Recognition and Unit Designation. SECTION 1. Management recognizes the Union as the exclusive representative of all employees of the unit identified below.
SECTION 2. The unit of recognition is defined to include all professional and nonprofessional employees of the National Weather Service, NOAA, DOC, except as provided below.
SECTION 3. The following are excluded from the unit:
A. All Management officials;
B. All supervisors;
C. All confidential employees;
D. All employees engaged in personnel work in other than a purely clerical capacity;
E. All employees engaged in administering the provisions of the Federal Service Labor Management Relations Statute;
F. Any employee engaged in intelligence, investigative, or security work which directly affects national security; and
G. Any employee primarily engaged in investigation or audit functions relating to the work of individuals employed by the NWS whose duties directly affect the internal security of the NWS, but only if the functions are undertaken to ensure that the duties are discharged honestly and with integrity.

Recognition and Unit Designation a. By this Agreement, the Agency recognizes the Union as the exclusive representative of all employees in the bargaining unit as defined in this Article. In accordance with 5 U.S.C. Chapter 71, the Union represents all employees regardless of whether they are members of the Union.
b. The Parties shall not do anything by custom or practice that violates this Agreement.
Recognition and Unit Designation. 1. Management recognizes that the American Federation of Government Employees, AFGE Local #0446, is the exclusive representative of all employees in the bargaining units.
2. This Agreement is applicable to all professional and non-professional employees of the Xxxxxxx and LBJ Job Corps Centers, except management officials, supervisors, and employees described in 5 U.S.C. 7112 (b)(2)(3)(4)(6) and (7). 3. This section does not apply to Bargaining Unit Status changes as a result of a Management Right decision in accordance with 5 USC 7106. Management will notify the union when making a Bargaining Unit Status change that is not a Management Right decision with the rationale for the change. If the union disagrees with the statutory exclusion, the Union will notify Management in writing with the rationale within fifteen

Recognition and Unit Designation. Section 1. The Agency recognizes that the Union is the exclusive representative of all employees in the Unit described in Appendix A of this Agreement, and any subsequent certifications clarifying the Unit. Employees covered by the Agreement: Included: All RFT, RPT and INT regularly scheduled, INT on call, and INT casual employees, and temporary employees employed continuously for more than 180 day, including off-duty military personnel in any of the forgoing categories. 1. The Employer recognizes that the Union is the exclusive representative of all employees in the bargaining unit described below in Article 2.2, section 2.
2. The bargaining unit consists of all non-supervisory full-time and part-time academic employees of the College. This includes substitutes, career specialists/advisors, and employees funded through grants, or other categorical funds, or and instructors not included in the above definition.
3. Excluded from the bargaining unit are the president, administrators, administrative interns, and those instructors working for or under the direction of a Joint Apprenticeship Committee, whose parent unions have requested non-participation in writing from Local 4184 because of violation of their International or Local Union bylaws and all other District employees.
4. Exceptions to this section shall be bargained between the College and the Union.
5. Disputes regarding the representative status of any employee shall be resolved in accordance with RCW 28B.52.
