GAG AND EAG. 4.1 The Secretary of State agrees to pay GAG and EAG to the Company in relation to the Academy in accordance with the Master Agreement.

GAG AND EAG. The Secretary of State agrees to pay GAG and EAG to the Company in relation to the Academy in accordance with the Master Agreement, save that clauses 65-74 of the Master Agreement are disapplied and replaced with clauses 4.2 to 4.9 below.
GAG AND EAG. 4.1 The Secretary of State agrees to pay GAG and EAG to the Company in relation to the Academy in accordance with the Master Agreement. 4.2 The Company shall use the GAG funding it receives prudently in order to cover the normal reasonable running costs of the Academy including, but not limited to, payments which fall due pursuant to the School Agreement and/or the Principal Agreement. 4.3 In the event that the Secretary of State pays the LA any sums in connection with a Normal Payment Matter pursuant to the Principal Agreement the Secretary of State may, subject to clause 4.4, set off or xxxxx an amount equal to such sums from any GAG payable to the Company in respect of the Academy pursuant to this Agreement in the following financial year. 4.4 Before exercising its right of set off or abatement pursuant to clause 4.3 above, the Secretary of State shall: 4.4.1 notify the Company that such sums have been paid by the Secretary of State to the LA; 4.4.2 take into account (acting reasonably) any representations made by the Company providing reasons why the relevant Normal Payment Matters liabilities were not settled; 4.4.3 take into account (acting reasonably) any representations made by the Company as to the nature of the Normal Payment Matters under consideration and whether they properly fall within the definition of Normal Payment Matters having regard to the costs that other academies may normally be expected to bear from GAG funding.
GAG AND EAG. 4.1 The Secretary of State agrees to pay EAG to the Company in relation to the Academy in accordance with the Master Agreement. 4.2 Clauses 42A to 53 of the Master Agreement do not apply to the Academy. 4.3 GAG will be paid by the Secretary of State to the Company in order to cover the normal running costs of the Academy, and shall only be spent by the Company towards those costs. These costs will include, but are not limited to: a) teachers' salaries and related costs (including full and part time teaching staff and seconded teachers); b) non-teaching staff salaries and related costs (including pension contributions, educational support staff, administrative and clerical staff and manual and premises related staff); c) employees' expenses; d) the purchase, maintenance, repair and replacement: (i) of teaching and learning materials and other educational equipment, including books, stationery and ICT equipment and software, sports equipment and laboratory equipment and materials; (ii) of other supplies and services; e) examination fees; f) repairs, servicing and maintenance of buildings (including redecoration, heating, plumbing, lighting etc); maintenance of grounds (including boundary fences and walls); cleaning materials and contract cleaning; water and sewage; fuel and light (including fuel oil, solid and other fuel, electricity and gas); rents; rates; purchase, maintenance, repairs and replacement of furniture and fittings; g) insurance; h) medical equipment and supplies; i) staff development (including in-service training); j) curriculum development; k) the costs of providing school meals for pupils (including the cost of providing free school meals to pupils who are eligible to receive them), and discretionary grants to pupils to meet the cost of pupil support, including support for pupils with special educational needs or disabilities (taking account of the fact that separate additional money will be available for pupils with statements of special educational needs); l) administration; and m) establishment expenses and other institutional costs. 4.4 Subject to clauses 4.11 and 4A.2, GAG for each Academy Financial Year for the Academy will include: a) funding equivalent to that which would be received by a maintained school with similar characteristics, determined by the Secretary of State and notified in the Annual Letter of Funding or its equivalent, taking account of the number of pupils at the Academy; b) funding for the cost of functions which w...
GAG AND EAG. 4.1 The Secretary of State agrees to pay GAG and EAG to the Company in relation to the Academy in accordance with the Master Agreement. 1 If the Academy is to be a “selective school” then insert the following wording at the end of paragraph 2.1 “…,save that clause 12(c) of the Master Agreement does not apply as the Academy is a “selective school” within the meaning of Section 6(4) of the Academies Xxx 0000 and additionally clause 19 does not apply in so far as it provides for the Academy to be an all ability inclusive school”.

