Common use of Overtime Premium Clause in Contracts

Overtime Premium. (a) Employees shall be entitled to payment of time and one-half (1-1/2X) the employee's basic straight time hourly rate for all authorized overtime work in excess of seven and one-half (7-1/2) hours in a tour of duty or in excess of the average full-time hours of work over the period scheduled by the Hospital. Such period for this purpose shall not exceed two (2) weeks. It is understood that no overtime will be paid where the time worked was a result of an exchange at shifts between employees. Overtime shall be distributed as equally as practical among those employees normally performing the type of work to be done on overtime. Notice of overtime work shall be given as soon as practically possible. It is understood and acknowledged that the Hospital has the right to require employees to perform reasonably authorized overtime work. Call-back shall not be considered as hours worked for purposes of this Article. Overtime premium will not be duplicated nor pyramided nor shall other premiums be duplicated nor pyramided nor shall the same hours worked be counted as part of the normal work week and also as hours for which the overtime premium is paid. Where an employee is required to work additional overtime contiguous to an overtime shift within a twenty-four (24) hour period, the employee will be compensated at the rate of double time his or her straight time hourly rate for all additional contiguous overtime hours worked. (b) Overtime shifts will be offered on a rotating seniority basis (over a two (2) week pay period), first to full-time and then to part-time within the home department. The refusal of an overtime shift within the home department shall constitute time worked.

Where Not applicable. Standby pay shall, however, cease where an employee is required called in to work, and works during the period of standby. Where employees are called back to work additional overtime contiguous after having completed a regular shift and prior to an overtime the commencement of their next regular shift within they shall receive a twenty-minimum of four hours of work or four (244) hour period, the employee will be compensated hours pay at the rate of double time and one-half their regular hourly earnings. Where call back is immediately prior to the commencement of their regular shift the call back pay will only apply to the point of commencement of a regular shift at the rate of time and one-half (1 after which they shall revert back to the regular shift. Call back pay shall cover all calls within the minimum four (4) hour period provided for under (a). If a second call takes place after four (4) hours have elapsed from the time of the first call, it shall be subject to a second call back premium but in no case shall an employee collect two call back premiums within one such four hour period, and to the extent that a call back overlaps and extends into the hours of his or her regular shift, (a) shall apply. Notwithstanding the foregoing an employee who has worked his full shift on a holiday and is called back shall receive the greater of two and one-half (2 1/21 times his regular straight time hourly rate for all additional contiguous overtime hours worked. (b) Overtime shifts will be offered actually worked on a rotating seniority basis (over a two (2) week such call-back or four hours pay period), first to full-at time and then one-half (1 his straight time hourly rate subject to part-time within the home departmentother provisions set out above. Where Employees who report for any scheduled shift will be guar- anteed at least four hours of work, or if no work is avail- able will be paid at least four hours except when work is not available due to conditions beyond the control of the Hospital. The reporting allowance outlined as herein shall not apply whenever an employee has received not less than one hour's prior notice not to report for work. Employees absent on approved leave, paid by the Employer or by the Workers' Compensation Board shall for the purposes of computing overtime pay during the work schedule in which the absence occurred, be considered as having worked their regularly scheduled hours during such leave of absence, No pyramiding shall result from the application of this provision. The foregoing shall also apply in cases of short term leaves of absence for Union business approved by the Employer under the applicable provisions of the Collective Agreement where payment is required made to work additional overtime contiguous to an overtime shift within a twenty-four (24) hour period, the employee will be compensated at by the rate of double time his or her straight time hourly rate for all additional contiguous overtime hours workedUnion. Notice of overtime work shall be given as soon as practically possible. It is understood and acknowledged that the Hospital has the right to require employees to perform reasonably authorized overtime work. Calla call-back shall not be considered as hours worked for purposes of this Articleless than four (4) consecutive hours. Overtime premium will not be duplicated nor pyramided nor shall other premiums be duplicated nor pyramided nor shall the same hours worked be counted as part of the normal work week and also as hours for which the overtime premium is paid. Where an employee is required to work additional overtime contiguous to an overtime shift within a twenty-four (24) hour period, the employee will be compensated at the rate of double time his or her straight time hourly rate for all additional contiguous overtime hours worked. (b) . Time Off in Lieu of Overtime shifts Employees who work overtime will not be required to take time off in regular hours to make up for overtime worked. Time off in lieu may be taken on a mutually agreed upon basis between the employee and the Hospital. Such time off will be offered on a rotating seniority basis the equivalent of the premium rate the employee has earned for working overtime, The Hospital shall revert to payment of premium rate if time off is not taken within ninety (over a two 90) calendar days of the workweek in which the overtime was earned or, with the employee’s agreement, within twelve (212) week pay period), first to full-time and then to part-time within the home department. The refusal months of an overtime shift within the home department shall constitute time workedthat workweek.

