Freedom of Information Act Requests. If there is a request to a Party pursuant to the Freedom of Information Act (“FOIA”) for Data in the possession of the Party which is owned by another Party, such Party shall coordinate with the Party that owns the Data to respond to the request. Such coordination shall be initiated within 24 hours, and no later than 48 hours of the receipt of the FOIA request.
Freedom of Information Act Requests. Bargaining unit members will have the right to review the contents of their personnel file. Should a FOIA (Freedom of Information Act) request be made for personnel file information, the employer will notify the bargaining unit member with two (2) days of the request and prior to the release of the information. If the employee challenges the information in his/her personnel file, the Board of Education will take the maximum time to respond to the FOIA request, and under the law will genuinely and seriously consider a member’s request for exemptions and will not release information which is irrelevant or defaming.

The Superintendent or his/her designee shall notify, in writing, any Teacher if a request for information contained in the Teacher’s personnel file is made under the Freedom of Information Act, within the timeframe that the request is required to be honored. The notification shall include the name of the individual making the request, the documents that have been requested, and the District’s intent whether or not to disclose the information. The District shall not disclose any documents considered exempt under the Freedom of Information Act or otherwise prohibited from disclosure by law.

Within four (4) business days after the Municipality’s Notice to the Consultant of the Municipality’s receipt of a request made pursuant to the Illinois Freedom of Information Act (ILCS 140/1 et seq. – herein “FOIA”), the Consultant shall furnish all requested records in the Consultant’s possession which are in any manner related to this Contract or the Consultant’s performance of the Services, including but not limited to any documentation related to the Municipality and associated therewith. The Consultant shall defend, indemnify and hold harmless the Municipality including its several departments and including its officers and employees and shall pay all of the Consultant’s Costs associated with such FOIA request or requests including Costs arising from the Consultant’s failure or alleged failure to timely furnish such documentation and/or arising from the Consultant’s failure or alleged failure otherwise to comply with the FOIA, whether or not associated with the Consultant’s and/or the Municipality’s defense of any litigation associated therewith. In addition, if the Consultant requests the Municipality to deny the FOIA request or any portion thereof by utilizing one or more of the lawful exemptions provided for in the FOIA, the Consultant shall pay all Costs in connection therewith. As used herein, “in the Consultant’s possession” includes documents in the possession of any of the Consultant’s officers, agents, employees and/or independent contractors; and “Costs” includes but is not limited to attorneys’ fees, witness fees, filing fees and any and all other expenses — whether incurred by the Municipality or the Consultant.

Freedom of Information Act Requests. The Union President shall be notified within two (2) school business days of the District’s receipt of a Freedom of Information Act (FOIA) request that asks for information about any teacher(s) including, but not limited to, name, e-mail address, birth date, social security number or any part of a home address, or a list of employees in the bargaining unit or their Union member status.
