IMAGE USAGE. In this act, the User yes ( ) no ( ), accepts and acknowledges that while using the Service indicated in this Contract, the Company may, always respecting the integrity of the User, make use of their Image for statistical, commercial or promotional purposes. This, through visual, audiovisual or multimedia material, without this generating any liability or obligation for the Company to pay any payment derived from the dissemination and/or exploitation of its image.

IMAGE USAGE. All members of Xxxxx Basketball are required to sign a form stating that they allow their picture to be used in any marketing material for Xxxxx Basketball. The use of pictures from Xxxxx Basketball activities and competition are permitted on social media sites.
IMAGE USAGE. The model (or parents/legal guardians) expressly agrees to the following: 4.1 In exchange for valuable and sufficient consideration, the adequacy of which is hereby acknowledged, the model hereby grants irrevocable authorization for the use of the images in any media format for any kind of print sales, Book, calendar and NFT sales, including but not limited to self-promotional purposes, fine art prints, calendars, advertising publications in magazines, the photographer‘s website, and social media. 4.1.1 In the case that images are made for companies in combination with their products for their marketing and self- promotional purposes, the model grants the same authorization. 4.1.2 This authorization is granted without any expectation of additional compensation or remuneration, and the model hereby acknowledges that this authorization is irrevocable and perpetual. 4.2 The Model expressly authorizes any additional commercial use of the images, such as stock photos. In the event of such commercial use, the Model shall be entitled to receive a compensation of fifteen percent (15%) of the net profit, calculated as the gross revenue from the commercial use of the images minus all related production costs, unless other- wise agreed in writing. The Model shall issue a valid invoice to Sascha van der Werf for this purpose. This provision shall not apply to self-promotion or other points as set forth in Section 4.1 of this Agreement. 4.3 Both parties, the Model and the Photographer, expressly agree that the images shall not be used for pornographic, defamatory or disfiguring purposes. In addition, the use of the images for stock photography is strictly prohibited. This exception applies equally to both parties to this agreement. 4.4 Both parties, the model and the photographer, agree that the images must be reviewed and approved by both parties before any publication, sale, or other use, including personal social media accounts. The model has the right to reject the publication of images that are deemed offensive, such as images with explicit depictions of genital areas. In such cases, the photographer has the option to modify the images according to the agreed conditions or not to publish them at all. 4.5 The model acknowledges and agrees that Sascha van der Werf and all associated partners may use the appro- ved images and any subsequent modifications to promote Sascha van der Werf‘s work. IMAGE USAGE. The Client releases the Photographer and assigns permission to all images to use in any media for any purpose which may include, among others, advertising, promotion, marketing and packaging for any product or service. The Client agrees that any images and sound recordings may be combined with other images, text and graphics, cropped, altered and modified. The Client may purchase and obtain prints and digital files with license for personal use only, and is not permitted to sell or authorize any reproductions by parties other than the Photographer and Client.
IMAGE USAGE. I hereby authorize Countryside Pet Estates to depict in perpetuity the likeness, image, name and other indicia of rights of publicity of myself and my Pet (“Images”) in photographic or other works appearing in any and all media for purposes of promoting, advertising, or marketing current or future events, and I agree that such Images may be used for that purpose without compensation.

  • Leave Usage Full shift absences on vacation, sick leave, compensating time off, or holiday in lieu taken by employees on a scheduled twelve-hour workshift shall result in the deduction of twelve (12) hours from the employees’ accrued leave balances.

  • Excess Usage If during a Billing Period, In Energy is greater than zero (0), then Excess Usage for that Billing Period will be calculated. If Excess Usage is greater than zero (0), then for the Facility and any secondary account at the conclusion of that Billing Period: (i) kilowatt-hour usage will equal the value of Excess Usage and (ii) Unused Credits are equal to zero (0). If Excess Usage is equal to zero (0), then for the Facility and secondary accounts at the conclusion of that Billing Period: (i) kilowatt-hour usage is equal to zero (0) and (ii) Unused Credits are reduced by the value of In Energy, determined for that Billing Period, and that reduced value, in accordance with paragraph (C) Unused Credits of this Article IV, will remain for possible future application.

