Recognition and Unit Designation. SECTION 1. Management recognizes the Union as the exclusive representative of all employees of the unit identified below. SECTION 2. The unit of recognition is defined to include all professional and nonprofessional employees of the National Weather Service, NOAA, DOC, except as provided below. SECTION 3. The following are excluded from the unit: A. All Management officials; B. All supervisors; C. All confidential employees; D. All employees engaged in personnel work in other than a purely clerical capacity; E. All employees engaged in administering the provisions of the Federal Service Labor Management Relations Statute; F. Any employee engaged in intelligence, investigative, or security work which directly affects national security; and G. Any employee primarily engaged in investigation or audit functions relating to the work of individuals employed by the NWS whose duties directly affect the internal security of the NWS, but only if the functions are undertaken to ensure that the duties are discharged honestly and with integrity.

Recognition and Unit Designation a. By this Agreement, the Agency recognizes the Union as the exclusive representative of all employees in the bargaining unit as defined in this Article. Management recognizes that the American Federation of Government Employees, AFGE Local #0446, is the exclusive representative of all employees in the bargaining units. 2. The Agency recognizes that the Union is the exclusive representative of all employees in the Unit described in Appendix A of this Agreement, and any subsequent certifications clarifying the Unit.
