Forensic Services. Those services provided by the Crime Lab to a Member pursuant to this Agreement that pertain to the identification, and analysis of physical evidence pursuant to the investigation or prosecution of a crime.

Forensic Services. Given this treatment is taking place as the result of another forensic process, there is a need to be aware of treatment within the forensic backdrop. Forensic Services are different from traditional psychotherapy. Whereas psychotherapy is a confidential exploration, discussion and mutually agreed upon plan for change, the same does not apply to forensic services. The forensic services may include interviews, contact with collaterals, observations, home and school visits, testing and other related services. Unlike traditional therapy, there should be no expectation of confidentiality in this process. Although the Appointee tries to be sensitive to therapeutic needs, at any time information may be provided to another individual within the guidelines of the Court's order. An example of such a provision from a standard Maricopa County appointment order is as follows: “There is no confidentiality relating to the parties’ communications with/to the Therapeutic Interventionist or concerning the Therapeutic Interventionist’s activities, treatment, referrals, data collection, or recommendations. This court order constitutes a complete waiver of doctor-patient privilege, as the Therapeutic Interventionist is appointed as the Court’s expert. Additional rules applicable to the Therapeutic Interventionist may be ordered by the Court from time to time.” Your commitment to the process is crucial and is demonstrated by your understanding and written agreement to the following. Forensic Services. Any forensic services to be performed by Magnet Forensics for You shall be as set out in a mutually agreed upon Statement of Work (“SOW”) executed by the parties (“Forensic Services”). This Agreement and the applicable SOW shall govern and supersede any terms and conditions stated on any purchase order or other document submitted by You. This Agreement shall take precedence in the event of any conflict or inconsistency between this Agreement and a SOW (except to the extent any SOW term expressly amends terms of this Agreement for the purposes of such SOW only). Any completion times set out in the SOW are estimates only. Magnet Forensics in its sole discretion will provide suitably experienced personnel to perform Forensic Services and reserves the right to have some or all of Forensic Services performed by sub-contractors. Magnet Forensics shall be vicariously liable for the performance of Forensic Services by such sub-contractors under a SOW.
