Hot August Nights. (a) The Hot August Nights special event may require the Chief of Police or his designee to schedule officers to work on their days off. The Chief of Police or his designee shall advise the Association President, or his designee, of the xxxxxxx requirements for Hot August Nights by the first of June preceding the event. Those officers with equal qualification in excess of the xxxxxxx requirements will be granted consecutive days off by seniority. Officers desiring time off during the Hot August Nights special event will normally be granted leave by seniority on a first come, first served basis. When two (2) officers put in for any leave request, the officer with the most departmental seniority will be granted the leave. When five percent (5%) of the officers have been granted leave, additional leave may be granted subject to supervisor approval. (b) Notwithstanding the above, all overtime for officers scheduled to work the Hot August Nights special event on their scheduled days off, or required to work extended shifts either prior to or after their regularly scheduled shifts shall be at two (2) times their base hourly rate of pay. Effective July 1, 2011 through June 30, 2013 the two (2) times base hourly rate of pay shall be reduced to one and one-half (1-1/2) times base hourly rate of pay. The two (2) times base hourly rate of pay shall be reinstated on July 1, 2013. In order to qualify for Hot August Nights special event overtime pay, any extension of shift must be related to the Hot August Nights special event. Officers working on their scheduled days off shall be paid a minimum of eight (8) hours pay at the rate of two (2) times their base hourly rate of pay. For calculation of payment due under this section, base hourly rate shall be increased by Investigator assignment pay, FTO assignment pay, or Senior Officer premium pay for any employee so assigned by payroll action form. (c) All officers working or required to work the Hot August Nights special event and qualifying for two (2) times their base hourly rate of pay, including those officers whose work shifts are extended either prior to or after their regular shifts, shall receive shift differential pay in the amount identified in Article 24, section (a), of the collective bargaining agreement, for the hours identified in Article 24 and worked during that period of time. However, the Chief of Police, or his/her designee, shall advise the Association President, or his/her designee, a minimum of thirty (30) days preceding that special event, of anticipated staffing requirements. Those officers with equal qualifications in excess of the staffing requirements will be granted consecutive days off by seniority. (b) Officers desiring time off during the Pre-Designated Crawl/Events will normally be granted leave by seniority on a first come, first served basis. When two (2) officers put in for any leave request, the officer with the most departmental seniority will be granted the leave. When five percent (5%) of the officers have been granted leave, additional leave may be granted, subject to supervisor approval. (c) When staffing requirements for any special event require the involuntary scheduling or forced hiring of more than forty percent (40%) of officers, who are regularly assigned to patrol teams and detectives, on their regularly scheduled days off, the Association and the City shall immediately open negotiations for the limited purpose of negotiating overtime pay and benefits for that special event. (d) Officers scheduled to work special events shall receive shift differential pay in the amount identified in Article 24(a) for the hours identified in Article 24 and worked.

  • Xxxxx Fargo Name The Sub-Adviser and the Trust each agree that the name "Xxxxx Fargo," which comprises a component of the Trust's name, is a property right of the parent of the Adviser. The Trust agrees and consents that: (i) it will use the words "Xxxxx Fargo" as a component of its corporate name, the name of any series or class, or all of the above, and for no other purpose; (ii) it will not grant to any third party the right to use the name "Xxxxx Fargo" for any purpose; (iii) the Adviser or any corporate affiliate of the Adviser may use or grant to others the right to use the words "Xxxxx Fargo," or any combination or abbreviation thereof, as all or a portion of a corporate or business name or for any commercial purpose, other than a grant of such right to another registered investment company not advised by the Adviser or one of its affiliates; and (iv) in the event that the Adviser or an affiliate thereof is no longer acting as investment adviser to any Fund or class of a Fund, the Trust shall, upon request by the Adviser, promptly take such action as may be necessary to change its corporate name to one not containing the words "Xxxxx Fargo" and following such change, shall not use the words "Xxxxx Fargo," or any combination thereof, as a part of its corporate name or for any other commercial purpose, and shall use its best efforts to cause its trustees, officers and shareholders to take any and all actions that the Adviser may request to effect the foregoing and to reconvey to the Adviser any and all rights to such words.

  • Christmas Closedown 15.1 It is agreed that whenever annual leave is taken in conjunction with the Christmas/New Year period (as per Calendar in sub-clause 2.11), it is to be taken in accordance with the following procedure. 15.2 Employees who have not accrued sufficient pro rata annual leave prior to commencement of the Christmas/New Year period, may be granted leave without pay by their Employer to give that employee at least the minimum leave of absence required. 15.3 Where the Employer decides to close a site over the Christmas/New Year period for any period in excess of the agreed minimum closedown, up to and including 20 Annual Leave days, then the Employer shall give at least 2 months’ notice to employees as per the relevant Award. Employees who have no, or insufficient, accrued annual leave equal to the period of the closure, may be granted leave without pay for that period. 15.4 Notwithstanding anything elsewhere contained in this Agreement, the Employer may require any employee to work in unforeseen or emergency circumstances during the Christmas period. 15.5 Where an employee requests that annual leave be allowed in one continuous period at Christmas, such a request shall not be unreasonably refused. 15.6 It is a breach of this Agreement and the Award for an employee to be paid his/her full accrual, or part thereof, of annual leave at Christmas or any other time, unless that employee takes such annual leave or his/her employment is terminated. Employment is not to be terminated for reasons of avoidance of this clause.
