Responsibility and Security. The Banks does not accept any responsibility for damage to or loss of any articles or property left at The Banks prior to, during or after the event. The Customer(s) agrees to be responsible for any damage done to The Banks Complex by the Customer(s), their guests, invitees, employees or other agents under the Customer(s) control. Further, The Banks shall not be liable for any loss, damage or injury of any kind or character to any person or property caused by or arising from an act or omission of the Customer(s), or any of his guests, invitees, employees or other agents from any accident or casualty occasioned by the failure of the Customer(s) to maintain the premises in a safe condition or arising from any other cause, The Customer(s), as a material part of the consideration of this agreement, hereby waives on its behalf all claims and demands against The Banks for any such loss, damage, or injury of claims and demands against The Banks for any such loss, damage, or injury of the Customer(s), and hereby agrees to indemnify and hold The Banks free and harmless from all liability of any such loss, damage or injury to their persons, and from all costs and expenses arising there from, including but not limited to attorney fees.
Responsibility and Security. 6.1 AMYS and XXXXXX are not responsible for any damage to or loss of any articles or property left at the VENUE prior to, during or after the EVENT. The CLIENT agrees to and accepts responsibility for any damage done to the VENUE or any property at the VENUE owned by XXXX or MAISON by the CLIENT and the CLIENT's guests, invitees, employees or other agents of the CLIENT.
6.2 CLIENT agrees that neither XXXX nor MAISON shall be liable for any loss, damage or injury of any kind or character to any person or property caused by or arising from any act or omission of the CLIENT, or any of the CLIENT's guests, invitees, employees or other agents from any accident or causality occasioned by the failure of AMYS or MAISON to maintain the VENUE in a safe condition or arising from any other cause. The CLIENT, as a material part of the consideration for this contract, hereby waives on CLIENT's behalf and on behalf of all CLIENT's guests, invitees, employees or other agents, all claims and demands against XXXX and MAISON for any such loss, damage, or injury. CLIENT further agrees to indemnify and hold both XXXX and MAISON free and harmless from any and all liability for any and all such loss, damage or injury to property and other persons, and from any and all costs and expenses arising there from, including but not limited to attorney fees.

The customer, as a material part of the consideration of this agreement, hereby waives on its behalf all claims and demands against The Oaks or Spanish Fork City for any such loss, damage, or injury of the customer, and hereby agrees to indemnify and hold The Oaks free and harmless from all liability for any such loss, damage or injury to other persons, and from all costs and expenses arising there from, including but not limited to attorney fees. All clean up and exit of the room must be completed by 11:00 pm or by the time your hourly time has expired. Only tape which is approved by The Oaks Banquet Center representative shall be permitted. • Storage of any unapproved private property. • Use of equipment or other items that could mar or otherwise damage the surface of the floor. • Charging admission to any facility, except with approval of The Oaks Banquet Center representative. • Removal of any furnishings or property of The Oaks Golf Course or Banquet Facility.

The Customer(s), as a material part of the consideration of this agreement, hereby waives on behalf all claims and demands against MAC for any such loss, damage, indemnify and hold MAC free and harmless from all liability of any such loss, damage or injury to her persons, and from all costs and expenses arising there from, including but not limited to attorney fees.

Further, The Salem Herbfarm shall not be liable for any loss, damage or injury of any kind or character to any person or property caused by or arising from any act or omission of the CLIENT, or any of his guests, invitees, employees or other agents from any accident or causality occasioned by the failure of the CLIENT to maintain the premises in a safe condition or arising from any other cause. The CLIENT, as a material part of the consideration of this agreement, hereby waives on its behalf all claims and demands against The Salem Herbfarm for any such loss, damage, or injury of the CLIENT, and hereby agrees to indemnify and hold The Salem Herbfarm free and harmless from all liability for any such loss, damage or injury to other persons, and from all costs and expenses arising there from, including but not limited to attorney fees.
Responsibility and Security. You acknowledge and agree that:
(i) your password is confidential and you must take reasonable precautions to keep it confidential;
(ii) you must not disclose your password to any person;
(iii) you must change your password regularly;
(iv) you must notify Sustainability Victoria if the confidentiality of your password is compromised; and
(v) you are solely responsible for all activities that occur on your User Account undertaken by you or undertaken by another person in circumstances where you have failed to comply with any of the requirements referred to in paragraphs (i) to (iv).

