Premium Rate Services. A second cause for concern in commercialism, and related to spam, is pre- mium-rate services. A service is called premium rate if the receiver of the service has to pay an additional amount of money for receiving the service. From our study, we note the increasing abuse of these services specifically with regards to children and young people. Below, we describe briefly how premium-rate services will continue to be an area of increasing concern if left unchecked. (1) Premium-rate services have become payment methods for information and for consumption of services.148 Already their use has grown to encompass applications, such as (1a) SMS voting for popularity shows and TV reality shows, and (1b) obtain- ing visa information from foreign embassies.149 Often the payment amount is neither sufficiently transparent nor made clear to mobile users. (2) Premium- rate services can involve indiscriminate marketing by marketers and is also known to include mobile phone fraud. We state two ways in which this can happen. (2a) Often, a mobile spam consists of a SMS request to call a number. Unbeknown to the caller, the number is a premium-rate number. This means that the caller will be charged at a higher rate. (2b) A second tactic to lure and direct the caller to the premium rate number is to ring the caller and to end the call before the caller has a chance to answer the call. This will lead the caller to call the number shown on his mobile screen and thus be charged a higher rate for the call. Premium Rate Services. The Supplier shall ensure that all Supplier Personnel appointed to the helpdesk have the relevant skills, experience and knowledge of the services offered under the Framework Agreement and have the capability to manage Contracting Authority relations.
Premium Rate Services. Without prejudice to the other obligations of the Supplier set out elsewhere in this Agreement (including those set out in Clauses, 3.2.1, 3.3.9 and 5), to the extent that Premium Rate Services form part of Services being provided:- 3.1.1 it is acknowledged and agreed by the parties that the Supplier is acting as the “service provider” for the purposes of the Phone-Paid Services Authority regulations and the Supplier:- 1. shall on request, supply the Customer with a copy of its Phone-Paid Services Authority registration and any applicable permissions including its relevant Phone-Paid Services Authority prior permission certificate (including any renewals); 2. represents and warrants that it has a current registration with Phone-Paid Services Authority and that there are no complaints made or investigations launched or notice received by the Supplier from Phone-Paid Services Authority with respect to the Supplier’s registration with Phone-Paid Services Authority; 3. shall keep the Customer informed of any complaints made or investigations launched or notice received by the Supplier from Phone-Paid Services Authority, OFCOM or any other appropriate regulatory authority during the Term; 4. in the event that the parties agree to change the Services and/or the Promotion and this change is likely to result in the Services and/or the Promotion being altered from what is described in the relevant Phone-Paid Services Authority permission certificate, The Supplier shall immediately notify the Customer as soon as it becomes aware of the alteration and seek permission from Phone-Paid Services Authority to provide the altered service and/or promotion, and shall keep the Customer informed of all material developments (including any conditions imposed by Phone-Paid Services Authority). For the avoidance of doubt no change to the Services will take place and the Supplier shall continue providing the Services as previously agreed until a valid certificate for the changed service is obtained by the Supplier from Phone-Paid Services Authority; and 5. shall procure that any of its Sub-contractors acting as a “service provider” for the purposes of the Phone-Paid Services Authority regulations shall comply with this Clause 3.1.2 the Supplier represents, warrants and undertakes that:- 1. at the date of this Agreement it is and shall remain for the duration of the Term fully compliant (and the provision of the Services shall be in accordance) with the Phone-Paid Services Authorit...
Premium Rate Services. 11.1) The customer shall be responsible for the quality and delivery of the content of the services and that these services shall comply with the PSA code of practice and this agreement. 11.2) The customer is responsible for obtaining all necessary approvals, permissions or authorisations for use of the numbers. The Customer shall neither acquire any right, title or interest in the numbers. 11.3) The customer shall provide Tamar Telecommunications with such information or material relating to the services as may be requested including without limitation copies of recorded messages and any other information supplied to callers or potential callers. 11.4) The customer shall ensure that the services neither infringe any intellectual property rights nor are defamatory. 11.5) The customer shall liaise with Tamar Telecommunications in relation to any complaints, enquiries or investigations by callers, the media, PSA or Ofcom relating to the service. 11.6) The customer shall neither state or imply any approval of the services by Tamar Telecommunications, and shall use no words, names or expressions which in any way connect Tamar Telecommunications to the services. 11.7) The customer shall ensure that any third party utilising its facilities shall be bound by clauses 11.1 to 11.8 11.8) The customer shall reimburse Tamar Telecommunications in full any fines or charges incurred from PSA or any other third party in connection with failure to comply with the relevant rules and regulations issued by the relevant third party.
Premium Rate Services. Prior to the supply of premium rate services in accordance with an ongoing agreement, the customer should indicate their acceptance to the supplier of the service. Such acceptance may be provided by the customer replying to an SMS. The customer may block access to premium rate services by contacting Telenor's customer services on 05000 or 09000. The customer may set a spend limit for the use of such services. Complaints relating to billing of premium rate services may be directed to Telenor or directly to the service supplier. Telenor is responsible for handling customer appeals and complaints.

This Agreement does not apply to services provided under separate agreements with third party vendors that do not specifically reference this Agreement or that are not specifically referenced in this Agreement. Please note that during your use of Online Banking Services, we may provide you with additional requirements and limitations regarding the use of Online Banking Services through the system by which we may provide Online Banking Services.
