OPERATION CONDITIONS. 6.1 All equipment shall be designed for smooth, efficient and trouble free operation in tropical humid climate of 45 Q C ambient and a humidity of 90%. 6.2 In cases where the offer deviates from the specification, the vendor shall indicate clearly in his offer the specification proposed by him along with details thereof and the reasons for the deviation. Each exception to the specification or other parts of the tender document shall be listed separately by the vendor. If exceptions are not clearly listed they will not be considered by the Procurement agency later.

OPERATION CONDITIONS. The Generating Company shall have the right to investigate, study, develop, construct, own, operate and maintain the FACILITIES described in Annex 1 and its future extensions for power generation and electricity; performing environmental impact studies, field studies and sampling, generate, sell and convey the generated energy, have licenses and / or temporary or permanent permits for access and use of national areas, take samples, perform activities required for project development having permission of the respective institution, open quarries and extract and / or depositing rock, soil, sand and building materials, using underground water and surface water, use of ambient air, emission of gases into the environment;
OPERATION CONDITIONS. In order to carry out the precious metals business, the Parties shall contribute the following resources: 2.1.1 Party A or its affiliate shall contribute the following resources or satisfy the following conditions: (1) Each Licensed Company and its license for precious metals business; for avoidance of doubt, the precious metals business teams under the existing investment consulting business of Party A's affiliate (including Shenzhen, Chongqing and Shanghai teams that are engaging in the business at Haixi Precious Metals Exchange) will not participate in the business cooperation hereunder.   • Termination Conditions Such license shall not be terminated or its exploitation enjoined, until and unless: (i) Hitachi has committed a material breach of its obligations under this IP License Agreement, Opto-Device has given written notice of such breach to Hitachi and such breach remains uncured after the Cure Period, or, in the case of a breach, which cannot be cured within such Cure Period, Hitachi has not instituted within such Cure Period steps necessary to remedy the default and/or thereafter has not diligently pursued the same to completion; or (ii) such a material breach is incurable. In the event the breach is a curable breach that cannot be cured within the Cure Period but with respect to which Hitachi has instituted steps necessary to remedy the default and is thereafter diligently pursuing such cure, both parties shall negotiate to determine whether further pursuit of such cure is reasonable. If the parties cannot agree on a resolution in such negotiations, then this issue shall be referred to arbitration pursuant to the arbitration procedures set forth in Exhibit B hereto to decide whether such breach can be cured or any other alternative remedy should be adopted. In the event the breach is an incurable breach, the parties agree that the matter shall be referred to arbitration pursuant to the arbitration procedures set forth in Exhibit B hereto to determine the appropriate remedy. In the event that either party submits the dispute to arbitration, both parties shall cooperate in such binding arbitration in accordance with Exhibit B.