A request by an employee for time off in lieu of overtime shall not be unreasonably denied, it being understood that vacation requests shall supersede a request for time off in lieu of overtime. The Hospital shall revert to payment of accumulated overtime when the employee requests to be paid, or where time off in lieu for accumulated overtime owing is not taken in the course of the fiscal year in which it was earned. When an employee performs authorized overtime work of at least three (3) hours duration, the Hospital will allocate a rest period of fifteen (15) minutes duration. An employee required to work additional overtime contiguous to an overtime shift within a twenty-four (24) hour period, the employee will be compensated at the rate of double time his or her straight time hourly rate for all additional contiguous overtime hours worked. (b) Overtime shifts will be offered on a rotating seniority basis (over a more than two (2) week pay period)hours overtime: Shall be supplied a meal by the Hospital. A further meal will be supplied for each four (4) hours continuous of overtime thereafter. When the ambulance employees are in transit during a meal period they will be provided with up to a maximum of seven dollars ($7.00) per meal provided that the employee submits a receipt for the meal. Overtime will be offered in order of seniority on an equitable basis to employees within the classification that normally perform the work, in the in which the work is to be performed. In the Ambulance Department overtime will be offered in order of seniority on an equitable basis first to full-time and then employees, failing this, to regular part-time employees, and failing this to relief part- time employees. Employees who have worked or will work within eight (8) hours of the home department. The refusal commencement or end of an the overtime shift within or are not available due to an approved absence from work will not be offered such overtime opportunity, however this will not count as an offered overtime opportunity for the home department purpose of equitable distribution. An available work opportunity offered and declined will be counted for the purpose of determining equitable distribution. An employee may accumulate up to five (5) shifts which may be a combination of regular and extended shifts in straight time hours. Such banked hours must be taken no later than March of each year. If such time cannot be taken for any reason, it shall constitute time workedbe paid.

The Hospital shall revert to payment of an overtime shift within premium rate when the home department shall constitute employee requests to be paid, or where time workedoff in lieu is not taken in the course of the fiscal year in which it was earned.

Overtime Premium. Where an employee is required to work on a paid holiday and is required to work additional hours following his/her full shift on that day, he/she shall receive two (2) weekstimes their regular straight time hourly rate for such additional hours worked. It is understood that no overtime Full-time employees (1.0 FTE only) who are required to work on their scheduled day off will be paid at time and one half (1.5) their regular rate of pay for the shift. Should additional, contiguous overtime be required following the scheduled shift, employees shall be paid at double (2.0) time. When an employee is required to and does work for three (3) or more hours of overtime after his/her normal shift, he/she shall be provided with a hot meal or a nine-dollar ($9.00) meal allowance if the Employer is unable to provide the meal or has been unable to schedule a meal break during the overtime period. Notwithstanding the foregoing, where the time worked was overtime assignment is for a result period of an exchange at shifts between employeesthree (3) hours, no more or less, the employee is not required to take a hot meal, if available, and may claim the nine-dollar ($9.00) meal allowance. Overtime shall Subject to the requirements of patient/client care and/or departmental requirement, the thirty (30) minutes unpaid meal break will be distributed as equally as practical among those employees normally performing provided during the type of work to be done on first four (4) hours overtime. Where Reporting Pay Employees who report for work on any regular scheduled shift will be guaranteed at least three and one-half hours of work or if no work available will be paid for at least three and one-half hours. employee must accept available work as assigned within his job classification. This does not apply to part time employees who make individual arrangements for less than three hours of work per shift, nor shall it apply in case of any labour dispute or conditions beyond the control of the Hospital. Standby An employee who is required to remain available for duty on standby, outside the normal working hours for that particular employee, shall receive standby pay in the amount of two dollars and ten cents per hour for all hours on standby. Standby pay shall, however, cease where an employee is required called in to work, and works during the period of standby. Call-back Where employees are called back to work additional overtime contiguous after having completed a regular shift and prior to an overtime shift within the commencement of their next regular shift, they shall receive a twenty-four (24) hour period, the employee will be compensated minimum of three hours of work or three hours' pay at the rate of double time and one-half their regular hourly earnings. Where call-back is immediately prior to the commencement of their regular shift, the call-back will only apply to the point of commencement of a regular shift at the rate of time and one-half after which they shall revert back to the regular shift. Call-back pay shall cover all calls within the minimum three hour period provided for under (a) above. If a second call takes place after three hours have elapsed from the time of the first call, it shall be subject to a second call-back premium, but in no case shall an employee collect two call-back premiums within one such three hour period, and to the extent that a call-back overlaps and extends into the hours of his or her straight time hourly rate regular shift, (a) shall apply. Shift Premium Employees shall be paid retroactive to October a shift premium of forty-five cents per hour for all additional contiguous overtime hours worked. ARTICLE PREMIUM PAYMENT: Responsibility Outside the Bargaining Unit When an Employer temporarily assigns an employee to carry out the assigned responsibilities of a higher paying classification outside of the Bargaining Unit for a period in excess of one-half of one shift, the employee shall receive an allowance of three dollars for each shift from the time of the assignment. Overtime shifts will be offered on a rotating seniority basis (over a two (2) week pay period), first Lieu Time not applicable Paid Time to full-time and then to part-time within the home department. The refusal of an overtime shift within the home department shall constitute time worked.Working Time not applicable ARTICLE ALLOWANCES:

