Occupancy Permits. The Village will not issue any occupancy permits for the Project until all Public Improvements are complete and accepted by the Village.

Occupancy Permits. No structure shall be occupied until it and all of its appurtenances have been completed, all roads necessary for ingress and egress to the said structure have been completed to an extent which will permit unquestionable ease of access for emergency vehicles, and all of the other requirements of this Agreement and the Plan and other ordinances, laws, rules or regulations regarding such structure have been complied with, and the same have been inspected and approved by the Township, and the Township has issued an occupancy permit or permits therefor. Furthermore, no structure shall be occupied until provisions satisfactory to the Township Engineer have been made (including but not limited to seeding and sodding) to prevent runoff of rain water, melting snow, etc., from being discharged onto adjacent lands or onto the street or pavement and to prevent such runoff from coming onto said lot, street or pavement from other adjacent lands. The provisions of this Paragraph shall not prevent occupancy where the asphalt base course of any roadway or easement is constructed to the extent required by the Township and Developer desires to delay the top surfacing of said roadway until the end of the term in which the improvements are required to be completed. All stormwater-related improvements to each lot and all stormwater-related improvements that are affected by stormwater entering or exiting each lot must be completed before occupancy of any building on that lot.

Conditional provisions for the installation of any required sidewalk must be made if the sidewalk is not installed prior to requesting the Certificate of Occupancy. The Developer may request dedication of the Improvements in phases, however, no less than a completed street or significant portion there of shall be dedicated. The City will not be required to accept dedication of a single Improvement (sewer main, water main, etc.) without the dedication of all other related improvements in the street. Dedications shall not be made on a lot to lot basis.
Occupancy Permits. It is understood and agreed by both parties hereto that occupancy permits for any structure shall not be issued until all planned public improvements have been sufficiently completed so essential public utility services and traffic access are provided to the structure.

Occupancy Permits. 1. VILLAGE may withhold occupancy permits for individual buildings constructed within the DEVELOPMENT in case of any default pertaining to this Agreement on the part of DEVELOPER. 2. DEVELOPER agrees that said land division identified in Section 3 of this Agreement must be approved by VILLAGE and recorded prior to the issuance of an occupancy permit for any building constructed within the DEVELOPMENT.
Occupancy Permits. A. As to each building constructed on the Subject Realty, the City agrees to issue occupancy permits (certificates of occupancy) within a reasonable time (which, in any event, shall not exceed ten (10) business days after application) or to issue a letter of denial within said period of time informing Developer and the individual or entity to whom the building permit was issued specifically as to those corrections necessary as a condition to the issuance of a certificate of occupancy and quoting the section of the Code relied upon by the City in its request for correction. B. [INSUFFICIENT INFORMATION PROVIDED TO REVIEW AT THIS TIME] Subject to the provisions of Section 15C below, the City agrees that occupancy permits (certificates of occupancy) (temporary, conditional or permanent, as the case may be) shall be issued as to each separate building upon (a) proper application of the Developer or the party seeking occupancy, (b) compliance with all applicable building codes, zoning ordinance requirements and other applicable requirements of law, and (c) [to follow]. C. If, and to the extent that, any building constructed on the Subject Realty is designed with separate interior tenant spaces, then the City agrees that it shall issue occupancy permits (certificates of occupancy) under the provisions of Section 14B above on a tenant space-by-tenant space basis provided that the incomplete portions of said building do not pose any material threat of public safety to the occupants if such tenant space(s), it being understood that the Developer will likely not complete the interior buildout of any particular tenant space until a tenant for that space is located and its build-out requirements are determined.
Occupancy Permits. The VILLAGE shall issue occupancy permits within a reasonable period of time following application thereof or post a notice of denial informing the applicant specifically as to the corrections necessary as a condition precedent to the issuance of an occupancy permit and designating the section of the Code of Ordinances relied upon by the VILLAGE in its request for correction. VILLAGE agrees to issue temporary occupancy permits in accordance with VILLAGE Ordinances, good for six (6) months, between November 1, and April 15 of each year, when final grading work, landscaping, and pavement installation cannot be completed. No occupancy permits will be required for the activities described in the Operations Plan during the Land Reclamation, Operations and Implementation Plan phase of the project.
