Redundancy Layoff and Recall. (Secondary Only) SENIORITY The seniority list shall be developed by the Board in conjunction with the through the Committee on Redundancy, with a copy retained by each party. The seniority list shall be revisedfrom time to time as required by the Committee on Redundancyand on December 1st and April 1st of each year and shall include all teachers who were members as of September 1st of each year and any memberswho were added before March 1st. For purposes of implementing the provisionsof this clause, a Committee on Redundancyshall be formed consisting of six members composed of three secondary school teachers appointed by the Executive and three Board representativesappointed by the Board. The Committee shall elect its own chair annually; its purpose is to make recommendationsto, and in consequence thereof, extend options to any teachers within the secondary school panel who may from time to time be declared redundant to the needs of the Board within the secondary school system in the manner hereinafter provided; and for the purposes aforesaid the Committee may engage in research related to future staff requirements and suggest specializedassignments for personnel; and shall also recommend the dates for the new contract for Article The Committee shall have the responsibility of designating any teacher to be declared surplus, displaced and redundant under this Article. The Committee on Redundancyshall keep a file of all its decisions. Seniority shall mean and be established as follows: The seniority of teacherswith the Board is determined by the total number of years served consecutively with this Board, or its predecessors, by a certified teacher or a teacher holding a recognized letter of standing. A teacher employed on a letter of permission who becomes certified and is in continuous employment with the Board shall receive retroactive seniority to the date of hire. The seniority list shall consist of the names of teachers identified in and in decreasing order of years of recognized continuous employment with the Board or its predecessors. "Recognized continuous employment" for the purpose of this article shall include time spent while on leave of absence granted by the Board; leave due to prolonged illness, long term disability, or educational leave. Redundancy Layoff and Recall. Seniority is defined as the length of service in the bargaining unit and shall include service with the Employer prior to the certification or recognition of the Union. Seniority shall be used in determining preference or priority for promotion, transfer, demotions, lay-off, permanent reduction of the workforce and recall, as set out in other provisions of this Agreement. Seniority shall operate on a bargaining unit-wide basis. Employees shall serve a probationary period of three (3) months worked before acquiring seniority rights which shall then date back to their respective date of starting to work with the Employer. Probationary employees may be discharged without cause and without entitling the employee to recourse to the Grievance Procedure. No employee shall be transferred to a position outside the bargaining unit without the employee's consent. An employee, if transferred to a position outside the bargaining unit, shall retain the seniority acquired at the date of leaving the bargaining unit and for a further trial period of twelve (12) months. If such an employee is later returned to the bargaining unit such employee would be considered a new employee for the purposes of layoff and job Such employees shall retain all other seniority rights with the employer. Seniority, once established for an employee, shall be forfeited and employment shall be deemed to be terminated under any of the following conditions:

  • Layoff and Recall (a) A layoff of employees shall be made on the basis of seniority, based on an integrated seniority list of all hours paid since date of last hire. It is understood and agreed that through the bumping procedure the first to be laid off are probationary employees followed by those who work casual part-time shifts. No agency or new hires will be used when there is an employee on layoff provided that the employees on layoff will meet the staffing requirements of the Home. An employee will not be laid off out of seniority order if her lack of qualification for a junior employee’s shift can be remedied by a three (3) day orientation to that shift. An employee will not be denied recall to a shift if her lack of qualification for the recall opportunity can be remedied by a three (3) day orientation to that shift.

  • Layoff Recall Section 1. Bargaining unit employees shall be laid off and recalled on the basis of available work within each job classification. Layoffs shall be in reverse order of seniority and recalls shall be in order of seniority; provided however, that in order to avoid layoff and in order to be subject to recall, the most senior employee within the affected classification must be qualified, in the judgment of the University, to perform all available work. Any gross abuse of the University's discretion to judge qualifications shall be subject to the grievance procedure. Any employee who would otherwise be laid off may bump (i.e., replace) the least senior employee in another bargaining unit job classification if they previously held such job with the University and remain qualified, in the judgment of the University, to perform all work available in the job into which they are bumping. An employee who elects not to bump shall not lose their right to recall to the employee’s regular job, but shall lose their bumping rights for the duration of the layoff. When it becomes necessary to lay off an employee, such employee shall, if possible, be notified at least ten (10) work days before the layoff occurs; provided, however, such notice shall not be required with respect to temporary layoffs or lack of work occasioned by breakdown of machinery, floods, fires, utility failures, Acts of God, or other causes beyond the University's control. When an employee is to be recalled from layoff, the University shall notify the employee by telephone (confirmed by certified or hand delivered letter, copy to Chief Xxxxxxx) specifying the time to report back to work, which notice shall, if possible, not be less than five (5) work days prior to the reporting time. In order to be eligible for recall, any employee who is laid off must keep the University currently advised in writing of their current whereabouts, address and telephone number, and any temporary changes thereof. The employee shall, within twenty-four (24) hours after receiving notice of recall, notify the University if for any reason the employee cannot report for work at the specified time. In the event an employee is unable to return to work due to illness or injury certified by a physician, the employee shall not lose their right to subsequent recall but the University may pass them over in order to fill an available position.

  • LAYOFFS AND RECALLS 17.01 Both parties recognize that job security should increase in proportion to length of service. Therefore, in the event of a layoff, employees shall be laid off in the reverse order of seniority.   • Layoff A layoff of an employee shall be deemed to occur when an employee is removed from the work schedule for one (1) week or more due to lack of work.