Overtime Premium. If an employee is authorized to work in excess of the hours worked either in clause (a) Employees or of clause of this contract he shall be entitled to payment receive for the first four hours a premium of time one and one-half (1-1/2X) 1 times his straight time hourly rate and double the employee's basic straight time hourly rate for all authorized overtime work in excess of seven and one-half (7-1/2) hours in a tour of duty or in excess of the average full-time hours of work over the period scheduled by the Hospital. Such period for this purpose shall not exceed two (2) weeks. It is understood that no overtime will be paid where the time worked was a result of an exchange at shifts between employees. Overtime shall be distributed as equally as practical among those employees normally performing the type of work to be done on overtime. Notice of overtime work shall be given as soon as practically possible. It is understood and acknowledged that the Hospital has the right to require employees to perform reasonably authorized overtime work. Call-back shall not be considered as continuous hours worked for purposes of this Articleafter the first four hours. Overtime premium will not be duplicated for the same tour as referred to in Article (a) or nor pyramided nor with any other premium payable under this agreement. Time off in lieu of overtime may be taken on a mutually agreed upon basis between the employee and the Hospital. The request will not be unreasonably withheld. The Hospital shall other premiums be duplicated nor pyramided nor shall revert to payment of premium rate if time off is not taken within sixty (60) calendar days except on units where closures occur. Nothing herein will disentitle the same hours worked be counted as part employee to payment of the normal work week and also as hours tour differential for a full overtime tour worked not withstanding the provisions hereof. At the change of tour there normally be time required for reporting. Should the reporting time extend beyond twenty minutes, the entire period shall be considered overtime but must be approved by the supervisor. The Hospital shall revert to payment of premium rate if time off is not taken within sixty (60) calendar days, except in those departments or units which are subject to summer and/or Christmas closures. When no buses are available after hours, the overtime premium is paid. Where an employee is required Hospital will pay taxi fare from the Hospital to the employee’s residence for those employees who have been asked to work additional overtime contiguous to an past their regular shift. Meal Ticket An employee shall be provided with a free meal ticket when working for two hours or more of overtime shift within on the same day the employee has worked a twenty-full tour. All time off taken as lieu time for overtime hours worked shall be at the premium rate (i.e., four hours of overtime shall equal six (246) hour periodhours of lieu time off). When the Hospital determines that absent employees will be replaced, the employee Hospital will be compensated at endeavour to replace such employees with persons from the rate of double time his or her straight time hourly rate for all additional contiguous overtime hours workedsame classification. The refusal weekend premium shall increase to fifty-five cents ($0.55) effective November sixty cents ($0.60) effective October and sixty- five cents ($0.65) effective October This amount shall increase to seventy ($0.70) cents effective April eighty ($0.80) cents effective April and eighty-five ($0.85) cents effective October Responsibility Outside the Unit When an Employer temporarily assigns an employee to carry out the assigned responsibilities of a higher paying classification outside of the bargaining unit for a period in excess of one-half of one shift, the employee shall receive an overtime allow- ance of three dollars ($3.00) for each shift within from the home department shall constitute time workedof the assignment.

The refusal of reporting allowance outlined as herein shall not apply whenever an overtime shift within the home department shall constitute time workedemployee has received not less than one hour's prior notice not to report for work.

Where Reporting Pay Employees who report for work at the starting time of their scheduled shift, save and except employees who are scheduled for four hours or less, not having previously been advised not to report, shall be guaranteed at least four hours of work or, if no work is available, shall be paid for at least four hours time, at the employee's applicable straight time hourly rate of Employees who are scheduled for four hours or less will be guaranteed one-half of their scheduled hours. This provision shall not apply in the following circumstances: When an employee fails to keep the Hospital advised of a telephone number that can be used for the purpose of leaving a message; when work is not available due to circumstances that are beyond the reasonable control of the Hospital. An employee who is required to remain available for duty on standby, outside the normal working hours for that particular employee, shall receive standby pay in the amount of per hour for all hours on standby. Standby pay shall, however, cease where an employee is required called in to work, and works during the period of standby. Call Back Where employees are called back to work additional overtime contiguous after having completed a regular shift and prior to an overtime the commencement of their next regular shift within they shall receive a twenty-minimum of four (24) hour period, the employee will be compensated hours of work or four hours pay at the rate of double time and one-half their regular hourly earnings. Where call-back is immediately prior to the commencement of their regular shift the call- back pay will only apply to the point of commencement of a regular shift at the rate of time and one-half after which they shall revert back to the regular shift. Call-back pay shall cover all calls within the minimum four hour period provided for under (a). If a second call takes place after four hours have elapsed from the time of the first call, it shall be subject to a second call-back premium, but in no case shall an employee collect two call-back premiums within one such four hour period, and to the extent that a call-back overlaps and extends into the hours of his or her straight time hourly rate regular shift, (a) shall apply.
