Excessive Chargebacks. Using limits established by the Payment Networks as a standard for review, FORTE reserves the right to suspend and/or terminate AGENCY’s access to the Services should AGENCY’s chargeback ratio exceed allowable limits in any given period. FORTE will make reasonable efforts to provide AGENCY with notice and a time to cure its excessive chargebacks prior to suspending or terminating AGENCY’s access to the Services. AGENCY acknowledges and expressly authorizes FORTE, in compliance with Payment Network Rules, to provide to the Payment Networks and applicable regulatory bodies, AGENCY’s name and contact information as well as Transaction details should AGENCY’s chargeback ratio exceed the allowable limits in any given period.

Excessive Chargebacks. MPay and/or Acquirer will notify Sponsored Merchant if its Chargebacks in any particular category determined by MPay and/or Acquirer has or is in threat of exceeding the threshold as shall be determined by MPay and/or Acquirer in its discretion. Sponsored Merchant must take immediate action to rectify the situation. Failure to resolve the cause of the problem will result in “Excessive Chargebacks fines” imposed by the Card Associations which shall be passed on to and be borne by Sponsored Merchant.

Excessive Chargebacks. At any point, IntegraPay, the Card Networks, or our payment processors may determine that you are incurring excessive Chargebacks. Card Networks typically consider Chargeback volume approaching 1% of your total processing volume to be excessive, although the level at which you are considered to have excessive Chargebacks may be more or less than that. Excessive Chargebacks may result in additional fees, penalties, or fines. Excessive Chargebacks may also result in I. additional controls and restrictions put on your use of IntegraPay Payments, including without limitation
Excessive Chargebacks. If Merchant is receiving an excessive amount of Chargebacks, in addition to Chase Paymentech’s other remedies under this Agreement, Chase Paymentech may do any one or more of the following:
Excessive Chargebacks. If Teleflora determines, in its sole and absolute discretion, that Merchant is incurring an excessive amount of Chargebacks, in addition to all other remedies to which Teleflora may be entitled under this Agreement or applicable law, Teleflora may take any or all of the following actions without the obligation to comply with the terms and conditions of Section 12.3: (i) review Merchant's internal procedures relating to the acceptance of or different procedures to avoid the incidence of future Chargebacks; (ii) establish a new rate that Teleflora shall charge Merchant to process its Chargebacks, effective immediately upon notice to Merchant; (iii) collect from Merchant an amount reasonably determined by Teleflora to be sufficient to cover anticipated Chargebacks (and related fees, fines, and penalties) for deposit into a Reserve Account; (iv) if Merchant is enrolled in the direct deposit plan, transfer Merchant to a check payment plan; and (v) terminate this Agreement pursuant to Section 7.2.

Excessive Chargebacks. If (i) the aggregate number of Sales Slips subject to Chargeback exceeds 3.0% of the total number of Card Sales submitted by Merchant with respect to an individual Merchant location in any calendar quarter or (ii) the aggregate dollar amount of all Sales Slips subject to Chargeback in any monthly billing cycle exceeds 5% of the total net balances of all Accounts at the end of such monthly billing cycle ((i) and (ii) are herein individually and collectively called "EXCESSIVE CHARGEBACKS"). Excessive Chargebacks shall be deemed a material breach of this Agreement and Household has the right, in its sole discretion, to terminate this Agreement pursuant to SECTION 15. d. The terms and provisions of this Section 6 shall survive the termination of this Agreement.
Excessive Chargebacks. Excessive Chargebacks are a breach of this MMA and cause for, at our option, suspension of Services, termination of this MMA, and assessment of an additional Excess Chargeback fee. "Excessive Chargebacks" means for any one of your terminal identification numbers or Merchant Account Numbers: (a) any number of Chargebacks in excess of one (1) in any monthly period; (b) any Chargebacks in any monthly period which exceed a Chargeback to Transaction Ratio of 1/100 (one percent) ; (c) ACH returns and/or retrieval requests in excess of 1% of the average monthly dollar amount of transactions or returns in excess of 3% of the average monthly dollar amount of transactions; (d) processing a transaction above the processing limits or amounts approved by us; or (e) processing any transaction that violates the AUP, MedFusion Policies or is otherwise prohibited by the MMA. You authorize us, upon the occurrence of Excessive Chargeback, to take additional actions we may deem necessary, including, but not limited to, termination or suspension of Services or creation or maintenance of a Reserve Account in accordance with this MMA. You acknowledge and agree that Provider may be required to report your name to law enforcement, or one or more card or payment associations for inclusion into VISA Terminated Merchant File, MasterCard MATCH, or any other prohibited merchant list in the event of fraud, Chargebacks, Excessive Chargebacks, or if we terminate your access to Services. You agree to such reporting and waive any claims, which you may raise against Provider as a result of such reporting. Provider, at its sole discretion may report incidents of fraud, counterfeit paper, unauthorized transactions, Chargebacks, Excessive Chargebacks or highly suspect activity to law enforcement and any other third party, including but not limited to the card or payment networks.
Excessive Chargebacks. If you are receiving an excessive amount of Chargebacks, as determined by the Payment Brands from time to time, in addition to our other remedies under this Agreement we may take the following actions: (i) review your internal procedures relating to acceptance of Payment Instruments and notify you of new procedures you should adopt in order to avoid future Chargebacks; (ii) notify you of a new rate we will charge you to process your Chargebacks; (iii) collect from you (pursuant to Section 4.6) an amount reasonably determined by us to be sufficient to cover anticipated Chargebacks and all related fees, penalties, expenses, and fines; or (iv) terminate the Agreement. You also agree to pay any and all penalties, fees, fines and costs assessed against you, Paymentech and/or Member relating to your violation of this Agreement, the Operating Guide, or the Payment Brand Rules with respect to your acceptance of Payment Instruments, your Transactions or with respect to excessive Chargebacks under this Section.
