Product Listings. Some Products are made available at no charge, and others require payment of fees. The Listing for each Product will identify the provider of the Product, which may be UiPath or a Partner.
Product Listings. 3.1. You shall be responsible for listing your products on the Marketplace by uploading to the Seller Center a completed product page which shall include prices, detailed information, specifications, and images in respect of each product.
3.2. You may not publish more than one listing in respect of each product.
3.3. You agree to be solely responsible for all listings submitted to our Marketplace and you agree that all listings must:
3.3.1. constitute bona fide listings relating to products that comply with the categories and rules set out in section 4;
3.3.2. comply with the rules on content in the general terms and conditions and further particularized in the Content and Image Guidelines; and
3.3.3. include all such information, specifications, and guidelines as may be required pursuant to all applicable laws and regulations, including in respect of consumer protection.
3.4. Listings that are submitted may be individually reviewed and approved, at Splitmulti’s discretion, before they are published on the Marketplace, and you acknowledge and agree there may be a lead time between submission of the product page to the Seller Center and the publishing of the Product page on the Marketplace due to time required for Splitmulti quality control operations.
3.5. Without prejudice to our other rights, we reserve the right to reject, unpublish and/or delete any listings that breach these seller terms and conditions, the general terms and conditions, or any Splitmulti codes, policies, or guidelines.
3.6. You acknowledge and agree that:
3.6.1. notwithstanding that we may approve any listings, you shall be fully responsible for the same; and
3.6.2. we reserve the right to impose penalties for breach of this Section 3, without prejudice to our other rights.
3.7. You must keep your listings up to date. In particular, you must deactivate any listings in respect of products that have ceased to be available.
3.8. You must provide the Split duration for each product listing including bundle products and you may renew the duration upon expiry at your discretion.
Product Listings. You must submit each Partner Product (including any updates) and the relevant Partner Assets to UiPath for certification, before publishing for distribution through the Marketplace. Each Partner Product (including any updates) is subject to certification by UiPath before Your Listing is made available in the Marketplace. UiPath has no obligation to make available any of the Partner Products that You submit, or to maintain the availability of the Partner Product, even if that Partner Product qualifies for certification or is certified. You may not add any new functionality to the Partner Product which requires written consent from the Customer without first providing notice and obtaining the required consents.
Product Listings. 4.1. The Service Provider shall enable the Seller to list, advertise and sell the Seller’s Products on the Websites and may make recommendations for these activities in order to ensure their lawfulness and transparency.
4.2. By listing the Products on the Websites, the Seller represents and warrants that (i) the Seller holds title to the Products and/or the Seller has the right to sell them; and (ii) the Products have not been pledged, transferred and/or encumbered otherwise.
4.3. In order to upload the Product for sale (create an offer for the Product), the Seller shall select an existing Product description in the System that matches the Product sold by the Seller, as defined in Clauses 4.4.-4.6. below.
4.4. By choosing the existing description of the Product, the Seller declares and warrants that the description is in compliance with applicable law and the Products sold by the Seller comply with the description of the Product including but not limited to colour, any features, functionality and technical parameters. The Seller represents and warrants that, by submitting the Offer and using the relevant description therein, the Seller is fully responsible for correspondence of the description and/or compliance with the law, and shall hold the Service Provider harmless against any claims that may arise from such non-compliance.
4.5. If the Seller finds a description in the System that corresponds to the Product but, in the Seller’s opinion, the description does not meet legal requirements and/or does not correspond to the Product’s characteristics, or should the Seller determine that the description is unsuitable for other reasons, the Seller shall not use such description in the Offer and shall notify the Service Provider immediately through the System. Such notice shall include at least the following information: 4.5.1. The part of the description that must be revised for reasons indicated above;
Product Listings. Except as provided in the Publishing Guidelines You must submit each Partner Product (including any updates) and the relevant Partner Assets to UiPath for security review and certification (which may include, without limitation: information requests to you, reviews of Your Documentation, security testing or technical testing and reviews) , before publishing for distribution through the Marketplace. Where required for the performance of security testing, UiPath reserves the right to request that You provide the source code to Your Partner Product, but solely for the purpose of UiPath conducting security tests. UiPath has no obligation to make available any of the Partner Products that You submit, or to maintain the availability of the Partner Product, even if that Partner Product qualifies for certification or is certified. You may not add any new functionality to the Partner Product which requires written consent from the Customer without first providing notice and obtaining the required consents.
