RESPONSIBILITY FOR SERVICE. Date Signature Form Page The Bank shall not be responsible for goods or services acquired through use of the Card and shall not be liable if the Card is not honored or accepted, or the corresponding card account cannot otherwise be used at any time, or the Bank is unable to perform its obligation due indirectly to the failure of any machine, date processing system or transmission link or to any cause outside the control of the Bank, its agent, servants or sub-contractors. All claims, including any right of set-off by Cardholder, and any dispute regarding any sales draft or credit voucher, or any transaction involving a Card or other use of the corresponding account, shall be settled directly between the merchant and Cardholder and shall have no effect on the indebtedness. In case of such disputes, the Bank shall remain fully indemnified by Cardholder in respect of any and all claims arising there from whether by the merchant or any third party. Any refund made by means of a credit voucher issued by a merchant will be credited to the corresponding account upon its receipt by the Bank from the merchant. Until a credit voucher is received by the Bank, the indebtedness is payable to the Bank in accordance with the provisions in this Agree- ment, and no claim by Cardholder against the merchant may be the subject of set-off or counter claim against the Bank.

The Bank shall not be liable for any accident, act of aggression, theft, loss or damage the Cardholder may suffer while using the Card at any ATM or other similar service whether on the Bank’s premises or otherwise.
RESPONSIBILITY FOR SERVICE a) The Bank incurs no liability to the Cardholder if any merchant denies or fails to honour the Card or if there is dispute as to the nature, quality of any goods or service acquired from the merchant it being acknowledged that no merchant is an agent of the Bank. b) All claims including any right of set-off by the Cardholder and any dispute regarding any sales voucher or credit voucher or any transaction involving Card or other use of the Card Account shall be settled directly between the merchant and the Cardholder and shall have no effect on the indebtedness. c) The Bank incurs no liability to the Card holder for any malfunction of any ATM.

RESPONSIBILITY FOR SERVICE. Company will perform the Services in (i) a timely and professional manner and utilizing the best industry practices for commercial Vessel operators, including by ensuring that Customer orders for Products are accurately and timely prepared, packaged, and ready for pick up and (ii) compliance with all Applicable Laws, including those relating to the specific Content available at the Vessel (e.g., food safety, food-borne illness for food service Content), workplace safety, and employment. Company will bear full responsibility for all aspects of the provision of the Services, including any personal injury or death or any damage or destruction of tangible personal property or real property (e.g., damage to surrounding structures or vehicles in connection with the Services).

RESPONSIBILITY FOR SERVICE. It is agreed by the parties receiving public fire service, private fire service, or any other service, that the Authority does not assume any liability as insurer of property or person, and that the Authority does not guarantee any special service, pressure, capacity or facility, other than is permitted by the ordinary and changing operating conditions of the Authority, as the same exists from day to day. It is agreed, by the parties receiving service, that the Authority shall be free and exempt from any and all claims for injury to any person or property by reason of fire, water failure to supply water pressure or capacity. When a prospective customer has made application for a new service or has applied for the reinstatement of an existing service, it shall be presumed that the piping and fixtures on the applicant's premises are in good condition. The Authority will not be liable in any event, for any accident, breaks or leakage arising in any way in connection with the supply of water or failure to supply same, or the freezing of water pipes or fixtures of the customer, nor any damage to the property which may result from the usage of water supplied to the premises. No water will be furnished to any premises where any possibility exists of the mingling of the water furnished by the Authority, with water from any other source. Nor will the Authority permit its mains or service pipes to be connected in any way to any piping, swimming pools, tank, vat or other apparatus containing liquids, chemical, or any other matter which may flow back into the Authority's service pipes or mains and consequently endanger the water supply. Whenever any person, persons, firm or firms, partnership or partnerships, corporation or corporations, or any combination thereof causes or has caused any damage to the water or sewer system or facilities of the said Authority, the party or parties causing such damage shall immediately notify the Authority of such damage. The said Authority shall have the right to repair such damage or have such damage repaired, and shall have the further right to recover the full cost and expense of such repairs, including, but not limited to, the standard charges for work performed by Authority employees, for materials, supplies and equipment used for such repairs from the party or parties causing such damage.

Until the credit voucher or other document of the value thereof is received by the Bank, the indebtedness is payable to the Bank in accordance with the provisions of this agreement.
