Measures to Avoid or Minimize the Impact of Layoff (a) There will be no layoffs until a reasonable attempt has been made by the Employer to make the necessary reductions in the workforce through attrition. (b) Subject to Article 17.02(a), the following Employees shall be subject to layoff identified by inverse order of seniority provided the remaining Employees can carry out the remaining work of the Department with Minimal Training: i. Redundant Employees in the affected positions, unless the identified Employee holds another position within the Bargaining Unit; and ii. Employees whose total hours of work in all positions within the Bargaining Unit have been changed by 10% or more from those specified at the time of the Employee’s most recent appointment and who have not accepted such change. For an ongoing change in hours of less than 10%, Article 15.03 shall apply. For an ongoing change in hours at the request of the Employee, Article 15.04(a) shall apply. (c) Seniority shall be determined with reference to the seniority list in effect in accordance with Article 14.02, and the list of Employees on probation. (d) Prior to notifying an Employee that they are subject to layoff in accordance with Article 17.04, the Employer will meet with the Union and will inform the Union of the Employer’s intentions including identification of the affected Employee(s) and the reasons for the redundancy. At this meeting the Parties may discuss and agree to alternative arrangements that meet operational needs and eliminate the need for, or limit the impact of layoffs. Alternative arrangements may include the provision of additional training to the Employee(s).

(c) Prior to implementation of the provisions of this Article, the Employer will meet with the Union and will inform the Union of the Employer’s intentions including identification of the affected Employee(s) and the reasons for the redundancy. At this meeting, the parties may discuss and agree to alternative arrangements that meet operational needs and eliminate the need for, or limit the impact of layoffs. (d) As a direct result of a layoff or attrition no Employees shall have their regular workload increased beyond a reasonable level.

A seniority list will be generated for the purpose of this meeting.

  • Ongoing Performance Measures The Department intends to use performance-reporting tools in order to measure the performance of Contractor(s). These tools will include the Contractor Performance Survey (Exhibit H), to be completed by Customers on a quarterly basis. Such measures will allow the Department to better track Vendor performance through the term of the Contract(s) and ensure that Contractor(s) consistently provide quality services to the State and its Customers. The Department reserves the right to modify the Contractor Performance Survey document and introduce additional performance-reporting tools as they are developed, including online tools (e.g. tools within MFMP or on the Department's website).

  • Uncontrollable Forces Tariff Provisions Section 14.1 of the CAISO Tariff shall be incorporated by reference into this Agreement except that all references in Section 14.1 of the CAISO Tariff to Market Participants shall be read as a reference to the Participating Generator and references to the CAISO Tariff shall be read as references to this Agreement.

  • Mitigation Measures Company shall take commercially reasonable measures (except measures causing it to incur out-of-pocket expenses which BNYM does not agree in advance to reimburse) to mitigate losses or potential losses to BNYM, including taking verification, validation and reconciliation measures that are commercially reasonable or standard practice in the Company’s business.

  • PRODUCTION DEFINITELY DISCONTINUED If the holder of the approval completely ceases to manufacture a type of vehicle approved in accordance with this Regulation, he shall so inform the authority which granted the approval, which in turn shall forthwith inform the other Contracting Parties to the Agreement applying this Regulation by means of a communication form conforming to the model in Annex 1 to this Regulation.

  • Disruption 41.1 The Contractor shall take reasonable care to ensure that in the performance of its obligations under the Framework Agreement it does not disrupt the operations of the Authority, its employees or any other Contractor employed by the Authority. 41.2 The Contractor shall immediately inform the Authority of any actual or potential industrial action, whether such action be by their own employees or others, which affects or might affect its ability at any time to perform its obligations under the Framework Agreement. 41.3 In the event of industrial action by the Staff, the Contractor shall seek Approval to its proposals to continue to perform its obligations under the Framework Agreement. 41.4 If the Contractor’s proposals referred to in clause 41.3 are considered insufficient or unacceptable by the Authority acting reasonably, then the Authority may by notice terminate the Framework Agreement with immediate effect.

  • Non-tariff Measures 1. A Party shall not adopt or maintain any non-tariff measures on the importation of any good of the other Party or on the exportation of any good destined for the territory of the other Party except in accordance with its WTO rights and obligations or in accordance with other provisions of this Agreement. 2. Each Party shall ensure its non-tariff measures permitted in paragraph 1 are not prepared, adopted or applied with a view to, or with the effect of, creating unnecessary obstacles to trade between the Parties.
