Recuperation Period After Overtime. An Employee who has worked overtime must have at least eight (8) consecutive hours free from work, starting from and including the time that he or she last stops work, before such Employee returns to duty, unless the Employee and the Employer mutually agree to a lesser time period for recuperation, without any increased cost being incurred by the Employer. The Employer shall have the right to shorten the Employee’s next scheduled shift, subject to management’s sole discretion, to allow for the requisite recuperation period, without incurring any penalty, prejudice or additional cost.

Recuperation Period After Overtime. (a) Recuperation Period Defined An Employee who has worked overtime must have at least ten (10) consecutive hours free from work before such Employee returns to work, except as expressly provided otherwise by this Clause 16.09. For the purposes of this Agreement, this time period shall be defined as the "recuperation period." (b) Pay for Shift Following A Recuperation Period An Employee who is subject to a recuperation period pursuant to Clause 16.09(a) above shall have the right to refuse to return to work prior to the end of such recuperation period. If the recuperation period ends after the mid-point of the Employee's next shift, the Employee shall not report to work for such shift and the Employee shall be paid his or her full salary for such shift at straight-time (1X) rates. If the recuperation period ends before the mid-point of the Employee's next shift, the Employee shall report for work by the mid-point of such shift and shall be paid his or her full salary for such shift at straight-time (1X) rates, including pay for any time not worked.

  • Rest Period After Overtime (a) When overtime work is necessary, it will, wherever reasonably practicable, be so arranged that employees have at least 10 consecutive hours off duty between the work of successive days or shifts, including overtime. (b) An employee, other than a casual employee, who works so much overtime between the termination of their ordinary work on one day and the commencement of their ordinary work on the next day, that they have not had at least 10 consecutive hours off duty between those times, will be released after completion of such overtime, until they have had 10 consecutive hours off duty without loss of pay for ordinary working time occurring during such a absence. (c) If, on the instruction of the employer, an employee resumes or continues to work without having had 10 consecutive hours off duty, they will be paid at the rate of double time until released from duty for such period. The employee will then be entitled to be absent until they have had 10 consecutive hours off duty without loss of pay for rostered ordinary hours occurring during the absence.

  • Vacation Earnings for Partial Years (1) During the first partial year of service a new employee will earn vacation at the rate of three and two-thirds (32/3) days for each month for which the employee earns ten (10) days pay. (2) Subject to Clause 17.8, any unused vacation earned during the first (1st) partial year will be paid to the employee at December 31st of that year. (b) During the first (1st) and subsequent vacation years an employee will earn one-twelfth (1/12) of the annual entitlement for each month in which the employee has received at least ten (10) days' pay at straight-time rates. Where an employee has taken more vacation than earned, the unearned portion taken shall be charged against future earned credits or recovered upon termination whichever occurs first.

  • Rest Interval After Overtime An employee required to work overtime adjoining his/her regularly scheduled shift shall be entitled to eight (8) clear hours between the end of the overtime work and the start of his/her next regular shift. If eight (8) clear hours are not provided, overtime rates shall apply to hours worked on the next regular shift.

  • Vacation Period ‌ The choice of vacation periods shall be granted to employees on the basis of seniority with the Employer except where the period requested would be detrimental to the operation of the Employer.

  • Vacation Periods Vacation schedules will be set by the employee’s immediate supervisor(s) and sent to the Office of Human Resources for approval.   • Prime Time Vacation Period Subject to the provisions of this article, it is the intent of the parties that no employee will be restricted in the time of year they choose to take their vacation. The Employer will make every effort to allow employees to take their vacation during the period of April 15th to October 15th inclusive, which will be defined as the prime time vacation period.

  • Vacation Allowance Employees in permanent positions are entitled to vacation with pay. Accrual is based upon straight time hours of working time per calendar month of service and begins on the date of appointment to a permanent position. Increased accruals begin on the first of the month following the month in which the employee qualifies. Accrual for portions of a month shall be in minimum amounts of one (1) hour calculated on the same basis as for partial month compensation pursuant to Section 5.6 of this MOU. Vacation credits may be taken in one (1) minute increments but may not be taken during the first six (6) months of employment (not necessarily synonymous with probationary status) except where sick leave has been exhausted; and none shall be allowed in excess of actual accrual at the time vacation is taken.
