Testing For Drugs and/or Alcohol. A. For good cause, as determined by the Court Executive Officer in his or her discretion, employees may be required to take a drug or alcohol test. Any employee so tested shall be required to sign an authorization to release the test results and other medical information to the Court. B. Upon a confirmed positive test, the employee will be interviewed and questioned about drug or alcohol use. I f the Court determines that the employee's use of drugs will impair his or her ability to effectively and safely perform the function of the job, the Court will discipline the employee, up to and including dismissal. If the Court determines that the employee's use of alcohol will impair his or her ability to effectively and safely perform the functions of the job, the Court will discipline the employee, up to and including dismissal, subject to any obligation of reasonable accommodation. C. Discipline may be waived on a one time basis i f the employee agrees to enter the San Xxxxxx County Substance Abuse Treatment Program prior to undergoing testing. An employee tested and confirmed as under the influence of alcohol or controlled substances or who has requested the one time disciplinary waiver shall be placed on unpaid leave until evaluation by a Substance Abuse Professional of San Xxxxxx County and entry into an approved course of treatment.

Testing For Drugs and/or Alcohol. If Bevilles is notified of or becomes aware that an Employee or contractor at Bevilles (whether in a store or the Company offices) may be adversely affected by drugs and/or alcohol at the workplace, the Store Manager or Area Manager must immediately direct the person allegedly affected by drugs and/or alcohol whilst in the workplace to cease work. The Store Manager or Area Manager must contact Bevilles' Human Resources Manager as soon as practicable after which time a meeting must be held with the Employee allegedly affected by alcohol and/or drugs. Any meeting which takes place will ordinarily be attended by the Human Resources Manager, the Area and/or Store Manager, the Employee and his or her representative if requested. At this meeting, the Employee will be advised as to whether Bevilles requests him or her to submit to a breath, blood, saliva and/or urine test to determine the presence of drugs and/or alcohol in the Employee's system. The Employee must comply with a request issued by Bevilles to submit to a breath, blood, saliva and/or urine test. Failure to comply with any such request shall result in the Employee being stood down immediately without pay. Prior to undergoing any breath, blood, saliva and/or urine tests for drugs or alcohol, the Employee will be given an opportunity to inform Bevilles of the possibility of any test returning a non-negative result. Any breath, blood, saliva and/or urine test/s in accordance with this policy shall be administered by a medical professional selected by Bevilles. The Employee shall be suspended on full pay pending the results of any blood, saliva or urine tests for drugs and/or alcohol. Where the blood, saliva and/or urine test/s return a result which indicates the presence of illicit drugs in amounts which could adversely affect the Employee's ability to do his or her duties in a manner which does not present a risk to him- or herself or others, the Employee will be subject to immediate disciplinary action which may include termination. Where the Employee's employment is not terminated, the procedure set out in 4.1 shall apply.

  • Substance Abuse Testing The Parties agree that it is in the best interest of all concerned to promote a safe working environment. The Union has no objection to pre-employment substance abuse testing when required by the Employer and further, the Union has no objection to voluntary substance abuse testing to qualify for employment on projects when required by a project owner. The cost and scheduling of such testing shall be paid for and arranged by the Employer. The Union agrees to reimburse the Employer for any failed pre-access Alcohol and Drug test costs.

  • NO DRUGS OR ALCOHOL For reasons of safety and public policy, in any Contract resulting from this procurement, the use of illegal drugs and/or alcoholic beverages by the Contractor or its personnel shall not be permitted while performing any phase of the work herein specified.

