SENIORITY, LAYOFF AND RECALL. A. “University seniority” is the employee’s length of continuous service with the University from the employee’s most recent date of hire into a Bargaining Unit position. This date will be considered the date that the employee begins active pay status in a Bargaining Unit position. B. An employee’s seniority shall terminate: 1. If the employee quits. 2. If the employee retires. 3. If the employee is discharged. 4. If the employee who has completed the new hire probationary period fails to report to work as scheduled or fails to report after any authorized absence or layoff, the employee may be terminated effective on the 7th day following the date of mailing a letter from the University advising the employee that they may be terminated if the employee does not advise the University of the employee’s intention to report to work as scheduled. The letter shall be mailed via certified and regular U.S. Mail. 5. When an employee is assigned out of the Bargaining Unit the following provisions will apply: a. If an employee is given a promotion out of the Bargaining Unit, and the employee is later found not to have met the posted qualifications, the employee may be returned to the employee’s prior position without a loss of seniority at any time during the employee’s probationary period. b. If an employee leaves the Bargaining Unit to take a non-Bargaining Unit position and returns to the Bargaining Unit for reasons other than those set forth above during the employee’s probationary period, the employee shall be credited with the employee’s prior seniority and Bargaining Unit rights but shall not be credited with seniority for service outside the Bargaining Unit. c. Except for laid-off employees who are awarded a non-Bargaining Unit position, once an employee has completed the employee’s probation in a non-Bargaining Unit position, the employee relinquishes all forms of Bargaining Unit seniority and shall be treated as a new employee in the event the employee returns to the unit. d. Once a Bargaining Unit employee is promoted out of the Bargaining Unit, the employee does not retain any Bargaining Unit rights except those listed above (i.e., seniority rights). e. This Agreement does not abridge Management’s rights nor guarantee that the employee shall be returned to his or her prior position. C. SENIORITY, LAYOFF AND RECALL. A. Seniority Definition 1. Seniority shall be defined as the length of continuous service in the bargaining unit with the District since the employee’s most recent date of hire in a bargaining unit permanent position. 2. Seniority will not accrue while the employee is on an unpaid leave of absence or layoff, nor will it accrue beyond ninety (90) work days, if an employee is on Workers’ Compensation; however, none of these shall be considered a break in “continuous service”.

SENIORITY, LAYOFF AND RECALL. Section 1 Seniority Defined‌ Seniority shall be defined as follows: A. State Seniority. State Seniority shall be the employee’s length of continuous service for the Employer or its designees from the most recent date of employment, or re- employment and is primarily used for the purpose of benefit calculation. State Seniority for employees transferring directly to State employment under Minn. Stat. § 480.181 shall be calculated from the employee’s date of hire verified by the County Auditor for the county from which the employee is transferring.
SENIORITY, LAYOFF AND RECALL. 9.01 Seniority shall mean an Employee’s continuous service with the Township since the date of his or her last hiring by the Township. 9.02 Seniority for Part-Time Employees shall accumulate based on hours paid 2,080 hours with one (1) year for all Employees. 9.03 Full time Employees transferring to part-time shall retain their established seniority, but such seniority shall be converted to hours as therein provided. The Employee shall then accumulate seniority on the basis of actual hours paid (1950 hours with one (1) year for all Employees except clerical which shall be 2080 hours with one (1) year for all employees). 9.04 Should circumstances require a reduction of Employees, Employees shall be laid off in reverse order of seniority, provided that the senior Employee has the ability, knowledge, and training to fill the requirements of the job. 9.05 Employees shall be recalled in order of their seniority provided that the senior Employee has the ability, knowledge, and training to fill the requirements of the job. 9.06 When Employees are to be recalled by the Township they shall be notified by registered mail to their last place of residence known to the Township and if they fail to report within seven (7) days after the mailing of such notice, the Township shall be under no obligation to re-employ them. 9.07 A seniority list of all Employees covered by this agreement shall be posted in January and June of each year. The list will show names, positions and date of hire for each Employee (or hours in the case of part-time Employees). Copies of the seniority list will be posted on all bulletin boards and one copy will be mailed to the Union. The seniority list will be considered correct for all purposes unless the Employee disputes its accuracy within two (2) calendar weeks from the date the list was posted. The Employee must file a written notice to the Township outlining the grounds of objection. No change in the seniority status of an Employee shall be made unless agreed to by the Union. 9.08 In relation to promotion, all Employees will undergo a trial period of sixty (60) consecutive working days provided that it shall not be less than 480 hours worked in the case of part- time Employees. 9.09 A newly hired Employee shall be required to serve a probationary period of six (6) months. SENIORITY, LAYOFF AND RECALL. 12.01 Seniority is defined as the length of service of an employee in the Fire Department of the Town of Oakville and shall be considered on a department-wide basis. Seniority shall be one (1) of the factors considered in determining selections for such things as promotions, transfers, demotions, lay-offs and recalls, and where set out in other provisions of this Agreement. 12.02 The Employer shall maintain a seniority list showing the name, job title and hiring date of each employee. An employee on the list shall have seniority rights from the date of hiring only after satisfactorily completing the required probationary period. An up-to- date copy of the seniority list shall be posted annually on all department bulletin boards and one copy sent to the Secretary of the Association. 12.03 An employee shall lose his/her seniority and his/her employment be considered terminated if: (a) he/she leaves the employ of the Employer of his/her own accord or he retires; (b) he/she is discharged and such discharge is not reversed through the grievance procedure; (c) he/she is laid off continuously for a period in excess of twelve (12) consecutive months; (d) he/she is laid off and fails to return to work within five (5) working days after he/she has been notified so to do by the Employer by registered mail to his/her last address on record with the Employer; (e) he/she is away from work without permission for more than one (1) working day without reasonable cause. 12.04 The last employee hired shall, in the case of layoff, be the first laid off and the last employee laid off shall be the first recalled. Such list shall be considered correct unless objection is raised within thirty (30) days of posting. 29.2 City seniority is understood to mean an employee's most recent date of employment or re- employment. City seniority will continue to accrue during all types of leave except for leaves of absence without pay or suspensions without pay for more than thirty (30) consecutive calendar days, which shall cause this date to be adjusted for an equivalent amount of time. Leaves of absence without pay or suspensions without pay for periods of thirty (30) consecutive calendar days or less shall not cause the City seniority date to be adjusted. City seniority shall be used for computing annual leave accrual, service awards, and other matters based on length of service. 29.3 Classification seniority shall be understood to mean length of time in classification. After successful completion of the probationary period, length of time in classification reverts to date of entry, transfer, or promotion to present classification. Seniority will continue to accrue during all types of leave except for leaves of absence without pay or suspensions without pay for more than thirty (30) consecutive calendar days, which shall cause this date to be adjusted for an equivalent amount of time.
