Surplus to School a) Where there is a reduction in the total Early Childhood Educator positions in a school, Early Childhood Educators will be declared surplus, subject to their seniority date as per Article 18.
Surplus to School. Teacher - is a teacher who has been identified by qualifications and seniority as being in excess of the staffing requirements of a particular school for the ensuing school year.
Surplus to School. A Teacher may become surplus to a school because of a decline in enrolment at such school, a decline in enrolment in a particular subject area, or elimination of a particular subject from such school’s program.
Surplus to School. 35.01 A surplus to school Teacher is a Teacher who has been identified by seniority and qualifications as being in excess of the staffing requirements of a particular school for the ensuing school year.
35.02 Teachers holding positions requiring special qualifications as required under Ontario regulations and the requirements of the Ontario College of Teachers will be exempt from the provisions of this section provided:
a) The Teacher’s present teaching position requires a special certificate.
b) The school continues to require the program for the coming year.
c) No Teacher with greater seniority is willing and able to become qualified. within one school year and is willing to teach in the special area.
Surplus to School a) Where there is a reduction in the total Educational Assistant positions in a school, Educational Assistants will be declared surplus, subject to special qualifications (eg. Braille, ASL), based on their FTE status and seniority date as per Article 18.
b) An Educational Assistant declared surplus to a school according to this Article shall be automatically placed on the transfer list. The immediate supervisor and employee shall be notified by email by the Human Resources department by the last day in May.
c) The Principal shall notify the employee declared surplus as soon as possible, within 5 working days, of receiving notice of surplus from Human Resources.
d) An Educational Assistant declared surplus to a school has the right of first refusal for any position at their originating school until the end of September providing he/she has the qualifications for the positions.
Surplus to School. 3.04.1 Should a decline in enrolment at a school or a change in the school organizational plan require that a teacher be declared surplus to that school for the following school year, such declaration shall be made by April 14th.
3.04.2 The teacher declared surplus to that school shall be the least senior teacher of the school as defined by the Joint Seniority List, except as allowed in Article 3.04.3.
3.04.3 Academic programming considerations, as required by the Education Act and its regulations, can allow the Board to override the process in Article 3.04.2 above to exempt a particular teacher.
3.04.4 A teacher declared surplus to a school shall have first preference for vacancies in other schools in the secondary panel, based on seniority and qualifications.
3.04.5 A teacher who is declared surplus to a school and who is not placed in a vacancy pursuant to Article 3.04.4 shall, subject to qualifications, bump the teacher with the least seniority in the secondary panel.

c) An Educational Assistant declared surplus to a school has the right of first refusal for any position at their originating school until September 1 providing he/she has the qualifications for the positions.
Surplus to School. (a) When a school is deemed to be overstaffed, teachers will be declared surplus to their school by the Principal in consultation with the school’s XXXXX. Factors to be considered will include program needs and then seniority within qualifications.
(b) If any party disagrees with the decision in (a) above or (d) below, the matter will be referred to OSSTF/FEESO, District 22, which will present the case to the Superintendent of Human Resources.
(c) The decision of the Superintendent of Human Resources is final.
(d) Teacher(s) declared surplus to a school may be given the option to return to that school should a position for which the teacher is qualified become available prior to June 1st of the current school year, in order of seniority.
Surplus to School. By May 1 or the last school day preceding, but following the declaration of initial redundancy, teachers shall be declared surplus to their school and placed on the Surplus List. The Secondary Staffing Committee will be provided with a copy of the surplus list. Those teachers declared surplus will be informed by the Principal(s) in a personal interview and given in writing:
a) a copy of the first posting;
b) on the request of the teacher, the reasons for the teacher being declared surplus;
c) on the request of the teacher, an assessment of his or her work in the school, which the teacher may use as a letter of reference in applying for another position in or out of the system;
d) after a teacher has been declared surplus, he/she has exclusive rebound rights in accordance with Article 17.09 to any posted position in the original school for which he/she is qualified until August 31st of the year he/she was declared surplus.
Surplus to School. Should a decline in enrolment at a school or a change in the school organizational plan require that a teacher be declared surplus to that school for the following school year, the teacher declared surplus to that school shall be the teacher who is the lowest on the seniority list, except as allowed in Part B, Article 3.03.2
