LIMITED DURATION APPOINTMENT. Appointments for Special Studies or Projects. Persons may be hired for special studies or projects of uncertain or limited duration which are subject to the continuation of a grant, contract, award, or legislative funding for a specific project.
LIMITED DURATION APPOINTMENT. Section 1. Persons may be hired for special studies or projects of uncertain or limited duration which are subject to the continuation of a grant, contract, award, or legislative funding for a specific project. Such appointments shall be for a stated period not exceeding two (2) years, except extended by legislative or Emergency Board action. Such appointment shall expire upon termination of the special study or projects.
a. No newly hired person on a limited duration appointment shall be entitled to rights under the layoff procedure and shall be so notified.
b. A person appointed from AFSCME regular status within the bargaining unit to a limited duration appointment shall be entitled to rights under the layoff procedure within their Agency.
Section 3. A person accepting such appointment shall be notified of the conditions of the appointment and acknowledge in writing that they accept that appointment under these conditions. Such notification shall include the following:
a. That the appointment is of limited duration.
b. That the appointment may cease at any time.
c. That persons who accept a limited duration appointment who were formerly classified state employees, from AFSCME, within the bargaining unit, are entitled to rights under the layoff procedure starting from the prior class within the Agency.
d. That in all other respects, limited duration appointees have all rights and privileges of other classified employees including but not limited to wages, benefits, and Union representation under this Agreement.
LIMITED DURATION APPOINTMENT. Persons may be hired for special studies and projects of uncertain or limited duration which are subject to the continuation of a grant, contract or award or legislative funding for special projects. Persons may also be hired to backfill behind an employee on approved leave including illness, injury, temporary reassignment to a developmental or rotational opportunity or for workload issues. Such appointments shall be for a stated period not exceeding two (2) years, but shall expire: 1) upon the earlier termination of the special study or project, 2) when the permanent employee returns to his position, or 3) when the workload issue is resolved. Successive appointments may be approved by the Agency. No newly hired person for a limited duration appointment shall be entitled to layoff rights. A person who accepts a limited duration appointment who was formerly a classified employee is entitled to rights under the layoff procedure starting from the prior classification. A person accepting such appointment shall be informed of the conditions of the appointment and acknowledge in writing that he/she accepts the appointment under these conditions.
LIMITED DURATION APPOINTMENT.
Section 1. Limited duration appointments may be made for special studies or projects of uncertain or limited duration, which are subject to the continuation of a grant, contract, award or legislative funding for a specific project. In addition, limited duration appointments may be made under the following conditions:
a. The incumbent in a permanent position is temporarily on a job rotation, limited duration appointment, or extended leave.
b. A permanent position is vacated in a class where reduction in positions is projected to occur.
c. The position is known to have limited work and funding, not to exceed two
LIMITED DURATION APPOINTMENT. Section 1. Persons may be hired either
(1) for special studies, projects, or purposes of uncertain or limited duration which are funded by grants, contracts, awards, student fees, or legislative funding for a specific project, or
(2) to replace a regular employee on leave of absence when it is known at the time of hire that the leave of absence will last for at least six (6) months.
LIMITED DURATION APPOINTMENT. If any of these positions are designated as limited duration, Section 2(B) and Section 3(D) of this Article will be modified so that layoff rights revert to the prior classification or successor to such classification, if any, held in DHS rather than PSU.

(d) Those persons who accept a limited duration appointment who were formerly classified State employees are entitled to rights under the layoff procedure starting from the prior class within the new Agency.
(e) That in all other respects, limited duration appointees have all rights and privileges of other classified employees including but not limited to wages, benefits and Union representation under this Agreement.

LIMITED DURATION APPOINTMENT. Section 1. Persons may be hired for special studies or projects of uncertain or limited duration which are subject to the continuation of a grant, contract, award, or legislative funding for a specific project. Such appointments shall be for a stated period not exceeding two (2) years but shall expire upon the earlier termination of the special study or projects. An employee’s limited duration appointment with an Agency may not exceed two (2) years except by mutual agreement of the Parties. For a limited duration appointment that exceeds two (2) years, the employee shall be placed on the Agency recall list in the affected geographic area when the limited duration appointment ends.
Section 2. Persons may be hired as limited duration appointments, for workload purposes, when needed to fill short-term or transitional assignments, such as, but not limited to, legislative directive, reorganizations, unanticipated workload needs or when position reduction is anticipated. These appointments will not be used in a manner that subverts or circumvents the filling of budgeted positions pursuant to Article 45 and Article 45.1-45.
