Tenant Approval. Upon completion of the construction drawings and specifications. Tenant shall be allowed five (5) business days after receipt thereof in which to review and approve or object to the construction drawings and specifications and to advise Landlord of such approval or objections. Landlord shall be permitted five (5) business days thereafter in which to make, agree to make or reject any change requested by Tenant. Any changes to the construction drawings and specifications which are required by Tenant and are inconsistent with Exhibit C shall be made by Landlord’s architect and the cost of related design fees shall be paid by Tenant.
Tenant Approval. This Lease and Sublease Agreement is expressly subject to the approval of the Board of Trustees of Tenant, a not-for-profit corporation.
Tenant Approval. A. Landlord has provided Tenant with a copy of the most current set of Base Building Plan base sheets in Auto CAD format. At Landlord's request, Tenant shall execute a document reasonably acceptable to Tenant whereby Tenant shall agree not to utilize the plans, except in connection with the construction of the Building. Tenant shall review such Base Building Plans and provide revisions thereto for Landlord consideration on or before May 2, 2011. Within five (5) Business Days after Tenant delivers such revisions to Landlord, Landlord shall provide Tenant with revised Base Building Plans containing those revisions acceptable to Landlord, Landlord being under no obligation to accept Tenant’s proposed modifications. Within five (5) Business Days after Tenant's receipt of the revised Base Building Plans, Tenant shall deliver to Landlord revisions to the revised Base Building Plans for Landlord's consideration and the foregoing process shall continue until Tenant approves the Base Building Plans. If Tenant has not approved such Base Building Plans in writing on or before May 1, 2011, Tenant shall have the right to terminate this Lease without penalty upon written notice to Landlord, in which event this Lease shall immediately terminate and be of no further force or effect. If Tenant does not exercise the foregoing option to terminate the Lease on or before May 15, 2011 then Tenant shall be deemed to have approved the Base Building Plans last presented to Tenant. Landlord and Tenant shall work together in good faith to address any revisions provided by Tenant pursuant to the terms of this subparagraph A.
B. Within thirty (30) days after Tenant's approval of the Base Building Plans pursuant to subparagraph A, above, Tenant shall provide revisions to such Base Building Plans necessitated by Tenant's proposed Tenant Improvement Work. Within ten (10) Business Days after Tenant delivers such revisions to Landlord, Landlord shall provide Tenant with revised Base Building Plans containing those revisions acceptable to Landlord, Landlord being under no obligation to accept Tenant’s proposed modifications. Within ten (10) Business Days after Tenant's receipt of the revised Base Building Plans, Tenant shall deliver to Landlord revisions to the revised Base Building Plans for Landlord's consideration and the foregoing process shall continue until Tenant approves such Base Building Plans. If Tenant has not approved such Base Building Plans in writing on or before August 1, 2...
Tenant Approval. Landlord shall deliver the Final Plans to Tenant within --------------- six (6) weeks after the Execution Date for approval by Tenant. Tenant shall have three (3) business days from the date the Final Plans are presented to Tenant to approve the Final Plans. The failure of Tenant to give written approval or disapproval of the Final Plans within said three (3) business day period shall constitute approval by Tenant of the Final Plans.
Tenant Approval. Within three (3) business days after --------------- delivery to Tenant of the Construction Budget, Tenant shall give written approval of the Construction Budget or shall provide Landlord with specific written objections thereto. The failure of Tenant to either approve or disapprove the Construction Budget within said three (3) business day period shall constitute the approval thereof by Tenant.
Tenant Approval. Prior to the execution of this Lease, Tenant agrees to provide Landlord its financial statement and other additional financial information requested by Landlord to ascertain its financial condition. It is mutually understood and acknowledged that in consideration of Landlord entering into a lease agreement with Tenant, Landlord is relying on Tenants financial condition and as such, Landlord has the sole and absolute right to approve or disapprove Tenant's financial condition, and upon said disapproval, Landlord may terminate this Lease on written notice to Tenant within ninety (90) days after the date of the Lease without liability to or by any party and any money paid by Tenant to Landlord hereunder shall be returned to Tenant immediately. Otherwise, this Lease shall be in full force and effect.
Tenant Approval. Landlord shall submit for Tenant's approval the Construction Documents, in accordance with the following procedural requirements:
7.3.2.1 Tenant shall review each draft of the Construction Documents received from Landlord, and either (a) approve the same or (b) return the same to Landlord with a written notice detailing only those requested modifications which are required in order to correct material deviations from the Schematic Design Documents which are contained in the Construction Documents, in either event within three (3) business days after receipt thereof from Landlord. Any other changes to the Construction Documents desired by Tenant shall be requested under Section 7.9 hereof.
7.3.2.2 If Tenant shall return the Construction Documents to Landlord in a timely fashion with requested modifications, Landlord shall, subject to Section 7.3.2.4 below, revise the Construction Documents within a reasonable period of time and resubmit same to Tenant for approval pursuant to Section 7.3.2.1 above, until the Construction Documents are approved.
7.3.2.3 The Construction Documents shall be deemed approved by Tenant upon the first to occur of (i) Landlord's receipt of Tenant's written notice approving same, or (ii) Tenant's failure to deliver written notice to Landlord either approving or suggesting modifications of the Construction Documents of the sort permitted under Section 7.3.2.1 above, within the time required under Section 7.3.2.1 above, or (iii) if all of Tenant's requested modifications of the Construction Documents are disapproved by Landlord pursuant to Section 7.3.2.4 below.
7.3.2.4 Landlord shall not unreasonably disapprove modifications of the Construction Documents requested by Tenant pursuant to Section 7.3.2.1, above. Without limiting the generality of the foregoing, Tenant acknowledges that it shall be reasonable for Landlord to disapprove modifications requested by Tenant under this Section 7.3.4 because the work detailed in the proposed modification is inconsistent with the work contemplated in the Schematic Design documents or because the work detailed in the proposed modification: (a) is likely to adversely affect Building systems, the structure of the Building or the safety of the Building and/or its occupants; (b) might impair Landlord's ability to furnish services to Tenant or other tenants in the Building; (c) would materially increase the cost of operating the Building; (d) would violate any governmental laws, rules or ordinances (o...
Tenant Approval. Landlord shall consult with Tenant during the preparation of, and shall submit to Tenant for its approval, the final plans and specifications for the Landlord's Work and the Leasehold Improvements, which approval shall not be unreasonably withheld.
Tenant Approval. Successor Agency shall have the right to approve the initial selection of all tenants and the identity of major tenants for five (5) years. The conveyance instrument may include a list of pre-approved tenants. Approval may not be unreasonably withheld.
Tenant Approval. The Tenant, through the action of the Madison County Board of Supervisors, has adopted a Resolution authorizing the President, to execute this document.
