in accordance with State law. B. In the event schools are closed because of public calamity (e.g., flood, tornado, storm or epidemic), members are not expected to report to work. Members will be paid for time lost in accordance with State law. C. In the event schools are closed because of an energy shortage, members are not expected to report to work; such days are not considered work days, and a modification of the school calendar will be determined by the Board following consultation by the Superintendent with the AEA. A member is assured of his annual contract salary, with no increase in the number of annual days worked. D. If for any reason, an entire student body is released after the school day commences, the faculty shall also be released for duty within thirty (30) minutes of the students’ departure.

  • Sabotage (a) Sabotage is of concern to all Parties involved on any work site and may affect safety, and therefore both the physical and mental wellbeing of all persons on site. (b) The Parties to this Agreement will not tolerate sabotage and will ensure that any person/s responsible for such action is immediately dismissed. (c) It is accepted that the relevant authorities may have to be notified, and provisions of the OH&S Act implemented. (d) In the event of a reasonable suspicion or proven sabotage consultation will occur between the Parties on a reasonable time frame up to a maximum of 4 hours to rectify the issue prior to Employees leaving the Project.

  • CALAMITY DAYS 19.01 The Superintendent, in consultation with the appropriate administrators, will establish work schedules for the support staff. Work schedules may be changed as required to meet the needs of the District. 19.02 When school is canceled or closed because of inclement weather or other calamity, the following support staff employees are expected to report to work, unless a Fairfield County Level 2 or 3 Snow Emergency is declared: A. District Office personnel; B. Custodial employees; C. Maintenance/grounds employees; and D. Secretarial employees (who may report on a two-hour delay when school is canceled or closed). 19.03 Specific job duties or responsibilities may require some employees to report to work in the instance of Level 2 snow emergencies. The Superintendent/designee determines whether or not conditions are too hazardous to expect employees to report for work at the regularly scheduled time, at a later time, or not at all. The work classifications and number of employees required to work on a day when school is closed will be determined by the Superintendent/designee in consultation with building and District administrators. 19.04 Employees who are required to work at times when school is closed will be paid a regular rate of pay unless: (a) the day is one that the District is required to make up in order to complete the required school year as approved by the Board, and (b) the hours worked are hours for which the employee is otherwise entitled to overtime compensation. 19.05 Employees who are required to report for work when school is closed and who fail to report will not receive any compensation for that day and may be subject to disciplinary action. 19.06 Non 12-month employees who are required to work on both a calamity day and a make-up day will be paid for working the make-up day at their regular hourly rate of pay. 19.07 In the event of an inclement weather delay, employees not listed in Article 19.02 whose day coincides with the start of the student instructional day shall have a delayed report time equivalent to that of the delay, except for custodial/maintenance-grounds employees who shall report as directed by their supervisor.

  • DISTURBANCES Tenant and all other occupants will be required to vacate the premises and forfeit the rental fee and security deposit for any of the following: Occupancy exceeding the agreed upon number people, using the premises for any illegal activity, causing damage to the premises rented or to any of the neighboring properties and any other acts which interferes with neighbors' right to quiet enjoyment of their premises. HOLD HARMLESS iTrip or the Owner, does not assume any liability for loss, damage or injury to persons or their personal property. Neither does owner accept any liability for any inconveniences, damage, loss or injury arising from any temporary defects or stoppage in supply of water, gas, cable service, electricity or plumbing, as well as due to weather conditions, natural disasters, acts of God, or other reasons beyond its control.

  • Explosion Riot or civil commotion.

  • Windstorm or hail This peril does not include loss to the property contained in a building caused by rain, snow, sleet, sand or dust unless the direct force of wind or hail damages the building causing an opening in a roof or wall and the rain, snow, sleet, sand or dust enters through this opening. This peril includes loss to watercraft and their trailers, furnishings, equipment, and outboard engines or motors, only while inside a fully enclosed building.

  • Act of God Landlord shall not be required to perform any covenant or obligation in this Lease, or be liable in damages to Tenant, so long as the performance or non-performance of the covenant or obligation is delayed, caused or prevented by an act of God, force majeure or by Tenant.

  • STRIKES OR LOCKOUTS 5.01 During the term of this Agreement, or while negotiations for a further agreement are being held the Union will not permit or encourage any strike, slowdown, or any stoppage of work or otherwise restrict or interfere with the Employer's operation through its members. 5.02 During the term of this Agreement, or while negotiations for a further agreement are being held, the Employer will not engage in any lockout of its employees or deliberately restrict or reduce the hours of work.

  • Pandemic An epidemic that spreads over a wide area, crossing borders and defined as a pandemic by the World Health Organisation (WHO) and/or by the competent local authorities of the country where the loss occurred. Isolation of the person, in the event of suspected illness or proven illness, decided by a competent local authority, in order to avoid a risk of spreading said illness in the context of an epidemic or pandemic.

  • War We do not Cover an illness, treatment or medical condition due to war, declared or undeclared.

  • NO STRIKES OR LOCKOUTS 5.01 The Union agrees there will be no strikes and the Employer agrees there will be no lockouts during the term of this Agreement. The term "strike" and "lockout" shall bear the meaning given them in the Ontario Labour Relations Act, as amended.
