Redundancy Layoff and Recall. Seniority is defined as the length of service in the bargaining unit and shall include service with the Employer prior to the certification or recognition of the Union. Seniority shall be used in determining preference or priority for promotion, transfer, demotions, lay-off, permanent reduction of the workforce and recall, as set out in other provisions of this Agreement. Seniority shall operate on a bargaining unit-wide basis. Employees shall serve a probationary period of three (3) months worked before acquiring seniority rights which shall then date back to their respective date of starting to work with the Employer. Probationary employees may be discharged without cause and without entitling the employee to recourse to the Grievance Procedure. No employee shall be transferred to a position outside the bargaining unit without the employee's consent. An employee, if transferred to a position outside the bargaining unit, shall retain the seniority acquired at the date of leaving the bargaining unit and for a further trial period of twelve (12) months. If such an employee is later returned to the bargaining unit such employee would be considered a new employee for the purposes of layoff and job Such employees shall retain all other seniority rights with the employer.
