RIGHTS AND OBLIGATIONS OF THE PROVIDER. The Provider undertakes that the Material is transferred in accordance with the following provisions of the Treaty: a) Access shall be accorded expeditiously, without the need to track individual accessions and free of charge, or, when a fee is charged, it shall not exceed the minimal cost involved; b) All available passport data and, subject to applicable law, any other associated available non-confidential descriptive information, shall be made available with the Plant Genetic Resources for Food and Agriculture provided; c) Access to Plant Genetic Resources for Food and Agriculture under Development, including material being developed by farmers, shall be at the discretion of its developer, during the period of its development; d) Access to Plant Genetic Resources for Food and Agriculture protected by intellectual and other property rights shall be consistent with relevant international agreements, and with relevant national laws; e) The Provider shall periodically inform the Governing Body about the Material Transfer Agreements entered into, according to a schedule to be established by the Governing Body. This information shall be made available by the Governing Body to the third party beneficiary.2

RIGHTS AND OBLIGATIONS OF THE PROVIDER. 7.1.1 The Provider shall maintain the apron parking and bridge used for the provision of the Services in good technical condition so that they are fit for the provision of the Services under this Agreement; 7.1.2 The Provider has the right to ensure that the User makes use of the Services in accordance with this Agreement and the Supplemental Agreement; 7.1.3 The Provider has no obligation to provide for the guarding of parked aircraft. The security provided for apron parking adheres to the same standard as that for other SRA areas; 7.1.4 The Provider shall not be responsible for damages originating to parked aircraft or other objects belonging to the User located at the apron parking area, nor articles inside them. The Provider shall be responsible for damages in such a case only if it has caused the damage itself; 7.1.5 The Provider has the right to bring boarding stairs alongside the aircraft as a replacement for the bridge or gate when it has serious operational reasons to do so. In this case, the User is not obligated to pay the Price pursuant to this Agreement, but only the price for the use of boarding stairs given in the Pricelist. 7.1.6 The Provider will not undertake any activity for the User with respect to the fire safety. Any fire safety requirements the User may request of the Provider will be governed after the conclusion of this Agreement between the Parties by an independent agreement; 7.1.7 The Provider will carry out winter maintenance of the apron parking area in accordance with internal regulations of the Provider at its own expense. At the time of signing of this Agreement, the applicable regulation is PP-010/2009D "Winter Maintenance of Areas at Prague/Ruzyne Airport" or any norm which replaces it. 7.1.8 The Provider shall not be responsible to the User for damages, in particular lost profit, arising due to an emergency at Prague/Ruzyne Airport through no fault of the Provider (in particular, reports of explosives, restrictions on access to apron parking, preventive or any other measures adopted to deal with a terrorist attack, fire, war, civil unrest, rebellion, the presence of ionizing radiation or radioactivity, explosions or other natural disasters or high winds) which might force closure of the bridge. Emergency may also refer to flights of national importance and securing the checking and transport of protected persons.

RIGHTS AND OBLIGATIONS OF THE PROVIDER. 5.1. The Provider undertakes to guarantee the smooth operation of the study programmes. It commits itself to creating the conditions necessary for the Student to complete her/his studies within the prescribed study period. 5.2. The provider is responsible for providing the necessary rooms, hardware, software and other equipment on the premises of the UAS. This equipment may be used for study purposes only. In case the inappropriate use of hardware, software or equipment has harmful consequences (associated with costs and/or legal proceedings) for the Provider, the Student has to assume the responsibility.
RIGHTS AND OBLIGATIONS OF THE PROVIDER. 9.1 The Provider has the obligation to facilitate access to the Genetic Resources. This includes the facilitation of the acquisition of any permits, including export permits required in accordance with the relevant national laws in the Provider‟s country. 9.2 Pursuant to the provisions of Article 5 and 9 herein, the Provider is entitled to supervise the collection of samples and to verify the samples to ensure compliance with the terms of this Agreement. 9.3 All Genetic Resources and Material and derivatives shall remain the property of the Provider 9.4 The Provider shall designate the Access and Benefit Sharing Focal Point as the responsible contact point person for the entire duration of the present Agreement.
RIGHTS AND OBLIGATIONS OF THE PROVIDER. (1) Personnel can carry out Work at the Provider's office and/or Work location and are not required to stay at the Work location for the Term of the Agreement, however, PT SMI may request that certain Personnel to be at the Work location for a certain period within the Term of the Agreement, without any additional Service Fee. (2) The Provider has the right to obtain access and/or copy and use data and information owned or known by PT SMI in connection with the implementation of the Goods/Services Procurement Agreement and/or the Work. (3) The Provider shall be entitled to receive payment of Service Fees for Work performed in accordance with the provisions of Article 4 of the SSUP. (4) The Provider shall carry out the Work efficiently, in accordance with standards and pay attention to good management practices and with the responsibility expected of a professional expert in providing (5) The Provider will always act, as a trusted advisor to PT SMI, and will always support and protect the interests of PT SMI in relation to the Work, each Third Party. (6) During the Term of the Agreement, the Provider is obliged to obtain and maintain the validity of all permits and approvals necessary to carry out its business activities and carry out the Work.
