Equipment Availability. If Vodafone is unable to provide the Equipment requested, Vodafone will agree with Customer to provide alternative Equipment if practicable to do so.

Subject to RB Group's receipt of full payment and Buyer's completion of any additional, required documents, you and the Buyer will be notified that the Equipment is available for pick-up via an email that is generated automatically by the Marketplace ("Item Release"). You agree to have the Equipment available for transportation, complete with ignition key, if applicable, to the Buyer no later than one business day after a Binding Obligation is created. If the Equipment is not available, you will be subject to pay a Post-Closing Delay Fee. Further, if you fail for any reason to release the Equipment to the Buyer after a Binding Obligation is created, you will be subject to a Seller Default Fee in addition to any other rights or remedies that RB Group or Buyer may have.

However, Copper Mountain shall not be liable to Customer or any third party for any damages due to Copper Mountain's failure to fill any Purchase Order or for any delay in delivery or error in filling any Purchase Order for any reason whatsoever, except to the extent such damages result from the gross negligence or willful misconduct of Copper Mountain.

In the event a FSE is at the Buyer site and the equipment is unavailable for servicing which causes a delay in excess of four (4) hours and consequently prevents the timely completion of the Services, Seller, in its sole discretion, may charge Buyer for “waiting time” at the standard hourly rate quoted in the current Seller Services price list.
