IRC Section 125 Plan. The City will continue to maintain an IRC Section 125 Plan whereby employees will be able to pay for their share of health and hospitalization insurance premiums with pre-tax earnings. This plan will remain in effect so long as it continues to be permitted by the Internal Revenue Code.

16.5.2 All unit members who are eligible for District-paid benefits will be eligible to participate in the Employee Assistance Program.

Where the Plan of Benefits, or any component or program thereof, covering the staff employees of the Contributing Employer offers staff employees the ability to obtain coverage by making pre-tax payments or contributions, the Contributing Employer shall adopt and maintain a qualified Internal Revenue Code Section 125 plan to enable such payments to be made.