For the purpose of clause 46 of the Master Agreement, the condition is satisfied [2/3/4] Academy Financial Years after the Academy opening date. 4A ADDITIONAL FUNDING 4A.1 The Secretary of State shall meet the Company’s costs arising from Rent payable by the Company under the Lease. Such costs shall include those costs arising from any rent rise payable by the Company under the terms of the Lease, so long as the relevant rent rise is properly evidenced in writing by the Company to the Department as soon as is reasonably practicable, but such costs shall not include any amount in respect of service charge payments or insurance premiums. Where the definition of rent in the Lease includes service charge payments or insurance premiums, the Secretary of State shall exclude from the total grant payable in respect of Rent an amount in respect of such service charge payments or insurance premiums. 4A.2 The Secretary of State may pay further grant in the Start-up period, as determined and specified by him, for costs which cannot otherwise be met from GAG.

GAG AND EAG. 4.1 The Secretary of State agrees to pay GAG and EAG to the Company in relation to the Academy in accordance with the Master Agreement, subject to clauses 4.2 to 4.10 below. 4.2 Subject to clauses 4.8-4.9, GAG for each Academy Funding Year for the Academy will include: 4.2.1 Funding equivalent to that which would be received by a maintained school with similar characteristics, determined by the Secretary of State and notified in the Annual Letter of Funding or its equivalent, taking account of the number of pupils at the Academy; 4.2.2 Funding for the cost of functions which would be carried out by the local authority if the Academy were a maintained school, such funding to be determined at the discretion of the Secretary of State; 4.2.3 Funding for matters for which it is necessary for the Academy to incur extra costs, to the extent that those costs are deemed in the discretion of the Secretary of State to be necessary; and 4.2.4 Payments equivalent to further, specific grants made available to maintained schools, where the Academy meets the requisite conditions and criteria necessary for a maintained school to receive these grants, such payments to be at the discretion of the Secretary of State. 4.3 Subject to clause 4.4, the basis of the pupil number count for the purposes of determining GAG for an Academy Funding Year for the Academy will be the Academy Trust's estimate each November for numbers on roll in the following September for the Academy. 4.4 Once the condition specified in clause 4.5 has been satisfied with respect to the Academy for the Academy Funding Year for which funding is being calculated, the basis of the pupil number count for the purpose of determining GAG for the Academy will be: 4.4.1 for the pupil number count for pupils in Year 11 and below, the Schools Census for the January preceding the Academy Funding Year in question; and 4.4.2 for the pupil number count for pupils in Year 12 and above, the formula which for the time being is in use for maintained schools for the calculation of pupil numbers for pupils in Year 12 and above for the purpose of calculating their level of funding. 4.5 For the purpose of clause 4.4, the condition is satisfied when all planned Year-groups will be present at the Academy (that is, all the pupil cohorts relevant to the age-range of the Academy will have some pupils present). 4.6 For any Academy Funding Year in which GAG for the Academy has been calculated in accordance with clause 4.3, an adjustment ...
GAG AND EAG. 4.1 The Secretary of State agrees to pay GAG and EAG to the Company in relation to the Academy in accordance with the Master Agreement. 4.2 Subject to compliance by the Secretary of State with clause 4.3.1 notwithstanding clause 4.1, the Secretary of State may give written notice to the Company of his intention to and (subject as provided in clause 8.2) then may deduct an amount equal to any sum paid by the Secretary of State to the Council under clause 5.1 of the Principal Agreement or in respect of Excluded Matters Claims from the next instalment(s) of GAG payable to the Company after the date of the notice given under this clause 4.2. 4.3 Before giving notice to the Company of an intention to make any deduction from GAG in accordance with clause 4.2 the Secretary of State shall:- 4.3.1 notify the Company in writing that he has made a payment to the Council in respect of Excluded Matters and specifying the circumstances in which such payment has been made and the amount of such payment; 4.3.2 consider any representations made by the Company as to why it has not made payment to the Council in respect, of the Excluded Matters in question; 4.3.3 consider the circumstances surrounding and the amount of the payment to be made in respect of Excluded Matters; and 4.3.4 consider anything which other academies would normally be expected to pay out of GAG. 4.4 The Secretary of State shall, during the currency of the Schools Agreement, pay to the Company as an increment to GAG, and by the same instalments as GAG, the sum of £55,807 (Indexed) per annum.