Product Listings a. Seller shall create Product Listings or offers for sale posted to Product Listings using the Mirakl Portal for all Products it intends to sell on a Marketplace.
b. If it creates Product Listings, Seller shall create Product Listings that comply with Applicable Law, the Policies, and any specifications posted in the Mirakl Portal, and that are accurate and appropriate for the Marketplace to which they are posted.
c. Seller shall ensure that URBN’s use of Seller’s Product Listings will not (1) violate any intellectual property rights of non-parties; (b) contain defamatory or discriminatory content; (c) constitute an invasion of a party’s rights of privacy or publicity; and/or (d) reflect unfavorably on URBN, the Websites and/or other Sellers on the Websites;
d. Seller shall not create Product Listings that:
(1) offer products that are inauthentic, counterfeit, replicas or knock-off goods;
(2) offer any Restricted Products;
(3) offer Products Seller does not currently have in stock;
(4) promote or engage in any deceptive trade practice (including spoofing, slamming, cramming, phishing, or attempting to scam or defraud a URBN Customer into surrendering private and/or personal information);
(5) contain nudity or pornographic, obscene, or offensive content; or
(6) use any URBN trademarks or imply that URBN endorses or approves the Product Listing.
e. URBN may modify, reject, remove, or censor any Product Listing for any reason, and may combine two or more Product Listings or elements of two or more Product Listings. If Seller believes a modified Product Listing would violate section 3.3.b, 3.3.c, or 3.3.d, Seller shall promptly notify URBN in the manner set forth in the Policies. If Seller posts offers for sale against a Product Listing, it will be deemed to have accepted any modifications made to that Product Listing.
Product Listings. 3.1. A seller shall be responsible for listing his/her products on the marketplace by uploading to the Seller Center, a completed product page which shall include prices, detailed information, specifications and images in respect of each product.
3.2. Seller shall create his/ her products on the Sellers’ center by uploading pictures and contents that meets Global Wave Mart’s expectations. Global Wave Mart’s staff will then review and check the quality of each product to ensure they are compliant with Global Wave Mart's product's expectations. A product shall not be listed on the marketplace unless it has met all requirements. All detailed content and guidelines are available per category.
Product Listings. 3.3.1. Seller shall create Product Listings or offers for sale posted to Product Listings using the MCL eNetwork for all Products it intends to sell on an eMarketplace/eShop.
3.3.2. If it creates Product Listings, Seller shall create Product Listings that comply with Applicable Law, the Policies, and any specifications posted in the MCL eNetwork, and that are accurate and appropriate for the eMarketplace/eShop to which they are posted.
3.3.3. Seller shall ensure that MCL’s use of Seller’s Product Listings will not 3.
3.3.1. violate any intellectual property rights of non-parties; 3.
3.3.2. contain defamatory or discriminatory content;
Product Listings. 4.1 Sellers (users) should maintain routine oversight of their product listings and reviews on Amazon and Walmart to ensure compliance with each platform's policies, avoiding prohibited products and violations.
4.2 In cases of uncertainty regarding a product's suitability for Amazon or Walmart, sellers (users) are encouraged to reach out to the respective platform's seller support for clarification.
4.3 Sellers (users) bear the responsibility of verifying the Internet Minimum Advertised Price (IMAP) policy and limits for each product before listing on both platforms. Non-compliance with IMAP policies and limits may expose the seller (user) to legal action and related consequences, for which they are solely accountable.
Product Listings. After you agree to be bound by this Agreement and complete the eStore Product Submission Form, Take5 will list and publish approved products on the Take5 eStore web site.
