Funding Contingencies. Funding for this program is contingent upon availability of state or federal appropriations. TEA reserves the right not to award a continuation grant that was originally competitive to a grantee that is identified by TEA as high risk or not financially reliable between the time the application is submitted to TEA and the time the application is approved and the XXXX is awarded. Funding Contingencies. A. PAYMENTS: The State shall reimburse Grantee with Access to Technology Grant funding that has been appropriated, designated, encumbered, or otherwise made available for payment by the State under this Agreement. The following applies to all funding within this Agreement:

Fingerprinting Requirement Per Section 22.0834 of the Texas Education Code (TEC), any person offered employment by any entity that contracts with TEA or receives grant funds administered by TEA (i.e., a grantee or subgrantee) is subject to the fingerprinting requirement. TEA is prohibited from awarding grant funds to any entity, including nonprofit organizations, that fails to comply with this requirement. Maintenance of Effort (MOE) Public Law (P.L.) 107-110, Section 9521, states “a local educational agency may receive funds under a covered program for any fiscal year only if the State educational agency finds that either the combined fiscal effort per student or the aggregate expenditures of such agency and the State with respect to the provision of free public education by such agency for the preceding fiscal year was not less than 90% of such combined fiscal effort or aggregate expenditures for the second preceding fiscal year”. As per the Education Department General Administrative Regulations (XXXXX), this requirement applies to this grant. Local educational agencies (LEAs) are responsible for maintaining effort and for documenting MOE. TEA will verify each LEA’s MOE using information obtained from the PEIMS database. TEA staff will notify the applicant if fiscal effort has not been maintained. The final grant amount will be reduced in exact proportion by which the LEA fails to meet 90% of the combined fiscal effort per student or aggregate expenditures (using the measure more favorable to the LEA). Funding Contingencies. A. All obligations of STATE under the terms of the MFTA and each annual OWPA are subject to the availability of Federal and State funds, appropriation of resources by the Legislature, and the annual passage of the State Budget Act. The authorization and obligation of these funds by outside entities may be terminated, limited or otherwise adversely affected by factors which may include, but are not limited to, changes in State or Federal law regarding the encumbrance and reimbursement of the funds provided by each annual OWPA and this MFTA.
Funding Contingencies. In the event that a new job is created for which funding is uncertain, Management will so advise the Union prior to recruitment for the position. If an internal employee is selected for the position, the employee's former position will be filled on a temporary basis until a final decision is made on whether, or not, funding will be available. The temporary employee will be hired after a full hiring process, but will be advised that their position is subject to the confirmation of funding for the position assumed by the regular employee and/or the regular employee's satisfactory performance and/or satisfaction with the new position. If funding is confirmed, the temporary employee shall be hired as an Introductory Period employee into the position without the need for an additional hiring process. The employee who fills the new job classification for which funding is uncertain may be returned to their prior position if funding is unavailable or the Employer decides that the employee is not performing the new job satisfactorily under the terms set forth in Section I, or the employee wishes to return to their former position. If the regular employee returns to their former position, the temporary employee will be terminated.
Funding Contingencies. Delivery by STATE of all State funds encumbered to reimburse allowable PROJECT costs pursuant to this AGREEMENT is contingent upon prior budget action by the Legislature, fund allocation by the CTC or the United States Department of Transportation, and submittal by RECIPIENT and approval by STATE of all PROJECT documentation, including, without limitation, that required by Government Code Section 14085. In the event of the imposition of additional conditions, delays, or a cancellation or reduction in funding, as approved by the Legislature, the CTC or the United States Department of Transportation, RECIPIENT shall be excused from meeting the time and expenditure constraints set forth in the Project Financial Plan and the Project Schedule to the extent of such delay, cancellation or reduction and the PROGRAM SUPPLEMENT will be amended to reflect the resultant necessary changes in PROJECT funding, scope, or scheduling.

Funding Contingencies. The parties acknowledge that payment to be by the Consortium to Contractor under this Agreement is provided under the terms of the NYSERDA Funding Agreement (including without limitation the Cooperative Agreement forming part thereof), which includes various limitations and contingencies. Among other things, the availability of funds under the NYSERDA Funding Agreement is contingent on New York State and federal legislative appropriation of the funds to be provided to the Consortium thereunder, as well as rights of termination available to NYSERDA, both independently and based upon determinations by U.S. DOE. Anything to the contrary notwithstanding, the Consortium’s payment obligations to Contractor under this Agreement are, in their entirety, subject to and contingent upon receipt by the Consortium of funding allocated under the NYSERDA Funding Agreement to the project(s) forming the basis of this Agreement. The Consortium shall be under no obligation to pay Contractor, and shall have no liability for failure to make such payment, to the extent that the applicable funds are not received by the Consortium pursuant to the NYSERDA Funding Agreement. Moreover, the interpretation and administration of this Agreement are in all respects subject to the Funding Agreement, and the provisions thereof which are required by NYSERDA to be made part hereof shall be deemed included.
