NOT IN USE. The question as to whether or not the incumbent of a new job not now in existence or the incumbent of a job now in existence which changes in duties or responsibilities is entitled to belong to the bargaining unit will be discussed between the union and the company and if agreement cannot be reached will be referred to the umpire and dealt with at step four of the general grievance procedure. The umpire, in making his/her decision, will have regard to the fact that the parties agree that persons having access to confidential information belonging to the company, or exercising managerial functions, should be excluded.
NOT IN USE. (a) Local 1324 may appoint and the company shall recognize a negotiating committee consisting of the one (1) committeeperson and the chairperson of the negotiating committee. (b) A national representative of the union may be present and participate in meetings between the negotiating committee and the human resource manager or his/her nominee. More than one national representative may participate with the committee whenever mutually agreed upon. (c) The president of Local 1324 or his/her nominee shall be an ex-officio member of the negotiating committee provided that, to be an ex-officio member, he/she must be an employee of the company and also provided that he/she shall not be paid by the company while attending meetings of the negotiating committee. (a) The appropriate allocation of the committeeperson to his/her jurisdictions shall be the responsibility of the union. (b) The committeeperson shall be allocated as provided in section 7.04(a) to represent a designated group of employees (hereinafter referred to as his/her "jurisdiction"). Such allocation shall be described from time to time in Appendix 'A'.
NOT IN USE. Upon request of the committeeperson or the chair person of the negotiating committee, the company shall review the volume of work required of such employee, taking into consideration the time he/she is permitted to leave his/her regular company duties under the provisions of this agreement. If, on such review, the company considers that an adjustment of the volume of work required of such employee is necessary, the volume shall be adjusted by the company accordingly.

NOT IN USE. Any replacement to the Key Personnel shall be subject to the prior written agreement of UKRI (not to be unreasonably withheld). Such replacements shall be of at least equal status or of equivalent experience and skills to the Key Personnel being replaced and be suitable for the responsibilities of that person in relation to the Goods and/or Services. 15 TUPE 15.1 The Supplier warrants that the provision of the Goods and/or Services shall not give rise to a transfer of any employees of the Supplier or any third party to UKRI pursuant to TUPE.

NOT IN USE. The Licensee shall be responsible for paying, and the Licensor shall not be liable to pay, all applicable existing and future charges, taxes (including property tax and Goods and Services Tax (“GST”)), assessments, outgoings and impositions which are now or which at any time during the Licence Period may be imposed or charged in respect of the Licensee's operations on the Premises or in relation to this Agreement to the relevant taxing authorities, statutory/regulatory authorities, and utilities/service providers. The charges shall include all charges for / relating to the connection and supply of water, electricity, gas, telecommunications and any water-borne sewerage systems, and other services consumed or used at or in relation to the Premises and all charges levied by the relevant authorities in respect of the Premises.
NOT IN USE. The Licensee shall ensure that the Works are completed within 3 months from the commencement of the Licence Period or such other extended period as may be allowed by the Licensor at its discretion. For the avoidance of doubt, any allowance by the Licensor in this respect does not operate to change the commencement and end date of the Licence Period.
