Project Enhancements Clause Samples

The Project Enhancements clause defines the process and conditions under which additional work or modifications can be added to the original scope of a project. Typically, this clause outlines how either party may propose enhancements, the approval process required, and how costs and timelines will be adjusted to accommodate the changes. By establishing a clear framework for managing changes beyond the initial agreement, this clause helps prevent disputes and ensures that both parties have a mutual understanding of how enhancements are handled.
Project Enhancements. Policies designed to enhance project performance, in terms of employee skills, supervisory skills, health and safety (including measures to address substance use and abuse), worker satisfaction, worker retention, productivity, effective training and employment of apprentices, mentoring, attendance, and other value-adding initiatives, shall be developed by the parties and implemented on the Project.
Project Enhancements. Except as decided by the Parties by operation of Section 11(p) of this IGA, the City shall be solely responsible to fund Project Enhancements. The City shall retain sole and complete discretion to decide which Project Enhancements are funded, if any.
Project Enhancements a) The Owner reserves the right to design, implement, and remove project travel, attraction, performance, and retention incentives. Such incentive programs will include their own dispute-resolution mechanisms for administering such programs. Such programs shall not form a part of this Agreement. Entitlements to such incentives shall not be subject to a grievance or dispute herein, nor shall it be an allowable remedy of the Parties or Employer under Article 9. The programs to be developed and implemented may include: ▪ Health & Safety Incentives ▪ Travel Assistance PlanAttraction and Retention IncentivesPerformance Incentives b) Policies designed to enhance project performance in terms of Employee skills, supervisory skills, health and safety (including measures to address substance use and abuse), respectful workplaces, worker satisfaction, worker retention, productivity, training and employment of apprentices, mentoring, attendance, and other value-adding initiatives, may be developed by the Parties and implemented on the Project. c) The Employer and the Union agree to support and promote supervisory training for on-site supervision and to recognize the critical role of supervisors and site leaders, including shop stewards, concerning Employee safety, productivity, quality, and customer satisfaction.
Project Enhancements. (enhancements are limited to a berm, a privacy fence, and landscaping associated with the Project within the City of Centennial.– The installation of Project Enhancements will be contingent on available funding, will be voted on and prioritized by adjacent property owners, and the funding of enhancements will be subject to ratification by City Council) (together, the “Construction Work”); and
Project Enhancements a) Policies designed to enhance project performance, in terms of Employee skills, supervisory skills, health and safety (including measures to address substance use and abuse), worker satisfaction, worker retention, productivity, effective training and employment of apprentices, mentoring, attendance, and other value-adding initiatives, shall be developed by the Parties and implemented on the Project, subject to the Owner’s approval. b) The Parties agree to support and promote supervisory training for on-site supervision and to recognize the key role that the “supervisors” (whether lead hand, ▇▇▇▇▇▇▇, general ▇▇▇▇▇▇▇ or superintendent), including the shop stewards, have with respect to on job productivity, Employee safety, quality of workmanship and customer satisfaction.
Project Enhancements. (a) Metro agrees that before initiating any procurement for a Project Enhancement or before negotiating or entering into any agreement relating to a Project Enhancement, if the Project Enhancement is not provided for in the currently Approved Business Plan, Metro will: (i) give notice to Parking Company and (ii) engage in exclusive negotiations with Parking Company for the development of such Project Enhancement. If Metro and Parking Company agree on Project Enhancements, Metro and Parking Company will amend the Business Plan and Operating Standards to provide for the Project Enhancements. It may be a Compensation Event if Metro undertakes any Project Enhancement over the objections of Parking Company. (b) Parking Company will have the right, at its sole cost and expense (unless Metro agrees to contribute funds for a Project Enhancement) to design, develop, construct, operate and maintain any Project Enhancement Approved as part of the Business Plan.
Project Enhancements. The Project Enhancement scope includes End Stage Rigging, Escalators, SF increase for escalators (2,000 SF), Pavilion Increases, Ribbon Boards, Divider curtain, Center Stage Rigging, Core Networking Enhancements, Interior Finishes, and Enhanced loading docks.
