Common use of PERSONAL/XXXXX’S LEAVE Clause in Contracts

PERSONAL/XXXXX’S LEAVE. 8.4.1 Full-time Employees are entitled to 10 days of paid personal/xxxxx’s leave based on the Employee’s ordinary hours of duty and the Employee’s ordinary rate of pay for each completed year of continuous employment with the Company. Part-time Employees are entitled to the pro-rata equivalent. 8.4.2 Paid personal / xxxxx's leave accrues progressively during each year of service according to the Employee's ordinary hours of work, and accumulates from year to year. 8.4.3 All accrued personal/carer’s leave shall be available for use as sick leave and carer's leave in accordance with the provisions outlined below. 8.4.4 An Employee (other than a casual Employee) may take paid personal/carer’s leave if the leave is taken: (a) As sick leave - because the Employee is unfit for work as a result of a personal illness, or personal injury, affecting the Employee; or (b) As carer’s leave - to provide care or support to a member of the Employee’s immediate family, or a member of the Employee’s household, who requires care or support because of: (i) a personal illness, or personal injury affecting the immediate family or household member, or (ii) an unexpected emergency affecting the immediate family or household member. 8.4.5 An Employee (including a casual Employee) may take 2 days unpaid carer’s leave per occasion if: (a) the leave is taken to provide care or support as provided for in sub-clause 9.4.5(b) of this Agreement; and (b) the Employee does not have any paid personal/carer’s leave available.

In such case the employee’s next year of service will commence after a total of 12 months has been served with that employer excluding the period of interruption in service from the date of commencement of the previous period of employment or the anniversary of the commencement of the previous period of employment.
