LICENSE FEE ENTITLEMENT. (a) Pursuant to Massachusetts General Laws Chapter 166A, Section 9, the Licensee shall pay to the Town, throughout the term of this Renewal License, a License Fee equal to fifty cents ($.50) per Subscriber per year, or such higher amount as may in the future be allowed pursuant to State and/or federal law. The number of Subscribers, for purposes of this section, shall be calculated as required by law.

The five percent (5%) PEG Access payment, pursuant to Section 6.4, shall include the License Fee equal to fifty cents ($.50) per Subscriber per year, and the License Fee equal to eighty cents ($.80) per Subscriber per year payable to the Commonwealth of Massachusetts pursuant to M.G.L. c. 166A, Section 9 or as such fees may be amended from time to time.
LICENSE FEE ENTITLEMENT. (a) Subject to Section 8.2 infra, the City of Boston shall be entitled to receive from Licensee a License fee equal to five percent (5%) of Licensee's Gross Revenue less the value of any fees paid to the Massachusetts Cable Television Commission pursuant to X.X. x. 166A § 9, and less the value of any payments for Public, Educational and Governmental access. Notwithstanding the foregoing, Licensee agrees to pay the City an additional 3% on the 3% of Gross Revenues Licensee paid to the City for the period April 6, 1995 through July 31, 1997 (“Fee in a Fee Payments”). Said payment shall be paid in eight equal installments beginning July 1, 1998. If the Massachusetts Cable Television Commission ceases to be entitled to payments for any reason, the Licensee shall contribute the value of such payments to the City. If the Foundation ceases to provide access programming to the residents of the City of Boston, the Licensee shall provide financial support to any successor designated by the Issuing Authority.
LICENSE FEE ENTITLEMENT. Subject to applicable law, Licensee shall, on or before March 15th of each year, submit a license fee to the Issuing Authority as provided in Section 9 of Chapter 166A of the Massachusetts General Laws. The number of subscribers, for purposes of this section, shall be calculated on the last day of each year. Said license fees and the operating support for PEG access under Article 5 shall not exceed 5% of Licensee’s annual Gross Revenues. In accordance with 47 U.S.C. 542, Licensee shall, if requested in writing by the Issuing Authority, prepay a portion of said license fees and annual PEG grants or PEG capital grants, adjusted by the time value of money for prepayments, not to exceed $15,000.00 in the first eight years of the License, payable to the Issuing Authority or its designee, as directed by the Issuing Authority, for cable administration costs, as determined by the Issuing Authority, and Licensee may credit said payment against amounts otherwise due hereunder.

The Trustee shall adjust the net asset value (Trust Fund Evaluation) as of the dates specified in the preceding sentence to account for any variation between accrual of estimated license fee and the license fee payable pursuant to the Agreement, but such adjustment shall not affect calculations made prior thereto and no adjustment shall be made in respect thereof.
