Marine Services. 9.5.1 The Seller Group shall procure the provision of all Marine Services necessary for the safe approach from the Pilot Boarding Station, berthing, mooring, loading, unberthing and safe departure to the Pilot Boarding Station of an Approved LNG Ship in compliance with the terms of this Clause 9.5. 9.5.2 The Buyer acknowledges that the following services and facilities are not provided nor procured by the Seller Group: (a) facilities and loading lines for liquid or gaseous nitrogen to purge an LNG ship tanks except where nitrogen is required for draining and purging of the liquid and vapour lines prior to disconnection of loading arms; (b) facilities for providing bunkers; (c) facilities for the handling and delivery to the LNG ship of ship's stores, provisions and spare parts. 9.5.3 The Seller Group shall ensure that: (A) adequately well trained and experienced pilots and mooring masters in sufficient numbers are available at all times in order to assure the safe and reliable berthing, unberthing and transit to and from the berth as part of the provision of Marine Services under Clause 9.5.1; (B) fit for purpose harbour or offshore tugs of adequate design and power are available at all time in sufficient numbers in order to assure the safe and reliable berthing, unberthing and transit to and from the berth as part of the provision of Marine Services under Clause 9.5.1; (C) adequately well trained and experienced tug masters in sufficient numbers are available at all times to operate the harbour or offshore tugs; (D) fit for purpose marine support craft (including pilot vessels, mooring boats and service/security boats) in sufficient numbers are available at all times in order to support intended marine operations as part of the facilitation of Marine Services under Clause 9.5.1; (E) fit for purpose metocean measuring and monitoring systems and navaids and associated marine support infrastructure is available to support safe and reliable marine operations as part of the facilitation of Marine Services under Clause 9.5.1. 9.5.4 [***]
Marine Services. With effect from the First Operations Date: (a) the ACP shall at is own cost and risk: (i) provide or procure the provision of pilotage services for Eligible Container Vessels using the Corozal Container Terminal; (ii) undertake the co-ordination and scheduling for the entry, berthing, unberthing and sailing of Eligible Container Vessels to, at or from the Corozal Container Terminal in a manner that optimizes the utilisation of the access channel and after taking account of the priority of Panama Canal transit traffic, any ongoing Terminal Construction Works, the ACP's and the Concessionaire's blasting and/or dredging obligations under clauses 5.1 and 7.6, and the security and operational integrity of the Panama Canal; and (iii) provide waterside safety, and safety of water navigation in the access channel, the turning basin and the vicinity of the Corozal Container Terminal; (b) the Concessionaire shall: (i) provide to the ACP all necessary information in relation to its customers and Eligible Container Vessels proposing to berth or unberth at or from the Corozal Container Terminal in order to enable the ACP to undertake the port co- ordination tasks mentioned in clause 6.1(a)(ii); (ii) provide, at no cost to the ACP, office space at the Concession Area (with water, electricity, sewage, air conditioners, and phone and internet lines) for any person assigned by the ACP to perform the port co-ordination tasks referred to in clause 6.1(a)(ii); (iii) without prejudice to clauses 3.1, 6.1 and 6.2, pay to the ACP a port co- ordination fee, at the commercial rates prevailing as at the First Operations Date; and (iv) subject always to clause 8.1 provide or procure (including where possible through the ACP) the provision of towage services to its customers.
Marine Services. Marine services shall be provided by the TNPA in accordance with the agreed service between the LNG Carrier agent and the harbour master at the Port, and marine services charges will be payable by the LNG Carrier owners to the LNG Carrier agent to cover for pilotage, tugs or craft assistance, berthing services running of ships lines and LNG Carrier tracking systems. The details of the marine services tariffs as at the Signature Date are stipulated in the table in Schedule 20. The tariffs specified in Schedule 20 are in [month and year] prices. The TNPA shall provide port and marine services to the Terminal Operator in accordance with its berthing and marine resource policies and procedures, as may be revised from time time. Port dues shall be levied by the TNPA for its costs in providing Port protective works and dredging. The port dues will be payable by the LNG Carrier owner based on each LNG Carrier’s technical characteristics. The port dues as at the Signature Date are specified in Schedule 21 and are in [month and year] prices.
Marine Services. (a) Pursuant to the provisions of the Indian Ports Act, the Authority hereby appoints the Concessionaire to provide the Marine Services to all users of the Port (including itself, Users of the Terminal, other terminal operators that may be appointed by the Authority and users of facilities developed in future Phases) on behalf of the Authority. (b) The Concessionaire shall provide the Marine Services on and from the earlier of the Partial Commercial Operation Date or the Commercial Operation Date and until the Termination Date within the Port Maritime Area on a round-the-clock, non-discriminatory basis, in accordance with Part 1 of Schedule 6 (Service Specifications), Good Industry Practice, the Port By-Laws, all Consents and Laws, all Applicable S&E Laws, the S&EA, the IFC Performance Standards and general or special directions or instructions of the Conservator. (c) The Concessionaire agrees that it shall at all times during the Services Period, operate and maintain the numbers, capacity and condition of the Port Crafts and employ such number of Pilots in accordance with the type, number and capacity of vessels that are scheduled to call at the Port (whether at the Terminal or at other facilities developed in future Phases). Notwithstanding anything to the contrary in the foregoing sentence, the Concessionaire shall at all times during the Services Period provide the Port Crafts that at a minimum complies with the requirements of Part 1 of Schedule 6 (Service Specifications). (d) The Concessionaire agrees that it shall provide all users of the Port (including itself, Users of the Terminal, other terminal operators that may be appointed by the Authority and users of facilities developed in future Phases) with Equal Access to the Marine Services. For the purpose of this Clause 14.5(d), Equal Access shall mean where equivalent circumstances exist: (i) subject to the provisions of Clause 14.6(c), all the users of the Port shall be entitled to the same level, timing and priority of service as that provided by the Concessionaire to itself or to the Users of the Terminal; and (ii) the Concessionaire shall not unfairly discriminate against the Authority, any future terminal operators or users of facilities developed in future Phases, by refusing to provide any Marine Service on the same timely basis as such service is provided to itself or the Users of the Terminal, provided however that the Authority (either directly or through the Conservator) or any other Gov...
