Inventory of fixtures and fittings. An inventory of fixtures and fittings is to be carried out at the beginning and at the end of the stay, by the owner or his representative and the hirer. This document is to be signed by both parties. The inventory will be the only reference in case of litigation concerning the fixtures and fittings. The state of cleanliness of the holiday home on arrival of the hirer should be stated in the inventory. The cleaning of the holiday home is the hirer’s responsibility for the period of the stay and the hirer must ensure the holiday home has been cleaned before leaving. Otherwise, the amount of cleaning is at € 50.
Inventory of fixtures and fittings. The inventory of the items and equipment contained in the furnished accommodation will be carried out jointly with the owner or his authorised representative for rental periods in excess of two weeks. For periods of less than two weeks, the tenant accepts the inventory below when making the on-line reservation. Any complaints concerning the inventory and the cleanliness of the furnished accommodation must be made within four hours of the handing over of the keys. The rented apartment contains furniture in accordance with the description of the furnished accommodation. The tenant will be liable for the items included in the inventory and will be obliged to reimburse the price of any items damaged and if necessary bear the cost of repairing them. The tenant must report any damage or breakages that may occur during his stay. The tenant undertakes to return the furnished accommodation upon departure as clean as it was upon his arrival. By accepting the general terms and conditions, the client agrees that his credit card may be debited for up to 30 days after the end of his stay. In the event of the theft of or damage to items forming part of the rented property, his card will be debited for the relevant amount. The hourly rate for non-standard repairs or cleaning is EUR 60/hour. Inventory of fixtures and fittings. The lessee states that it is familiar with the premises and does not request any more detailed description thereof. The premises are let in the state in which they are described in the inventory of fixtures and fittings upon entry. This shall be drawn up after due hearing of both sides, and prior to the entry into force of this lease, by an expert appointed by mutual agreement or - failing this - by two experts, with each of the parties appointing and remunerating its own. It is expressly stated in this respect that the lessee shall bear the costs of all work of any kind involving the conversion or fitting-out of the premises that may be necessary with a view to making them suitable for their intended use. This work for the purposes of conversion and/or fitting-out shall be done under the responsibility of the lessee, 125 who must have it carried out professionally and in accordance with the rules of the general regulations on protection at the workplace, and subject to the lessor's prior written agreement. Should major alterations be made to the premises rented by the lessee during the course of the lease, the lessor reserves the right to have an endorsement to the inventory of fixtures and fittings upon entry drawn up, at the lessee's expense. When the lease comes to an end, the lessee must return the premises in a perfect state for letting, save for normal wear and tear. The work required to restore the premises to their original state shall be carried out before the expiration of the lease. In the event of failure to comply with this proviso, the lessee shall be liable, without prejudice to its other obligations, for payment of an indemnity at least equivalent to the total amount of the rental, charges and taxes in force at the end of the lease, per full months of consecutive occupation required for the let premises to be restored to their original state.   • Fixtures and Equipment Each of the Company and its Subsidiaries (as applicable) has good title to, or a valid leasehold interest in, the tangible personal property, equipment, improvements, fixtures, and other personal property and appurtenances that are used by the Company or its Subsidiary in connection with the conduct of its business (the “Fixtures and Equipment”). The Fixtures and Equipment are structurally sound, are in good operating condition and repair, are adequate for the uses to which they are being put, are not in need of maintenance or repairs except for ordinary, routine maintenance and repairs and are sufficient for the conduct of the Company’s and/or its Subsidiaries’ businesses (as applicable) in the manner as conducted prior to the Closing. Each of the Company and its Subsidiaries owns all of its Fixtures and Equipment free and clear of all Liens except for (a) liens for current taxes not yet due and (b) zoning laws and other land use restrictions that do not impair the present or anticipated use of the property subject thereto.

  • Furniture, Fixtures and Equipment Sublessee shall have the right to use during the Term the office furnishings and equipment within the Subleased Premises that are identified on Exhibit C attached hereto, as such exhibit may be adjusted by mutual agreement of the parties prior to the Third Floor Premises Delivery Date (the “Furniture”), provided Sublessee may only use the Furniture located in the Second Floor Premises after the Second Floor Commencement Date. The Furniture is provided in its “AS IS, WHERE IS” condition, without representation or warranty whatsoever. Sublessee shall insure the Furniture under the property insurance policy required under the Master Lease, as incorporated herein, and pay all taxes with respect to the Furniture. Sublessee shall maintain the Furniture in good condition and repair, reasonable wear and tear excepted, and shall be responsible for any loss or damage to the same occurring during the Term. Sublessee shall surrender the Furniture to Sublessor upon the termination of this Sublease in the same condition as exists as of the applicable Delivery Date, reasonable wear and tear excepted. Sublessee shall not remove any of the Furniture from the Subleased Premises. Notwithstanding anything to the contrary herein, Sublessee may provide Sublessor with written notice one (1) time not less than forty-five (45) days prior to the Third Floor Premises Delivery Date that lists any items of Furniture that Sublessee does not want to use and Sublessor shall, at no cost to Sublessee, remove such items from the Subleased Premises prior to the Third Floor Premises Delivery Date and such items shall no longer be considered Furniture hereunder. Notwithstanding the foregoing, provided Sublessee is not in default beyond the expiration of any applicable cure or grace period as of the date of the expiration or earlier termination of this Sublease, which condition may be waived by Sublessor in its sole discretion, then upon the expiration or earlier termination of this Sublease, the Furniture shall become the property of Sublessee, and Sublessee shall accept the same in its “AS IS, WHERE IS” condition, without representation or warranty whatsoever except as provided in the Bill of Sale referred to in the following sentence. In the event the Furniture is to become the property of Sublessee upon the expiration or earlier termination of this Sublease pursuant to the terms of the immediately preceding sentence, then Sublessor agrees to execute and deliver to Sublessee a Bill of Sale in the form of Exhibit D attached hereto conveying and transferring to Sublessee the Furniture.

Schedule 4.14 describes all Fixed Assets owned by or an interest in which is claimed by any other person (whether a customer, supplier or other person) for which the Company is responsible (copies of all agreements relating thereto being attached to said Schedule 4.14), and all such property is in the Company’s actual possession and is in such condition that upon the return of such property in its present condition to its owner, the Company will not be liable in any amount to such owner. There are no outstanding requirements or recommendations by any insurance company that has issued a policy covering either (i) such Fixed Assets or (ii) any liabilities of the Company relating to operation of the Business, or by any board of fire underwriters or other body exercising similar functions, requiring or recommending any repairs or work to be done on any Fixed Assets or any changes in the operations of the Business, any equipment or machinery used therein, or any procedures relating to such operations, equipment or machinery. All Fixed Assets of the Company are set forth on Schedule 4.14 hereto.

  • Equipment and Inventory With respect to any Equipment and/or Inventory of an Obligor, each such Obligor has exclusive possession and control of such Equipment and Inventory of such Obligor except for (i) Equipment leased by such Obligor as a lessee or (ii) Equipment or Inventory in transit with common carriers. No Inventory of an Obligor is held by a Person other than an Obligor pursuant to consignment, sale or return, sale on approval or similar arrangement.
