Road Improvements. Licensee recognizes that the County may from time to time deem it necessary or proper to make alterations or improvements in and upon the above-described road right-of-way and that the County has sole discretion to determine the nature and extent of such alterations or improvements. Licensee further recognizes that such County works may require the alteration or relocation of the Work hereunder. Licensee therefore covenants and agrees that, within a reasonable time after written notice from the County Engineer and without cost or expense to the County, Licensee will alter, reconstruct and relocate the Work as directed by the County Engineer. Licensee further covenants and agrees to indemnify and hold the County harmless from any and all liability and damages occasioned by said alteration, reconstruction and relocation.
Road Improvements. (a) The City shall relocate, at the Owner’s cost, the existing driveway access on Xxxxxx Street to the proposed location as outlined in Appendix “A” to access Lot 1. Tree removal is not permitted within the Road right-of-way without prior written approval from the city. The cost of this construction for bonding purposes is $500.00
Road Improvements. (a) The rear lane fronting the heritage lands must be upgraded to a paved standard including a drainage system at the owner’s expense. Owner is required to provide bonding in a form acceptable to the City of Kelowna in the amount of $14,000.00.
Road Improvements. (a) Xxxxxxx Avenue has been upgraded to the ultimate curb alignment. Frontage improvements are complete. And no further upgrades are required at this time.
Road Improvements. Park Avenue fronting this property must be constructed to a full urban standard including curb and gutter, fillet pavement, adjustment and/or re-location of existing utility appurtenances if required to accommodate this construction. Notwithstanding the foregoing, the construction of the full urban upgrade of Park Avenue fronting this development will be deferred. A one-time cash payment of $10,705.00 shall be collected from the Owner to pay for the future urban upgrade as described. This cash payment shall be made prior to final adoption of City of Kelowna Heritage Revitalization Agreement Authorization Bylaw No. 9673.
Road Improvements. On or before the expiration of the Construction Period and as part of the Public Improvements, the City hereby agrees to make roadway improvements and related infrastructure improvements to the Property according to the Final Plans (“Road Improvements”). All Road Improvements will be located on the Property. The City hereby represents and warrants that it has the power and authority to make the Road Improvements.
Road Improvements. City will initially pay the cost of the Road Improvements subject to this Agreement. Although City will initially pay for the Road Improvements under this Agreement, Xxxxxxxxx agrees to reimburse City for its actual costs of the Road Improvements as outlined in this Agreement. The Parties agrees the actual costs to be reimbursed to City by Developer for the Road Improvements shall include the actual costs incurred by the City for the material expenses of the Road Improvements and the actual expenses incurred by the City for the labor of non-City employees including contractors and subcontractors, non- City owned equipment and non-City owned tool rental, utilities, transportation, taxes, local, state, and federal public works laws and regulations, and all other services and facilities necessary for the execution and completion of the Public Improvements to the Road pursuant to this Agreement.
Road Improvements. (a) Pandosy Street was upgraded recently to the ultimate curb alignment; but the sidewalk and boulevard require modifications. This includes removal and replacement of the existing sidewalk to the ultimate location and boulevard changes to match the new sidewalk alignment. It is necessary for the development to pay one-time cash payment of $6,500.00 for this work. The City of Kelowna will complete this work at a later date.
Road Improvements. New roads, widening, resurfacing, and repairs of existing roads, pavement markings, signage, guardrails, ADA accommodations, and traffic calming projects are eligible. High-end decorative lighting, decorative road signage, brick pavers, and similar items are not eligible.
Road Improvements. Section 2.4(d) of the Original EDA contemplated that post execution of the Original EDA, the Parties would add a new Exhibit A-10-4 to the Original EDA. Therefore, the Parties amend the Original EDA by adding a new Exhibit A-10-4 which is attached to this Amendment.
