Common use of PERSONAL/XXXXX’S LEAVE Clause in Contracts

PERSONAL/XXXXX’S LEAVE. The term personal/carer’s leave effectively covers both sick leave and xxxxx’s leave. A full-time employee is entitled to claim up to 10 days paid personal/carer’s leave, for each year of continuous service, for absences due to: • personal illness or injury of the employee • to provide care and support to a member of the employee’s immediate family • to provide care and support to a member of the employee’s immediate family • to provide care and support to a member of the employee’s household, because of the illness or injury of that member or an unexpected emergency affecting that member 23 Part-time employees are entitled to leave under this clause on a pro rata basis based on the number of ordinary hours worked. Casual employees are not entitled to personal/carer’s leave. Personal/xxxxx’s leave accrues on an hourly basis and is paid at the employee’s ordinary rate of pay. Personal/xxxxx’s leave is cumulative but unused leave is not paid out on termination of the employment contract. Personal/xxxxx’s leave is not allowed to be cashed out under the terms of this agreement. Where an employee has insufficient accrued personal/carer’s leave, the employee is entitled to take up to 2 days unpaid carer’s leave on each occasion carer’s leave is required.
