Prohibited Uses of the Services. You agree that you are solely responsible for complying with all applicable laws, statutes, ordinances, and regulations in all of your activities, including your use of the External Transfers, Zelle and Other Payment Services and Xxxx Pay services, regardless of the purpose of the use, and for all communications you send through the Services. We and our Vendors have the right but not the obligation, to monitor and remove communications with content that we find in our sole discretion to be objectionable in any way. Prohibited Uses of the Services. You agree that You will use the Services ONLY as permitted pursuant to this Agreement, and you expressly agree that You DO NOT have the right to: • Transmit, distribute, or store any material in violation of any applicable law or regulation. Our accounts or services may not be used to solicit customers from, or collect replies to, messages sent from another Internet Service Provider where those messages violate this Policy or that of the other provider. • Run unconfirmed mailing lists. Subscribing email addresses to any mailing list without the express and verifiable permission of the email address owner is prohibited. All mailing lists run by Our customers must be Closed-loop ("Confirmed Opt-in"). The subscription confirmation message received from each address owner must be kept on file for the duration of the existence of the mailing list. Purchasing lists of email addresses from 3rd parties for mailing to or from any of Our hosted domains, or referencing any accounts with Us, is prohibited. • Advertise, transmit, or otherwise make available any software, program, product, or service that is designed to violate this Agreement or the acceptable use policy of any other Internet Service Provider. Use of the Services for transmission, distribution, retrieval, or storage of any information, data, or other material in violation of any applicable law or regulation (including, where applicable any tariff or treaty) is prohibited. This includes, without limitation, the use or transmission of any data or material protected by copyright, trademark, trade secret, patent, or other intellectual property right without proper authorization and the transmission of any material that constitutes an illegal threat, violates export control laws, or is obscene, defamatory, or otherwise unlawful. Network and System Security Violations of system or network security are prohibited, and may result in criminal and civil liability. Examples of system or network security violations include, without limitation, the following: • Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network. • Unauthorized probing and/or scanning of any system without prior consent of the owner or system administrator. This includes, but is not limited to, “dictionary attacks” and/or attempts to harvest or verify email addresses. • Unauthorized monitoring of data or traffic on any network or system without express authorization of the owner of the system or network. • Interference with service to any user, host or network including, without limitation, mail-bombing, flooding, deliberate attempts to overload a system and broadcast attacks. • Forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting. • Attempting to gain unauthorized access to, or attempting to interfere with or compromise the normal functioning, operation, or security of any network, system, computing facility, equipment, data, or information. • Engaging in any activities that may interfere with the ability of others to access or use the Service or the Internet. • Sending Unsolicited Bulk Email (“UBE” or “spam”).
