Selection of Contractors a. The CCRPC, in consultation with the Steering Committee, shall competitively bid for contract(s) for Program services that collectively satisfy the requirements for Minimum Control Measure One (Public Outreach and Education) and Minimum Control Measure Two (Public Involvement and Participation) of the Phase II NPDES Permit then in effect. The parties to the contracts shall be the contractors and the CCRPC. All contracts shall require the contractor to indemnify and hold harmless the MS4 Permittees from any claims related to the contract and to procure and maintain liability insurance for all services performed under the contract. b. All contracts shall be awarded based on qualifications, price, and the ability of the entity to provide services that meet the relevant MS4 Permit requirements. The selection of contractors shall comply with the procurement policy of the CCRPC and with applicable state and federal procurement laws and procedures. c. Contracts shall generally be 1 to 5 years in length and shall include, but not be limited to, a Maximum Limiting Amount and the right of the CCRPC to 1) cancel a contract if services are not being adequately provided, 2) specify that payments to contractors shall be made only for services rendered, 3) specify the annual scope of work and budget as approved by the Steering Committee, 4) allow a contract extension if desired, and 5) assign the contract to the MS4 Permittees that are signatories to this Agreement at the time of the assignment or to a contractor of the Steering Committee’s choosing. d. Contracting for services under this Agreement shall comply with the Fair Employment Act and Americans with Disabilities Act: the CCRPC shall comply with the requirement of Title 21 V.S.A Chapter 5, Subchapter 6, relating to fair employment practices, to the full extent applicable. The CCRPC shall also ensure, to the full extent required by the Americans with Disabilities Act of 1990, that qualified individuals with disabilities receive equitable access to the services, programs, and activities provided by the Steering Committee under this Agreement. This provision shall also be included in all contracts and subcontracts executed under this Agreement. e. The CCRPC and the Steering Committee recognize the important contribution and vital impact which small businesses have on the State’s economy. Selection of Contractors. All contractors providing services or materials in connection with the Project shall be selected in accordance with applicable provisions of the New Mexico Procurement Code, XXXX 0000, §§ 13-1-28 through 13-1-199, as amended, or, if the Borrower/Grantee is not subject to the New Mexico Procurement Code, shall be selected in accordance with a documented procurement process duly authorized and established pursuant to laws and regulations applicable to the Borrower/Grantee.
Selection of Contractors. Tenant shall retain a licensed general contractor (“Tenant’s Contractor”) to perform the Tenant Improvement Work. Tenant’s Contractor shall be subject to the prior written approval of Landlord, which shall not be unreasonably withheld.

Selection of Contractors. In general, the Steering Committee shall competitively bid for contract(s) for Program Services that collectively satisfy the requirements for Minimum Control Measure One (“Public Education and Outreach”) of the Phase II NPDES Permit for Program Years 2013 – 2018 as established by the MS4 Permit and as defined in Section 5. All contracts shall be awarded based on qualifications, price, and the ability of the entity to provide services that meet the relevant MS4 Permit requirements. However, upon consent of the majority of the voting members of the Steering Committee present, the RSEP may waive the bid process for select contracts. Contracts may be up to 5 years in length and shall include, but not be limited to, language specifying the right of the RSEP to cancel a contract if services are not being adequately provided and language specifying that payments to contractors shall be made only for services rendered.
Selection of Contractors. It will be the responsibility of the RECIPIENT to insure that any and all subs comply with the terms and conditions of this agreement and that the State of Washington is named as an express third-party beneficiary of such subcontracts with full rights as such.
Selection of Contractors. TAMPA BAY WATER shall select the Contractor(s) to manage, design and construct the Pipeline Segment B. The COUNTY acknowledges that TAMPA BAY WATER has already procured the engineering firm of Stantec Consulting Services, Inc., for design services for Pipeline Segment B pursuant to Contract No. 2021-025. In selecting the remaining Contractor(s), TAMPA BAY WATER acknowledges that it is the policy of the COUNTY that Disadvantaged Minority/Disadvantaged Women Business Enterprises (DM/DWBEs) shall have the maximum opportunity to participate in COUNTY projects. In this regard, TAMPA BAY WATER shall take all necessary steps to ensure that DM/DWBEs have the maximum opportunity to participate in any contract awarded for the management, design and construction of Pipeline Segment B. With regard to the solicitation for the Contractor(s) that TAMPA BAY WATER selects to manage and construct Pipeline Segment B, TAMPA BAY WATER agrees that it shall look to the COUNTY’s DM/DWBE program to encourage DM/DWBE participation in contracting and procurement activities as articulated in COUNTY Resolution R06-264 and its subsequent amendments (the “COUNTY’s DM/DWBE Program”). TAMPA BAY WATER also agrees it will look to the policies and procedures governing the COUNTY’s DM/DWBE Program for the purpose of identifying Contractor(s) with whom to contract in order to achieve minority and women participation in the project. Those policies and procedures are set forth in Exhibit 5, attached hereto (the “COUNTY’s DM/DWBE Program Operational Procedures”). Notwithstanding anything contained herein to the contrary, TAMPA BAY WATER shall not be subject to Part I, Section 7, Subsection 7.8.6(c) of the COUNTY’S DM/DWBE Program Operational Procedures. TAMPA BAY WATER staff shall oversee, implement, and enforce the DM/DWBE efforts. With regard to the Contractor(s) that TAMPA BAY WATER selects to manage, design and construct Pipeline Segment B, TAMPA BAY WATER shall submit quarterly reports to the COUNTY setting forth (a) the monetary amounts paid by TAMPA BAY WATER to all applicable prime Contractor(s), and (b) the monetary amounts paid by TAMPA BAY WATER and all applicable prime Contractor(s) to all DM/DWBEs during said quarter, including if a payment has not been made to a DM/DWBE during said quarter, and (c) the status of each prime Contractor(s)’ compliance with the DM/DWBE goal set forth in its contract with TAMPA BAY WATER.
