The number of Subscribers, for purposes of this section, shall be calculated as required by law.

LICENSE FEE ENTITLEMENT. (a) Subject to Section 8.2 infra, the City of Boston shall be entitled to receive from Licensee a License fee equal to five percent (5%) of Licensee's Gross Revenue less the value of any fees paid to the Massachusetts Cable Television Commission pursuant to X.X. x. 166A § 9, and less the value of any payments for Public, Educational and Governmental access. LICENSE FEE ENTITLEMENT. Subject to applicable law, Licensee shall, on or before March 15th of each year, submit a license fee to the Issuing Authority as provided in Section 9 of Chapter 166A of the Massachusetts General Laws. The Trustee shall adjust the net asset value (Trust Fund Evaluation) as of the dates specified in the preceding sentence to account for any variation between accrual of estimated license fee and the license fee payable pursuant to the Agreement, but such adjustment shall not affect calculations made prior thereto and no adjustment shall be made in respect thereof.