A security fee of $500.00 will be charged to the CLIENT should security services and/or law enforcement need to be called in the event of inappropriate behavior. Further, The Shore Event Centre shall not be liable for any loss, damage or injury of any kind or character to any person or property caused by or arising from any act or omission of the CLIENT, or any of his guests, invitees, employees or other agents from any accident or causality occasioned by the failure of the CLIENT to maintain the premises in a safe condition or arising from any other cause. The CLIENT, as a material part of the consideration of this agreement, hereby waives on its behalf all claims and demands against The Shore Event Centre for any such loss, damage, or injury of the CLIENT, and hereby agrees to indemnify and hold The Shore Event Centre free and harmless from all liability for any such loss, damage or injury to other persons, and from all costs and expenses arising there from, including but not limited to attorney fees. As the host of a private party, the CLIENT acknowledges responsibility for the proper and lawful consumption of alcoholic beverages at The Shore Event Centre during the duration of the event described in this contract. Alcoholic beverages will be purchased and served through The Shore Event Centre only. The Shore Event Centre will exercise due care in serving alcoholic beverages, and will refuse service to any person appearing to be under the age of 21 or any person who appears to be intoxicated. Identification and proof of age will be requested from any person who appears to be under 30 years of age. Alcoholic beverages will be removed from anyone believed to be a minor or from any intoxicated person. The Shore Event Centre will provide all alcoholic beverages consumed in accordance with the laws and regulations of the State of Iowa. The alcoholic beverage service will end no later than 1:00AM. The CLIENT agrees to fully cooperate and assist The Shore Event Centre in enforcing the laws of the State of Iowa and the policies of The Shore Event Centre regarding the consumption of alcoholic beverages.

The CLIENT agrees to be responsible for any damage done to Free Radical Ranch LLC by the CLIENT’s, his/her guests, invitees, employees, caterers or other agents under the CLIENT’S control. Furthermore, Free Radical Ranch LLC shall not be liable for any loss, damage, or injury of any kind or character to any person or property caused by or arising from any accident or causality occasioned by the failure of the CLIENT to maintain the premises in a safe condition or arising from any other cause. The CLIENT, as a material part of the consideration of this agreement, herby waives on its behalf all claims and demands against Free Radical Ranch LLC for any such loss, damage, or injury of the CLIENT, and xxxxxx agrees to indemnify and hold Free Radical Ranch LLC free and harmless from all liability for any such loss, damage, or injury to other persons, and from all costs and expenses, arising there from, including but not limited to attorney fees. Free Radical Ranch LLC does not accept any responsibility for damage, injury, or distress due to livestock or pets on the property prior to, during, or after the event. The CLIENT agrees to be responsible for the CLIENT’s, his/her guests, invitees, employees, caterers or other agents under the CLIENT’s control with regard to proper and safe behavior concerning livestock and pets at Free Radical Ranch LLC. The CLIENT, as a material part of the consideration of this agreement, herby waives on its behalf all claims and demands against Free Radical Ranch LLC regarding livestock and pets for any such damage, injury, or distress of the CLIENT, and hereby agrees to indemnify and hold Free Radical Ranch LLC free and harmless from all liability for any such damage, or injury, or distress to other persons, and from all costs and expenses, arising there from, including but not limited to attorney fees. If the CLIENT agrees to this contract, they accept responsibility for the conduct of their party. CLIENT’s event will end at 12:00AM (midnight) on Saturday. All vehicles must remain on the graveled areas unless approved by the farm for field parking. CLIENT agrees to indemnify and hold De Tierra Events harmless from any and all liability in connection therewith. De Tierra Events does not accept any responsibility for damage to or loss of any articles of property left at De Tierra Events prior to, during or after the event. The CLIENT agrees to be responsible for any damage done to De Tierra Vineyards by the CLIENT, CLIENT’S guests, invitees, employees or other agents under the CLIENT’s control. Further, De Tierra Events shall not be liable for any loss, damage or injury of any kind or character to any person or property caused by or arising from any act or omission of the CLIENT, or any of CLIENT’S guests, invitees, employees or other agents from any accident or causality occasioned by the failure of the CLIENT to control CLIENT’S guests or arising from any other cause. De Tierra Events is not responsible for any items lost or stolen during setup, break down, or the duration of the event or staff on the property.
