Sales Goals. The Marketer agrees that during the term of this Agreement, the Marketer will meet and maintain the franchise sales goals ("Sales Goals") set forth in Exhibit I to this Agreement.
Sales Goals. Sales goals shall be determined by Distributor and Supplier and sales performance criteria of Distributor shall be dictated as shown on Exhibit D. Both parties will shall work together to achieve these sales goals.

Sales Goals. In order to maintain Distributor’s rights in the Territory under Section 3.04 during the Term, Distributor shall meet all Minimum Requirements. Company shall determine Distributor’s purchase volumes applicable to the Minimum Requirements on a quarterly basis and, in light thereof, Company shall have the right, in its reasonable discretion, to adjust the Minimum Requirements set forth on Exhibit B no more than once per calendar year. Failure to meet the Minimum Requirements may also result in the early termination of this Agreement in accordance with Section 6.02.
Sales Goals. Licensee agrees to attain mutually agreed upon annual sales goals for the product as follows:
(a) No sales goals will exist for the period commencing on the date hereof and ending on the last day of calendar year 2007.
(b) Beginning with calendar year 2008, Licensee and Licensor will meet annually and agree on sales goals for each succeeding year, starting with calendar year 2008. Such agreed upon sales goals for each succeeding year will be in writing, executed by both parties and become part of this agreement.
(c) Should Licensee not attain any of the agreed upon sales goals for any year, Licensor may issue a notice of default to the Licensee. Licensee will then have a period of ninety (90) calendar days from receipt of said notice to cure the sales deficiency. Should the Licensee remain in default at the end of the cure period, Licensor, at their sole discretion, may terminate this agreement upon thirty (30) calendar days notice to the Licensee.
(d) Should Licensee and Licensor be unable to agree on sales goals for any year either party may terminate this agreement upon thirty (30) calendar days notice to the other party.

Sales Goals. Distributor shall attempt to meet the sales goals set forth in Schedule C attached to this Agreement (the "Sales Goals"). In the event Distributor does not attain the Sales Goals set forth in Schedule C, TPS may revoke Distributor's exclusive right to market, distribute and sell the Product in the Territory. The parties agree that Distributor's loss of its exclusive distributorship shall be sole remedy available to TPS in the event that Distributor does not attain the Sales Goals, but this Agreement shall otherwise continue in full force and effect.
Sales Goals. Choten will use its best efforts to achieve the sales goals during first year from the first customer shipment of the Products in Japan, as described and set forth on Exhibit F attached hereto, consisting of targeted unit sales of the Products in Japan. Following the initial period (and within 60 days of the end of the then current year), the parties will mutually agree on the quarterly and annual sales goals for the immediately succeeding year - which in any event will be no less than the sales goals for the immediately preceding year. In the event that SPC and Choten are unable to agree, the annual sales goals for the immediately succeeding year will be the same amount of immediately preceding year. Failure to meet the sales goals for the Products for each of years shall not be ground for termination of this Agreement.
Sales Goals. Employee agrees the 2017 sales goal for Mitzo is $TBD for new sales identified and sold directly by Employee. Any joint sales activities by Mitzo will be split proportionately on a case-by-case basis. For example, for a joint sales effort where a lead is identified by another party, the ultimate closing of a new customer contract will be split 50%-50% for purposes of the sales goal and commissions. Each new calendar year, the CEO of the Company will set a new sales goal for the upcoming year (i.e. 2017 calendar year and beyond).
