Standards of Maintenance. It is the intention of the parties to this Contract to provide for a high level of maintenance for the planting areas and improvements which are the subject of this Contract, up to the limit of budgeted funds. Therefore, the following standards shall be followed in the performance of this Contract: (a) All work shall be performed in a professional, workmanlike manner using quality equipment, methods, and materials. (b) All planting areas shall receive no less than the following: (1) Twice weekly inspection of areas, on Mondays and Fridays, as a minimum requirement. (2) All areas shall be maintained with a clean controlled appearance; i.e. pick up and dispose of all papers and bottles, cigarettes, or other litter on the grounds or in the areas daily or as needed. (3) Weed control as shall be maintained to insure that no obvious weeds are left visible. (4) All grasslike weeds, morning glories, or bindweeds, ragweed, or other underground spreading weeds shall be kept under strictest control. No plant of this type shall remain or be visible for more than one (1) week. No weed shall be allowed to remain that extends more than four inches (4") above the grounds. (5) Weed density shall never exceed more than five (5) weeds per square foot, averaged over the worst half of the given area. (6) An application of balanced, slow-release fertilizer and pre- emergence chemical approved by the City of Lincoln’s Parks and Recreation Department shall be applied according to label directions each spring. Pre-emergent shall be applied between April 1 and April 15. Fertilizer shall be applied between April 1 and June 1. (7) All areas must be maintained free of persistent erosion. Anti-erosion measures will be taken where potential problems exist. Any erosion that does happen will be cleaned up and cuts will be filled back. (8) Other plants or plantings grown by intent in these areas shall be protected and provided with adequate growing care, conditions, and space. (9) All dead, diseased, and unsightly branches shall be removed from the shrubs and trees as they develop in accordance with Section 201(b) hereof. (10) All areas shall be inspected and watered as needed to maintain the plantings in a healthy condition, provided water is available in or near the bed. (11) Pruning and shearing of shrubs shall be done as needed to maintain an attractive uniform appearance and comply with the Lincoln Municipal Code. (12) The Director of Parks and Recreation shall be notified immediately...
Standards of Maintenance. The CONTRACTOR will maintain the swimming pool in a clean and sanitary condition. The CONTRACTOR will be responsible for maintaining and operating the swimming pool in conformity with State and Local Health Department standards. The CONTRACTOR will supply all certificates and permits required by local health departments and other regulatory bodies necessary for the operation of the swimming pool, provided, however, that all permits obtained by the CONTRACTOR will be at the expense of the OWNER.
Standards of Maintenance. A. Maintenance shall include, but not be limited to road surfacing, shoulders, street name signs, storm drainage facilities and vegetation control. B. The private road shall be maintained in a safe condition so as to allow free and reasonable passage of such vehicular traffic as may be reasonable and necessary in order that all parties may enjoy full and free use of the parcels of real property affected hereby. C. The periodic maintenance schedule includes: snow plowing; keeping storm drainage facilities (ditches, road surface crowning, catch basins and culverts) functional and clear from debris; maintaining road shoulders from eroding into drainage ditches or allowing road surface to subside; grading, crowning road surface for proper drainage, including gravel application for a durable road surface and repairs of potholes and/or washboard road surface; vegetation control along road borders for improved sight line visibility, fire prevention and emergency vehicle access. D. Projects and Budgets shall be proposed by any Owner or the ROG and approved by a majority of Owners. Approved projects will be administered by the ROG. E. In coordination with the Ammeter Heights Homestead Owners group, all Common Road work costs will be agreed upon prior to the work taking place. The cost expense split on any Common Road work is 35% to Ammeter View and 65% to Ammeter Heights. F. Tax Lot 140448000 shall only be assessed for Common Road maintenance expenses, as the only road access to this Lot is from the Common Road and from no other Ammriview roads.

