Upon termination of employment with the Agency, unless personal relief to the employee may be granted after termination of employment. c. Upon the death of the employee, unless the grievance involves a question of pay. d. Upon failure by the grieving party to meet time limits, or to request and receive an extension of time, unless mitigating circumstances prevail.

Grievance Termination. This Agreement is subject to termination prior to expiration of the Term in accordance with CMC’s Graduate Medical Education’s House Staff Policy entitled “Grievance Process Policy.” as follows: (a) If milestones are not reached, CMC may take corrective action, up to and including suspension or termination; (b) By CMC due to Resident’s failure to comply with the terms of this Agreement, substandard or unsatisfactory performance, unprofessional or illegal conduct (including a positive drug screen pursuant to Atrium Health’s policy), debarment or exclusion from federal program participation, or conduct disruptive to the operations of CMC, Atrium Health, or the Program; or (c) By Resident upon thirty (30) days prior written notice.
Grievance Termination. When a grievance has been filed by a unit member, the grievant may terminate the grievance at any time by giving a written notice to the Assistant Superintendent of Human Resources or designee. Failure to comply within the time limits, to attend scheduled meetings to discuss or hear the grievance or to provide requested information at the grievant disposal relating to the subject matters of the grievance shall be deemed a termination of the grievance.

If the Board fails to answer the grievance in the stated time period, except as provided in Level Four of this Article, the grievance shall be considered meritorious and the relief granted. If the Association or a teacher fails to appeal any reply to a grievance within the stated time period, the grievance shall be considered closed in accordance with the Board’s answer. The Association or a teacher reserves the right to take any grievance to the next step of the Grievance Procedure and its action or actions in doing so shall thus be considered final and binding on all parties to the grievance.
