LESSEE'S REPAIRS. 4. The Lessee agrees to keep the interior of the demised premises, along with the florescent fixtures, windows and exterior plate glass in good condition and repair excepting all repairs which are made necessary by reason of fire and other unavoidable casualties and reasonable wear and tear. Lessee will provide for its interior cleaning and janitorial services.

LESSEE'S REPAIRS. Lessee shall, at Lessee's sole cost and expense, keep the Premises in good and sanitary condition and repair at all times during the Term. All damage, injury or breakage to any part or portion of the Premises, and all damage, injury or breakage to any portion of the Property caused by the willful or negligent act or omission of Lessee or Lessee's agents, employees, contractors, licensees, directors, officers, partners, trustees, visitors or invitees (collectively, "Lessee's Employees"), shall be promptly repaired or replaced by Lessee, at Lessee's sole cost and expense, to the satisfaction of Lessor; provided, however, that Lessee shall be entitled to receive reimbursement for such expense to the extent that the cost of any such repair or replacement is received by Lessor from insurance obtained by Lessor as part of Operating Expenses and is related to damage to the Property rather than expenses, Lessor may make any repairs or replacements which are not made by Lessee within a reasonable amount of time (except in the case of emergency when such repairs or replacements can be made immediately), and charge Lessee for the cost of such repairs and replacements. Lessee shall be solely responsible for the design and function of all of Lessee Improvements whether or not installed by Lessor at Lessee's request. Lessee waives all rights to make repairs or replacements to the Premises or to the Property at the expense of Lessor, or to deduct the cost of such repairs or replacements from any payment owed to Lessor under this Lease.
LESSEE'S REPAIRS. A. Lessee, at its own cost and expense, shall (i) maintain all parts of the Premises in good condition, (ii) promptly make all necessary repairs and replacements, (iii) obtain trash removal, interior extermination and termite eradication services, (iv) keep the parking areas, driveways and alleys surrounding the Premises in a clean and sanitary condition.
LESSEE'S REPAIRS. A. Lessee, at its own cost and expense, shall (i) maintain all parts of the Premises, landscape and grounds surrounding the Premises (except those for which Lessor is expressly responsible hereunder) in good condition, (ii) promptly make all necessary repairs and replacements, (iii) keep the parking areas, driveways and alleys surrounding the Premises in a clean and sanitary condition, and (iv) maintain any spur track servicing the Premises, Lessee agrees to sign a joint maintenance agreement with the railroad company servicing the Premises if requested by the railroad company. Lessor shall have the right to coordinate all repairs and maintenance of any rail tracks serving or intended to serve the Premises and, if Lessee uses such rail tracks, Lessee shall reimburse Lessor from time to time, upon demand, for its proportionate share of the costs of such repairs and maintenance and any other sums specified in any agreement respecting such tracks to which Lessor is a party.
LESSEE'S REPAIRS. The Lessee covenants with the Lessor:
LESSEE'S REPAIRS. The Lessee shall be responsible for all maintenance of the demised premises and for the repair, if required, of the cooling, plumbing and electrical systems, normal wear and tear excepted, and acknowledges that such systems have been inspected and are in good condition. The doors and windows of the demised premises shall be kept whole and whenever any part thereof shall become broken, it shall immediately be replaced or repaired to the satisfaction of the Lessor and shall be paid for by the Lessee.
LESSEE'S REPAIRS. Lessee acknowledges that premises, including heating system, electrical system, plumbing, air conditioning, hot water tank, floor covering, doors, door hardware, windows and the interior of premises, will be, as of the date rent commences to accrue hereunder, under the possession and control of Lessee and Lessee agrees to regularly service and keep the same in good order, repair, maintenance and operation and agrees to promptly pay up to the first $15,000 per year, cumulative total per year, required to replace any major mechanical systems, including the HVAC system, plumbing or electrical. Should Lessor and Lessee disagree as to whether repair or replacement of a major mechanical system should be performed, Lessor and Lessee will mutually select a licensed commercial contractor with at least 10 years of experience regarding the repair/replacement of the mechanical system at issue, who will provide an opinion as to repair or replacement which Lessor and Lessee will follow. Lessee also agrees to keep premises, sidewalks and areas adjoining the leased premises in a clean, safe and sanitary condition, including removal of trash and the removal of snow, ice and debris from the doorways and sidewalks, but no chemical or salt shall be used on the sidewalks which shall damage the concrete. Lessee is also responsible for maintaining the lawn and landscaping. Lessee is to be responsible to Lessor for any and all damages or destruction to property, inside the Leased Premises, due to any burglary, vandalism, excluding acts of God, which may occur. It is also understood that Lessee will have ample burglary and liability insurance to cover any such incidents. In the event of such occurrence, said property is to be restored to original condition by Lessee. Lessee shall be responsible to contract for and pay for all janitorial services for the premises. Lessor has no responsibility or liability for janitorial services.

LESSEE'S REPAIRS. Except as above provided, Lessee shall at its expense, repair and maintain the entire premises in good order, condition and repair. Lessee will make no alterations in, or additions or improvements to the premises, including, but not limited to, sewers, air conditioning and heating, without written consent of Lessor.
LESSEE'S REPAIRS. The Lessee agrees to and does hereby assume and agree to pay for all cost for and to assume all responsibility for maintaining, repairing, keeping up and, replacing in whole or in part, the Demised Premises, it being further understood that Lessee will also keep Demised Premises in such repair and condition as may be required by the Board of Health, or the City, State, or other Federal authorities, free of all cost to the Lessor.
LESSEE'S REPAIRS. Lessee agrees, at Lessee's expense, at all times to keep the Leased Premises and appurtenances thereto in good order, condition and repair, clean, sanitary and safe, including but not limited to the replacement of equipment, including heating, ventilating and air conditioning units, fixtures and all broken glass (with glass of the same size and quality) and shall in a manner satisfactory to the Lessor, decorate and paint the Leased Premises when necessary to maintain at all times a clean and sightly appearance. If Lessee refuses or neglects to commence any such repairs or replacements within five (5) days after written demand, then and thereafter Lessor may, but shall not be obligated to do so, make such repairs and replacements without liability to Lessee for any loss or damage that may occur to Lessee's stock or business by reason thereof, and, if Lessor makes such repairs, Lessee shall pay to Lessor, on demand, as additional rent, the cost thereof together with interest at the rate of ten percent (10%) per annum from the date of payment by Lessor, and all such cost and interest shall become due and payable on the rental payment date immediately following such completion. Lessee, at its expense, shall replace all glass including plate glass, other breakable materials used in structural portions and any interior and exterior windows and doors in the Leased Premises which may become damaged or broken.