The private road shall be maintained in a safe condition so as to allow free and reasonable passage of such vehicular traffic as may be reasonable and necessary in order that all parties may enjoy full and free use of the parcels of real property affected hereby. C. A recommended periodic maintenance schedule, prepared by the engineer for this project is attached.
Standards of Maintenance. Bayside CDD, at its sole cost and expense, shall maintain the landscaping within the Designated Roadways in good condition and order and shall promptly repair any damage that may occur from time to time. Promptly upon receiving notice (which may be telephonic) from Village that the landscaping has been damaged or vandalized, Bayside CDD will take necessary steps to remove any damaged landscaping that presents a safety hazard to the users of the Designated Roadways. Within a reasonable time, the damaged landscaping will be removed and Bayside CDD will take all necessary steps to acquire and install replacement landscaping at its expense. If Bayside CDD fails to maintain and repair the landscaping in accordance with these standards, Village may, but shall not be required to, do so at Bayside CDD’s expense, in which case Bayside CDD promptly shall reimburse Village for all costs it incurs in connection with such activities.
Standards of Maintenance. Maintenance shall include, but not limited to, road surfacing, shoulders, gates, signs, storm drainage facilities and vegetation control. The roadways shall be maintained in a safe condition consistent with Xxxxxx County Standards for private roads. The “Full” or “Entire” surface of the roadways shall be maintained so as to allow free and reasonable passage of such vehicular traffic as may be reasonably and necessary in order that all parties may enjoy full and free use of the parcels of real property affected hereby. Where any question exists as to the standards to be applied, the owners may obtain a recommendation from a licensed professional engineer whose written recommendations may be followed in lieu of the standards identified above.

  • STANDARDS OF MANAGEMENT AND OPERATIONS In performing its obligations hereunder, during the term of this ESA, the Competitive Supplier shall exercise reasonable care to assure that its facilities are prudently and efficiently managed; that it employs an adequate number of competently trained and experienced personnel to carry out its responsibilities; that it delivers or arranges to deliver a safe and reliable supply of such amounts of electricity to the Point of Delivery as are required under this ESA; that it complies with all relevant industry standards and practices for the supply of electricity to Participating Consumers; and that, at all times with respect to Participating Consumers, it exercises good practice for a Competitive Supplier and employs Commercially Reasonable skills, systems and methods available to it.

  • Project Maintenance The Local Government shall be responsible for maintenance of locally owned roads and locally owned facilities after completion of the work. The State shall be responsible for maintenance of the state highway system after completion of the work if the work was on the state highway system, unless otherwise provided for in existing maintenance agreements with the Local Government.

  • Patent Maintenance All annuity and maintenance fees that are necessary in order to keep the Patents in force as of the Effective Date have been paid by Seller, and no payment of annuities or fees, or papers to be filed in patent offices, are required to be made within the three-month period after the Effective Date.

  • System Maintenance The Trust understands that USBFS will perform periodic maintenance to the System(s), which may cause temporary service interruptions. To the extent possible, USBFS shall notify the Trust of all planned outages and will perform any necessary maintenance during non-business hours.

  • Preventive Maintenance The Contractor shall provide necessary preventive maintenance, required testing and inspection, calibration and/or other work necessary to maintain the equipment in complete operational condition during the warranty period.

  • RECORDS MANAGEMENT AND MAINTENANCE CONTRACTOR, its officers, agents, employees and subcontractors shall, throughout the term 12 of this Agreement, prepare, maintain and manage records appropriate to the services provided and in 13 accordance with this Agreement and all applicable requirements.

