The Crown RE. Benefits The parties agree that, once all employees to whom this memorandum of settlement of the central terms applies become covered by the employee life and health trust contemplated by this Letter of Agreement, all references to life, health and dental benefits in the applicable local collective agreement shall be removed from that local agreement. The employee representatives, the employer representatives, and the Crown, shall establish an ETFO Employee Life and Health Trust (ELHT), (hereinafter, the “Trust”), to provide benefits to teachers and other education workers in the Province of Ontario in accordance with section 144.1 of the Income Tax Act (Canada) (“ITA”). School board benefit plans, herein referred to as the ‘benefit plans’ can only be moved into the Trust, such that the Trust will be in compliance with the ITA and CRA administrative requirements for an ELHT (the “ELHT Requirements”). It is intended that the Trust be effective September 1, 2016, and that benefit plans will participate in this Trust no later than August 31, 2017. The date on which a benefit plan commences participation in the Trust shall be referred to herein as the “Participation Date”. The Trustees, as defined in 2.1.0, shall cooperate with other Trusts and school boards (hereinafter, the “Board”) to move all employee groups into the Trust(s) at the same time. The parties acknowledge that the establishment of the Trust represents a substantial commitment both within and beyond the term of the current collective agreement. This letter of understanding is conditional upon its terms continuing in full force and effect beyond the termination date of the collective agreement, and is made in detrimental reliance upon such continuation. The terms of this letter of agreement will form the basis for a trust agreement setting out the terms of the ELHT to be approved by the parties and will remain in effect until August 31, 2020.

The ETFO-EW intend to join the ETFO Employee Life and Health Trust (ELHT), (hereinafter, the "Trust"). Should ETFO-EW fail to reach agreement, consistent with the parameters contained herein, by January 15, 2016, the parties to this LOA will meet to consider other options. The parties to this LOA agree to comply with the Trust's requirements. The provisions of the agreement between ETFO-EW and ETFO shall be reflected in the ETFO trust participation agreement. The provisions contained herein shall be applicable to ETFO-EW within the Trust. The Participation Date for ETFO-EW shall be no earlier than September 1, 2016 and no later than August 31, 2017and may vary by Board. ETFO-EW shall be offered the same benefit plan as ETFO teachers but shall be a separate division within the Trust and accounted for separately.
The Crown RE. Ministry Initiatives The parties acknowledge the ongoing implementation of the children’s Mental Health Strategy, the Special Needs Strategy, and other initiatives within the province of Ontario. The parties further acknowledge the importance of initiatives being implemented within the provincial schools system including but not limited to the addition of Mental Health Leads, and the protocol for partnerships with external agencies/service providers. It is agreed and affirmed that the purpose of the initiatives is to enhance existing mental health and at risk supports to school boards in partnership with existing professional student services support staff and other school personnel. It is not the intention that these enhanced initiatives displace EWAO-ATEO workers, nor diminish their hours of work. LETTER OF AGREEMENT #12 BETWEEN Education Workers Alliance of Ontario - Alliance des travailleuses et travailleurs de l’Ontario (Hereinafter ‘EWAO-ATEO’) AND The Council of Trustees’ Associations (Hereinafter the ‘CTA-CAE’) AND The Crown Re: Provincial Health and Safety Working Group The parties confirm their intent to participate in the Provincial Health and Safety Working Group. The purpose of the working group is to consider areas related to health and safety in order to continue to build and strengthen a culture of health and safety mindedness in the education sector. Areas for discussion may include: Violence in the Workplace; Occupational health and safety training, including training for EWAO-ATEO members; Caring and Safe Schools as it relates to EWAO-ATEO members; Health and safety considerations in high risk areas of the school; Appropriate access to, and provision of, information related to students who may pose a safety risk; and Any other health and safety matters raised by either party. The Crown commits to convene a meeting of the Working Group prior to December 31, 2015. EWAO-ATEO will be entitled to equal representation on the Provincial Health and Safety Working group. Where best practices are identified by the committee, those practices will be shared with school boards. The Crown RE. E-Learning Prior to the establishment of any alternative delivery model of E-Learning program for which collective agreements between OECTA and Catholic District School Boards do not apply, the Crown shall meet and consult with OCSTA and OECTA regarding the proposed alternative delivery model. LETTER OF AGREEMENT #11 BETWEEN AND AND The Crown RE: Committee to Review Effective Implementation of Changes to Class Size OCSTA and OECTA agree to create a committee to undertake a review of secondary class sizes in OCSTA member boards in the 2020-2021 and 2021-2022 school years, ensuing from the increase in average class size from 22:1 to 23:1, with recommendations for improvement. The Parties will work co-operatively with the goals of ensuring that boards are able to achieve classes consistent with the funded average of 23:1 and maintain broad student choice and pathways, while also seeking a balance in class size considerations. The Ministry agrees to assist through provision of relevant data and may also attend committee meetings as a resource.
