Private Development Sample Clauses

Private Development. It is specifically understood and agreed by and between the Parties hereto that the Development of the Project is a private development, that neither party is acting as the agent of the other in any respect, and that each party is an independent contracting entity with respect to the terms, covenants and conditions contained in this Development Agreement. No partnership, joint venture or other association of any kind is formed by this Development Agreement. The only relationship between the City and Developer is that of a government entity regulating the development of private property and the owner of such property.

Private Development. The Private Development consists of the following three Project Elements, each a Private Development Project Element: (1) an apartment component comprising of approximately 144 units within approximately 128,000 gross square feet of floor area and a retail component comprising approximately 33,400 gross square feet plus ancillary parking in a building to be constructed by the Developer on Block 88 (the “Block 88 Apartment”) with the final unit count subject to completion of design development documents and completion of a market and feasibility analysis to be prepared by the Developer and land use approvals as described in Article IV; (2) an apartment component comprising of approximately 210 units within approximately 192,000 gross square feet of floor area and a retail component comprising approximately 7,800 gross square feet plus ancillary parking in a building to be constructed by the Developer on Block 105 (the “Block 105 Apartment”) with the final unit count subject to completion of design development documents and completion of a market and feasibility analysis to be prepared by the Developer and land use approvals as described in Article IV; and (3) an urban mixed use hotel component having no fewer than 250 guest rooms within approximately 164,000 gross square feet of floor area plus ancillary parking in a building to be constructed by the Developer on Block 105 (the “Block 105 Hotel”) with the final room count subject to completion of design development documents and completion of a market and feasibility analysis to be prepared by the Developer and land use approvals as described in Article IV.
Private Development. The Private Development consists of the following three Project Elements: (1) an office and retail component comprising approximately 315,500 gross square feet of floor area in a building to be constructed by the Developer on Block 88 (the “Block 88 Office Building”); (2) a hotel component having a goal of 250 guest rooms within approximately 141,000 gross square feet of floor area in a building to be constructed by the Developer on Block 105 (the “Hotel”), with the final room count subject to completion of design development documents, completion of a market and feasibility analysis to be prepared by the Developer and reviewed by the City and final determination of the parking program; and (3) an office and retail component (and/or other commercial or residential use as may be approved) within approximately 110,000 gross square feet of floor area in a building to be constructed by the Developer on Block 105 (the “Block 105 Future Expansion”).
Private Development. Prior to the conveyance or transfer of any private lot or building site to be served by a structural BMP pursuant to this Section, and prior to issuance of any permit for development or redevelopment requiring a structural BMP pursuant to this Section, the applicant or owner of the site must execute an operation and maintenance agreement that shall be binding on all subsequent owners of the site, portions of the site, and lots or parcels served by the structural BMP. Until the transference of all property, sites, or lots served by the structural BMP, the original owner or applicant shall have prim or carrying out the provisions of the maintenance agreement.
Private Development. The Developer, or a Sub-Developer acting in accordance with a Parcel Development Agreement, shall pay all costs associated with construction of the Private Development.
Private Development. The Private Development shall consist of a two-unit condominium building with the following components to be constructed on the Property as defined below: (1) A grocery store of no less than twenty-four thousand (24,000) square feet, which may include such ancillary or complementary space for storage and office, related to the grocery use, and/or community room (the “Grocery” or the “Grocery Unit”); (2) A housing component (the “Residential Unit”) comprising one hundred and fifty (150) apartments with ninety-four (94) income restricted units as follows: thirty (30) units restricted to residency by persons earning at or below thirty percent (30%) of the Dane County median income (“AMI”) (the “30% Units”); sixty- four (64) units restricted to residency by persons earning at or below fifty percent (50%) of the AMI (the “50% Units”). In addition, sixty (60) units restricted to residency by persons earning at or below eighty percent (80%) of the AMI (the “80% Units”). The final unit mix shall be determined based on an application to the City for Affordable Housing Funds and subsequent underwriting and approval by the City. Such City Funding shall apply to the 30% Units and the 50% Units (collectively the “AHF Units”).
Private Development. The Private Development shall consist of the following two Project Elements (but which may include other Project Elements), each a "Private Development Project Element (1) an office component comprising of approximately 156,000 gross square feet of floor area to be owned by American Family and currently intended to be used in part by American Family and in part by Starting Block Madison, Inc, a Wisconsin non-stock corporation (“Starting Block”) in a building to be constructed by American Family on a portion of the Project Parcel to be purchased by American Family from Xxxxxxxx (the “American Family Parcel”); and (2) a commercial component comprising of commercial space which will include approximately 60,000 square feet of office space and may include additional office, retail and other commercial uses in a building to be constructed by Xxxxxxxx on the balance of the Project Parcel not included within the American Family Parcel (the "Xxxxxxxx Parcel"); and