  • General Maintenance Borrower shall maintain the Project Site and all improvements thereon, including lighting and signage, in good condition, free of debris, waste and graffiti, and in compliance with the applicable provisions of the Anaheim Municipal Code. Borrower shall maintain the improvements and landscaping on the Project Site in accordance with the Maintenance Standards (as hereinafter defined). Such Maintenance Standards shall apply to all buildings, signage, lighting, landscaping, irrigation of landscaping, architectural elements identifying the Project Site and any and all other improvements on the Project Site. To accomplish the maintenance, Borrower shall either staff or contract with and hire licensed and qualified personnel to perform the maintenance work, including the provision of labor, equipment, materials, support facilities, and any and all other items necessary to comply with the requirements of this Agreement. Borrower and its maintenance staff, contractors or subcontractors shall comply with the following standards (collectively, “Maintenance Standards”): (i) The Project Site shall be maintained in conformance and in compliance with reasonable maintenance standards for comparable first quality affordable housing projects, including but not limited to painting and cleaning of all exterior surfaces and other exterior facades comprising all private improvements and public improvements to the curbline. The Project Site shall be maintained in good condition and in accordance with the custom and practice generally applicable to comparable first quality affordable apartment complexes in the County of Orange (the “County”). (ii) Landscape maintenance shall include, but not be limited to: watering/irrigation; fertilization; mowing; edging; trimming of grass; tree and shrub pruning; trimming and shaping of trees and shrubs to maintain a healthy, natural appearance and safe road conditions and visibility, and irrigation coverage; replacement, as needed, of all plant materials; control of weeds in all planters, shrubs, lawns, ground covers, or other planted areas; and staking for support of trees. (iii) Clean-up maintenance shall include, but not be limited to: maintenance of all sidewalks, paths and other paved areas in clean and weed-free condition; maintenance of all such areas clear of dirt, mud, trash, debris or other matter which is unsafe or unsightly; removal of all trash, litter and other debris from improvements and landscaping prior to mowing; clearance and cleaning of all areas maintained prior to the end of the day on which the maintenance operations are performed to ensure that all cuttings, weeds, leaves and other debris are properly disposed of by maintenance workers. Governmental Lender agrees to notify Borrower in writing if the condition of the Project Site does not meet with the Maintenance Standards and to specify the deficiencies and the actions required to be taken by Borrower to cure the deficiencies. Upon notification of any maintenance deficiency, Borrower shall have commenced to cure such deficiency within thirty (30) days and shall diligently act to correct, remedy or cure such deficiency within no more than sixty (60) days. If the written notification states the problem is urgent relating to the public health and safety of the City of Anaheim or Governmental Lender, then Borrower shall have forty-eight (48) hours to rectify the problem. In the event Borrower does not maintain the Project Site in the manner set forth herein and in accordance with the Maintenance Standards, Governmental Lender shall have, in addition to any other rights and remedies hereunder, the right to maintain the Project Site, or to contract for the correction of such deficiencies, after written notice to Borrower, and Borrower shall be responsible for the payment of all such costs incurred by Governmental Lender.

  • MAINTENANCE OF STANDARDS The Employer agrees, subject to the following provisions, that all conditions of employment in his/her individual operation relating to wages, hours of work, overtime differentials and general working conditions shall be maintained at not less than the highest standards in effect at the time of the signing of this Agreement, and the conditions of employment shall be improved whenever specific provisions for improvement are made elsewhere in this Agreement.

  • Routine Maintenance (i) CRC shall be responsible for Routine Maintenance when necessary or desirable to maintain the Shared Assets in a safe operating condition, and to permit and facilitate (A) the performance by CRC of its obligations pursuant to this Agreement, and (B) the use of Shared Assets by the Operators in accordance with this Agreement. (ii) CSXT or NSR, directly or through their respective affiliates, may perform the work which CRC performed prior to the date of this Agreement when (A) CRC does not possess the skills needed for such work, (B) CRC lacks the necessary employees to do such work in a timely fashion, or (C) CRC does not possess the equipment needed to do such work. CRC and the party performing the work shall agree to a reasonable fee for such work prior to performance. CRC, CSXT and NSR may agree to have additional work performed either by CSXT, NSR or their affiliates.

  • Personnel, Office Space, and Facilities of Manager The Manager at its own expense shall furnish or provide and pay the cost of such office space, office equipment, office personnel, and office services as the Manager requires in the performance of its investment advisory and other obligations under this Agreement.
