Maintenance Exclusions. The maintenance package excludes: support for third-party software/services, support for software/services not developed by F&S, updates to third-party software, hardware/software configurations of servers/services not managed by F&S. Anything not expressly included in provision 6.2.1 is excluded from the scope of the maintenance package.
Maintenance Exclusions. All items listed within section 4.2 (Maintenance Exclusions) including (but is not limited to) remediation of issues which do not constitute a Deviation. AssetWorks shall have no obligation but may attempt to correct such situations at Customer’s expense.

Tumbleweed will only provide Maintenance Services for (x) the then-current version of the Software, (y) the immediately preceding two (2) versions of the Software, and (z) all preceding versions of the Software (in addition to the immediately preceding version) for a period of [ * ] following the release of such preceding version(s). As used in this subsection (h), a "version" is any version of the Standard Software designated, in Tumbleweed's sole but reasonable discretion, by a change in the version number to the left of the first decimal point. Furthermore, Maintenance Services do not include any service required as a result of: (a) any modification of the Software performed by any Person other than Tumbleweed or any of its Associates (except for localizations certified by Tumbleweed as set forth in Section 5(f) and except for modifications to the base Software enabled by the Developer Kit Software); (b) operation of the Software under environmental conditions outside of normal operating ranges for computer hardware for UPS's data centers; (c) any use of the Software on a system that does not meet Tumbleweed's minimum standards for such Software, to the extent such minimum standards are included in the Specifications; or (d) the operation of hardware or non-Tumbleweed software (where such non-conformity is due solely to the operation of such hardware or non-Tumbleweed software). In the event that Tumbleweed provides services that are shown to be due to a factor not covered by the Maintenance Services enumerated in this Agreement, UPS shall pay Tumbleweed's then-current time --------------- [*]Confidential treatment has been requested with respect to certain information contained in this document. Maintenance does not include and Ordering Activity will perform, among other things, as Ordering Activity deems necessary or appropriate (or cause to be performed by Contractors): (a) the installation, activation, configuration, deployment, implementation, Updating, and operational training for licensed Software, including gaining access to and utilizing all features and functionality of such Software; (b) the provision of initial support assessment and distinguish whether or not the issue is licensed Software-related that should become an Escalated Issue; (c) simulating and attempting to recreate Escalated Issues and performing any required interoperability tests between Software and any Ordering Activity network/system component; and (d) facilitation and collection of samples and escalation of malware and virus-specific Escalated Issues.
Maintenance Exclusions. Customer-provided terrestrial communications or electrical power, accident, fire, lightning, snow, snow removal, or other hazards beyond normal range of use, vandalism, trouble calls where no problem is found and the reported problem does not repeat within five calendar days, or failures or malfunctions resulting from exposure of the Equipment to conditions beyond its operating conditions. Any such failures and malfunctions will be repaired on a commercially reasonable effort basis and billed to Customer on a time and materials basis. Customer shall grant or have granted access as required for maintenance of the Equipment during maintenance hours, including appropriate security escort when required. SOFTWARE LICENSE AND SUPPORT
Maintenance Exclusions. This Maintenance Agreement excludes services or repairs necessitated by or arising out of: -
10.1 Maintenance or repair work performed on the equipment without the authorization of ‘Siyaya’.
10.2 Tampering with the equipment by any person not authorized by ‘Siyaya’.
Maintenance Exclusions. The following items shall not be a requirement of this document and shall not be the Contractor's responsibility excepting, however, the Owner may require such services or additional services to be performed as a Contractor reimbursable expense without markup:
1. Eddy current testing of chiller bundles
2. Complete maintenance rebuild of chillers (complete teardown with replacement of all bearings and gaskets.)
3. Refrigerant, exclusive of major losses of more than five pounds at one time, for replenishment due to minor leaks.
4. Repairs to cooling tower basin or structure, or replacement of ceramic fill.
5. Costs to upgrade equipment, exclusive of engineering and project management.
6. Annual inspections and all maintenance to the capacitors and busduct.

Maintenance Exclusions. The items identified below are covered by Seller during the Warranty Period provided they have been supplied and installed by Seller. Following the end of the Warranty Period, the items identified below are specifically excluded from coverage from this TMA, unless otherwise noted in Addendum II (A) Terminal Equipment List or as later agreed in writing. Customer may request services on the items identified below at the then current Demand Services Rates listed in Addendum I – Section D.
