Requests for Change in Project Scope. Consistent with the discussion of the Solicitor’s opinion on SNPLMA funds as appropriated funds and the principles of appropriations law discussed in Section VI, the “purpose statute” is the guiding principle in regard to requesting, analyzing, and either approving or denying modifications for changes to project scope.49 Recipients of SNPLMA funds may request a change in scope so long as the requested change is determined to be necessary to accomplish the purpose of the project as described in the nomination and approved by the Secretary, and does not change or expand/generalize that purpose. The rules below address types of changes that do not require a change in scope, types of changes that require a change in scope, and types of changes that are prohibited because they would not comply with the purpose approved by the Secretary or the purpose statute. These rules are based on application of appropriations law, the Secretary’s requirements for expenditure of funds, and the Secretary’s authority and discretion to decide which projects to fund based on the description of the project purpose in the nomination. Beginning with Round 13, project nominations include a specific purpose statement. Requests for Change in Project Scope. Projects are evaluated, scored, ranked, and approved by the Secretary based on ranking criteria and public benefit, both of which are determined through evaluation of the project as described in the nomination. Requests for changes in scope should be limited to those necessary to complete the project as described in the nomination and approved by the Secretary. Changes in scope which increase the size, function, level of finish, or otherwise expand on the scope of the originally described project, regardless of whether or not additional funds are required for the change, should be submitted as an additional or future phase of the project in a subsequent round of nominations. Rather than request reductions or alterations in the scope of the project which would essentially change the essence of the project to something other than what the Secretary approved, agencies/entities should consider termination and nomination of the project in a future round. The consideration and approval process is described below in section XII.

  • Work Schedule Changes 215. It is agreed that pursuant to the exercise of management rights, normal work schedules may be changed without mutual agreement, subject to compliance with other provisions of this Agreement. Failure to agree to any adjustment shall be a dispute under the Disputes clause, provided, however, that nothing in this clause shall excuse the Contractor from proceeding with the Contract as changed.

  • Project Changes 1.8.1. All changes shall be administered per the UGC.

  • Project Schedule Construction must begin within 30 days of the date set forth in Appendix A, Page 2, for the start of construction, or this Agreement may become null and void, at the sole discretion of the Director. However, the Recipient may apply to the Director in writing for an extension of the date to initiate construction. The Recipient shall specify the reasons for the delay in the start of construction and provide the Director with a new start of construction date. The Director will review such requests for extensions and may extend the start date, providing that the Project can be completed within a reasonable time frame.

Such changes shall be effected by written order and shall be binding on the Owner and Contractor. The Contractor shall carry out such written orders without delay.