  • Personal Car Usage 7.1 Personal vehicle usage will be reimbursed in an amount equal to the standard mileage rate allowed by the IRS. 7.2 Per code of Federal Regulations, Title 26, Subtitle A, Chapter 1, Subchapter B, Part IX, Section 274(d), all expense reimbursement requests must include the following: 7.2.1.1 Date 7.2.1.2 Destination 7.2.1.3 Purpose 7.2.1.4 Name of traveler(s) 7.2.1.5 Correspondence that verifies business purpose of the expense 7.3 The mileage for a personal vehicle must document the date, location of travel to/from, number of miles traveled and purpose of trip. 7.4 Mileage will be reimbursed on the basis of the most commonly used route. 7.5 Reimbursement for mileage shall not exceed the cost of a round trip coach airfare. 7.6 Reimbursement for mileage shall be prohibited between place of residence and usual place of work. 7.7 Mileage should be calculated from employee’s regular place of work or their residence, whichever is the shorter distance when traveling to a meeting or traveling to Williamson County, Texas for vendors who are located outside of the Williamson County Courthouse, 000 Xxxx Xxxxxx, Xxxxxxxxxx, Xxxxx 00000 by at least a 45-mile radius. 7.8 When more than one person travels in same vehicle, only one person may claim mileage reimbursement. 7.9 Tolls, if reasonable, are reimbursable. Receipts are required for reimbursement. If a receipt is not obtainable, then written documentation of expense must be submitted for reimbursement (administrative fees on Tolls will not be reimbursed). 7.10 Parking fees, if reasonable are reimbursable for meetings and hotel stays. For vendors who contract with a third party for visitor parking at vendor’s place of business, Williamson County will not reimburse a vendor based on a percentage of its contracted visitor parking fees. Rather, Williamson County will reimburse Vendor for visitor parking on an individual basis for each time a visitor uses Vendor’s visitor parking. Receipts are required for reimbursement. If a receipt is not obtainable, then written documentation of expense must be submitted for reimbursement. 7.11 Operating and maintenance expenses as well as other personal expenses, such as parking tickets, traffic violations, and car repairs and collision damage are not reimbursable.

  • High Availability Registry Operator will conduct its operations using network and geographically diverse, redundant servers (including network-­‐level redundancy, end-­‐node level redundancy and the implementation of a load balancing scheme where applicable) to ensure continued operation in the case of technical failure (widespread or local), or an extraordinary occurrence or circumstance beyond the control of the Registry Operator. Registry Operator’s emergency operations department shall be available at all times to respond to extraordinary occurrences.

  • System Availability Although we will try to provide continuous access to the Service, we cannot and do not guarantee that the Service will be available 100% of the time and will not be liable in the event Service is unavailable. Actual service or network performance is dependent on a variety of factors outside of our control. If you notify us within twenty-four (24) hours and we confirm an outage consisting of a period of two (2) hours in any calendar month, and not due to any service, act, or omission of you, a third party, your applications, equipment or facilities, or reasons outside of our control, you shall be eligible for a service credit. A service credit shall be computed as a pro-rated charge for one day of the regular monthly fees for the Service in the next monthly statement. Intermittent service outages for periods of less than two (2) hours are not considered service outages. Outages caused by routine scheduled maintenance are also not considered an outage. You shall receive advance notice no less than forty-eight (48) hours in advance of our scheduled maintenance. Scheduled maintenance will be performed between 12:00 a.m. and 6:00 a.m. CST.

  • DNS name server availability Refers to the ability of a public-­‐DNS registered “IP address” of a particular name server listed as authoritative for a domain name, to answer DNS queries from an Internet user. All the public DNS-­‐registered “IP address” of all name servers of the domain name being monitored shall be tested individually. If 51% or more of the DNS testing probes get undefined/unanswered results from “DNS tests” to a name server “IP address” during a given time, the name server “IP address” will be considered unavailable.

  • Enhanced Optional Daily Usage File (EODUF) 12.1 The Enhanced Optional Daily Usage File (EODUF) service Agreement with terms and conditions is included in this Attachment as Exhibit D. Rates for EODUF are as set forth in Exhibit E of this Attachment. 12.2 BellSouth will provide EODUF service upon written request to its Account Manager stating a requested activation date.   • RDDS availability Refers to the ability of all the RDDS services for the TLD, to respond to queries from an Internet user with appropriate data from the relevant Registry System. If 51% or more of the RDDS testing probes see any of the RDDS services as unavailable during a given time, the RDDS will be considered unavailable.

  • FUNDING AVAILABILITY This Contract is contingent upon the continued availability of funding. If funds become unavailable through the lack of appropriations, legislative or executive budget cuts, amendment of the Appropriations Act, state agency consolidation or any other disruptions of current appropriations, DFPS will reduce or terminate this Contract.
