Common use of NAMED HOLIDAYS Clause in Contracts

NAMED HOLIDAYS. (A) With the exception of Article 22.06, Article 22 is replaced in its entirety by the following: (a) An employee to whom these provisions apply required to work on a Named Holiday, which are: New Year's Day Labour Day Alberta Family Day Thanksgiving Day Good Friday Remembrance Day Victoria Day Boxing Day Canada Day and all general holidays proclaimed to be a statutory holiday by any of the following: (i) the Municipality in which the site is located; (ii) the Province of Alberta; or (iii) the Government of Canada; shall be paid at one and one-half times (1 1/2X) their basic rate of pay for their regularly scheduled shift worked on a Named Holiday and two times (2X) their basic rate of pay for time worked in excess of their regularly scheduled shift. (b) An employee to whom these provisions apply required to work on Christmas Day and the August Civic Holiday shall be paid for all hours worked on the Named Holiday at two times (2X) their basic rate of pay. (c) An employee to whom these provisions apply shall be paid, in addition to their basic rate of pay, five percent (5%) of their basic hourly rate of pay in lieu of the Named Holidays, and the Floater Holiday.”

NAMED HOLIDAYS. (A) With the exception of Article 22.06Temporary, Article 22 is replaced in its entirety by the following:Part-Time and Casual Employees (a) An employee to whom these provisions apply Temporary, part-time and casual Employees required to work on a Named Holiday, which are: New Year's Day Labour Day Alberta Family Day Thanksgiving Day Good Friday Remembrance Day Victoria Day Christmas Day Canada Day Boxing Day Canada August Civic Day and all general holidays proclaimed to be a statutory holiday by any of the following: (i) the Municipality in which the site East Central 911 Call Answer Society is located; (ii) the Province of Alberta; or (iii) the Government of Canada; Canada shall be paid at one and one-one half times (1 1/2X) their basic rate of pay for their regularly scheduled shift worked on a Named Holiday the first twelve (12) hours worked, and two times (2X) their basic rate of pay for time all hours worked in excess of their regularly scheduled shifttwelve (12) hours. (b) An employee to whom these provisions apply required to work on Christmas Day Temporary and the August Civic Holiday shall be paid for all hours worked on the Named Holiday at two times (2X) their basic rate of pay. (c) An employee part-time Employee to whom these provisions apply shall be paid, in addition to their basic rate of pay, five percent (5%) of their basic hourly rate of pay in lieu of the Named Holidays, Holidays and the Floater Holiday.” (c) A casual Employee to whom these provisions apply, who meets all of the eligibility requirements of the Employment Standards Code and has worked 5 of the 9 preceding same week days as the named holiday, shall be compensated with 1 day’s pay at their regular rate of pay.

NAMED HOLIDAYS. (A) With the exception of Article 22.06, Article 22 is replaced in its entirety by the following: (a) An employee to whom these provisions apply required to work on a Named Holiday, which are: New Year's ’s Alberta Family Day Good Friday Victoria Day Canada Day August Civic Day Labour Day Alberta Family Day Thanksgiving Day Good Friday Remembrance Day Victoria Christmas Day Boxing Day Canada Day and all general holidays proclaimed to be a statutory holiday by any of the following: (i) the Municipality in which the site Health Care Facility is located; (ii) the Province of Alberta; or (iii) the Government of Canada; shall be paid at one and one-half times (1 1/2X11/2X) their basic rate of pay for their regularly scheduled shift the first seven and three-quarter (73/4) hours worked on a Named Holiday and two times (2X) their basic rate of pay for time worked in excess of their regularly scheduled shiftseven and three-quarter (73/4) hours. (b) An employee to whom these provisions apply required to work on Christmas Day and the August Civic Holiday shall be paid for all hours worked on the Named Holiday at two times (2X) their basic rate of pay. (c) An employee to whom these provisions apply shall be paid, in addition to their basic rate of pay, five percent (5%) of their basic hourly rate of pay in lieu of the Named Holidays, Holidays and the Floater Holiday.”"

NAMED HOLIDAYS. (b) An employee to whom these provisions apply required to work on Christmas Day and the August Civic Holiday shall be paid for all hours worked on the Named Holiday at two times (2X) their her basic rate of pay. (c) An employee to whom these provisions apply shall be paid, in addition to their her basic rate of pay, five four point six percent (54.6%) of their her basic hourly rate of pay in lieu of the Named Holidays, and the Floater Holiday.”"

Note: EMS employees, please refer to additional Clause 22.08 in EMS Local Conditions (Page 220) (A) With the exception of Article 22.06, Article 22 is replaced in its entirety by the following: (a) An employee to whom these provisions apply required to work on a Named Holiday, which are: New Year's Day Labour Day Alberta Family Day Thanksgiving Day Good Friday Remembrance Day Victoria Day Boxing Day Canada Day and all general holidays proclaimed to be a statutory holiday by any of the following: (i) the Municipality in which the site is located; (ii) the Province of Alberta; or (iii) the Government of Canada; shall be paid at one and one-half times (1 1/2X) their her basic rate of pay for their her regularly scheduled shift worked on a Named Holiday and two times (2X) their her basic rate of pay for time worked in excess of their her regularly scheduled shift. (b) An employee to whom these provisions apply required to work on Christmas Day and the August Civic Holiday shall be paid for all hours worked on the Named Holiday at two times (2X) their her basic rate of pay. (c) An employee to whom these provisions apply shall be paid, in addition to their her basic rate of pay, five four point six percent (54.6%) of their her basic hourly rate of pay in lieu of the Named Holidays, and the Floater Holiday.”

(b) An employee to whom these provisions apply required to work on Christmas Day and the August Civic Holiday shall be paid for all hours worked on the Named Holiday at two times (2X) their basic rate of pay. (c) An employee to whom these provisions apply shall be paid, in addition to their basic rate of pay, five percent (5%) of their basic hourly rate of pay in lieu of the Named Holidays, and the Floater Holiday.”

(b) An employee Employee to whom these provisions apply required to work on Christmas Day and the August Civic Holiday shall be paid for all hours worked on the Named Holiday at two times (2X) their basic rate Basic Rate of payPay and three times (3X) their Basic Rate of Pay for time worked in excess of their regularly scheduled shift. (c) An employee Employee to whom these provisions apply shall be paid, in addition to their basic rate Basic Rate of payPay, five percent (5%) of their basic hourly rate of pay in lieu of the Named Holidays, and the Floater Holiday.”

NAMED HOLIDAYS. (b) An employee to whom these provisions apply required to work on Christmas Day and the August Civic Holiday shall be paid for all hours worked on the Named Holiday at two times (2X) their basic rate of pay. (c) An employee Employee to whom these provisions apply shall be paid, in addition to their basic rate of pay, five percent (5%) of their basic hourly rate of pay in lieu of the Named Holidays, and the Floater Holiday. (c) When July 1st falls on a Sunday, July 2nd is the legal holiday and shall be kept and observed as such.”
