Notice requirements for Parental Leave. 41.6.1 Birth related leave 41.6.1.1 A pregnant employee intending to take birth related leave must, at least 10 weeks prior to each proposed period of leave, provide the Company with a medical certificate issued by a medical practitioner. This certificate must indicate the expected confinement date, and be accompanied by a statutory declaration confirming:  that the employee will have responsibility for care of the child;  the intended first and last days of any associated paid leave;  the particulars of any period of parental leave sought or taken by her spouse in relation to the birth; and  that the employee will not engage in any conduct inconsistent with her contract of employment while on parental leave. 41.6.1.2 The spouse of a pregnant employee intending to take birth related leave must, at least 10 weeks prior to each proposed period of leave, provide the Company with a medical certificate issued by a medical practitioner which names his/her spouse, confirms that his/her spouse is pregnant, and identifies the expected date of birth or the date on which the birth took place. This certificate must be accompanied by a statutory declaration confirming:  that the employee will have responsibility for care of the child;  the particulars of any period of parental leave sought or taken by his/her spouse in relation to the birth;  the intended first and last days of any associated paid leave; and  that the employee will not engage in any conduct inconsistent with his contract of employment while on parental leave 41.6.2 Adoption related leave 41.6.2.1 If an employee intends to take adoption related leave at the time of placement of a child for adoption purposes, the employee must, as soon as the employee is aware of the expected date of placement, but no less than 14 days before the placement, give written notice to the Company of: (i) the date of placement; and (ii) the date of the commencement of any period of adoption leave to be taken at the time of placement of the child. 41.6.2.2 Before taking adoption leave, an employee must provide the Company with: (i) a statement from an adoption agency or other appropriate body of the presumed date of placement of the child with the employee for adoption purposes; or (ii) a statement from the appropriate government authority confirming that the employee is to have custody of the child pending application for an adoption order; and (iii) in relation to any proposed period of adoption leave, a statutory dec...

  • Late Application for Parental Leave When an application for parental leave under sub-article (A) above is not made in accordance with sub-article (c), the employee is nonetheless entitled to, and upon application to the Co-operative shall be granted, parental leave under this Article for the portion of the leave period that remains at the time the application is made.

  • Pregnancy and Parental Leave (a) Pregnancy/Parenting leave will be granted in accordance with the provisions of the Employment Standards Act, except where amended in this provision. (b) If possible the employee shall give written notification at least one (1) month in advance of the date of commencement of such leave and the expected date of return. (c) The employee shall reconfirm her intention to return to work on the date originally approved in subsection (b) above by written notification received by the Employer at least four (4) weeks in advance thereof. (d) An employee who is on pregnancy leave as provided under this Agreement, who has completed five (5) months of continuous service and has applied for and is in receipt of Employment Insurance pregnancy/ parental benefits pursuant to the Employment Insurance Act shall be paid a supplemental employment benefit. That benefit will be equivalent to the difference between seventy-five percent (75%) of her regular weekly earnings (which for part-time employees shall include percentage-in-lieu) and the sum of her weekly Employment Insurance benefits and any other earnings. Such payment shall commence following receipt by the Employer of the employee's Employment Insurance cheque stub as proof that she is in receipt of Employment Insurance pregnancy/ parenting benefits, and shall continue while the employee is in receipt of such benefits for a maximum period of seventeen (17) weeks. The employee will endeavour to provide a copy of the Employment Insurance cheque stub within two (2) weeks of receipt of the employee’s EI benefit. The employee's regular weekly earnings shall be determined by multiplying her regular hourly rate on her last day worked prior to the commencement of the leave times her normal weekly hours.   • Notice Requirements and Commencement of Leave (1) An employee who requests parental leave for the adoption or caring of a child shall be required to provide proof of adoption or birth of the child. (2) An employee shall provide written notice, at least four (4) weeks in advance, of the intended commencement date of the maternity and/or parental leave. (In the case of adoption of a child, the employee shall provide as much notice as possible.) (3) The Employer may require a pregnant employee to commence maternity leave where the duties of the employee cannot reasonably be performed because of the pregnancy.   • Maternity and Parental Leave Employees are eligible for unpaid leave of absence from employment subject to the conditions in this article. Every employee who intends to take a leave of absence under this article will give at least four weeks' notice in writing to the Employer unless there is a valid reason why such notice cannot be given and will inform the Employer in writing of the length of leave intended to be taken. (h) A Nurse shall have the right to a personal leave of absence without pay to commence immediately following a parental/pregnancy/ adoption leave of absence, provided the sum of all such leaves of absence do not exceed twelve continuous months per pregnancy/ adoption.

  • Overtime requirements No contractor or subcontractor contracting for any part of the contract work which may require or involve the employment of laborers or mechanics shall require or permit any such laborer or mechanic in any workweek in which he or she is employed on such work to work in excess of forty hours in such workweek unless such laborer or mechanic receives compensation at a rate not less than one and one-half times the basic rate of pay for all hours worked in excess of forty hours in such workweek.