  • Loop Testing/Trouble Reporting 2.1.6.1 Telepak Networks will be responsible for testing and isolating troubles on the Loops. Telepak Networks must test and isolate trouble to the BellSouth portion of a designed/non-designed unbundled Loop (e.g., UVL-SL2, UCL-D, UVL-SL1, UCL-ND, etc.) before reporting repair to the UNE Customer Wholesale Interconnection Network Services (CWINS) Center. Upon request from BellSouth at the time of the trouble report, Telepak Networks will be required to provide the results of the Telepak Networks test which indicate a problem on the BellSouth provided Loop. 2.1.6.2 Once Telepak Networks has isolated a trouble to the BellSouth provided Loop, and had issued a trouble report to BellSouth on the Loop, BellSouth will take the actions necessary to repair the Loop if a trouble actually exists. BellSouth will repair these Loops in the same time frames that BellSouth repairs similarly situated Loops to its End Users. 2.1.6.3 If Telepak Networks reports a trouble on a non-designed or designed Loop and no trouble actually exists, BellSouth will charge Telepak Networks for any dispatching and testing (both inside and outside the CO) required by BellSouth in order to confirm the Loop’s working status. 2.1.6.4 In the event BellSouth must dispatch to the end-user’s location more than once due to incorrect or incomplete information provided by Telepak Networks (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will xxxx Xxxxxxx Networks for each additional dispatch required to repair the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Trouble Determination rates from BellSouth’s FCC or state tariffs.

  • Substance Abuse Program The SFMTA General Manager or designee will manage all aspects of the FTA-mandated Substance Abuse Program. He/she shall have appointing and removal authority over all personnel working for the Substance Abuse Program personnel, and shall be responsible for the supervision of the SAP.

  • DRUGS & ALCOHOL Any incidents concerning drugs and/or alcohol shall be dealt with in accordance with the policy of the Building Industry Group Drug and Alcohol Safety and Rehabilitation Program as detailed in Appendix D of this Agreement.

  • Quality Assurance Program An employee shall be entitled to leave of absence without loss of earnings from her or his regularly scheduled working hours for the purpose of writing examinations required by the College of Nurses of Ontario arising out of the Quality Assurance Program.

  • CONTRACT WORK HOURS AND SAFETY STANDARDS As per the Contract Work Hours and Safety Standards Act (40 U.S.C. 3701-3708), where applicable, all Customer Purchase Orders in excess of ,000 that involve the employment of mechanics or laborers must include a provision for compliance with 40 U.S.C. 3702 and 3704, as supplemented by Department of Labor regulations (29 CFR Part 5). Under 40 U.S.C. 3702 of the Act, each contractor must be required to compute the wages of every mechanic and laborer on the basis of a standard work week of 40 hours. Work in excess of the standard work week is permissible provided that the worker is compensated at a rate of not less than one and a half times the basic rate of pay for all hours worked in excess of 40 hours in the work week. The requirements of 40 U.S.C. 3704 are applicable to construction work and provide that no laborer or mechanic must be required to work in surroundings or under working conditions which are unsanitary, hazardous or dangerous. These requirements do not apply to the purchases of supplies or materials or articles ordinarily available on the open market, or contracts for transportation or transmission of intelligence.

  • Substance Abuse The dangers and costs that alcohol and other chemical abuses can create in the electrical contracting industry in terms of safety and productivity are significant. The parties to this Agreement resolve to combat chemical abuse in any form and agree that, to be effective, programs to eliminate substance abuse and impairment should contain a strong rehabilitation component. The local parties recognize that the implementation of a drug and alcohol policy and program must be subject to all applicable federal, state, and local laws and regulations. Such policies and programs must also be administered in accordance with accepted scientific principles, and must incorporate procedural safeguards to ensure fairness in application and protection of legitimate interests of privacy and confidentiality. To provide a drug-free workforce for the Electrical Construction Industry, each IBEW local union and NECA chapter shall implement an area-wide Substance Abuse Testing Policy. The policy shall include minimum standards as required by the IBEW and NECA. Should any of the required minimum standards fail to comply with federal, state, and/or local laws and regulations, they shall be modified by the local union and chapter to meet the requirements of those laws and regulations.

  • Drugs and Alcohol The Pupil may be given the opportunity to provide a biological sample under medical supervision if involvement with drugs is suspected, or a sample of breath to test for alcohol consumed in breach of School rules or policy. A sample or test in these circumstances will not form part of the Pupil's permanent medical record.
