Health and Dental Benefits. During the term of this MOU, the City will provide benefits to all half-time employees as defined by Article 4.1 (Part-Time Employment) of this MOU in accordance with the Civilian Modified Flexible Benefits Program (Flex Program) and any modifications thereto as recommended by the Joint Labor-Management Benefits Committee (JLMBC) and approved by the City Council. During the term of this MOU, the City agrees that it will not unilaterally impose a reduction in plan design or benefits for any benefit plan applicable to employees covered by this MOU. Nothing in this MOU, however, shall prevent the parties from jointly reaching agreement on plan design or benefits applicable to employees covered by this MOU. Additionally, nothing in this MOU constitutes a waiver by the Union or the City with respect to making changes to plan design or benefits. If there are any discrepancies between the benefits described in this Article and the Flex Program approved by the JLMBC, the Flex Program benefits will take precedence.
Health and Dental Benefits. The Medical Center shall provide to the Physician-in-Training and the Physician-in-Training’s legal dependents, group hospitalization and dental insurance. The nature and extent of such coverage, program co-pay, if any, shall be determined by the Medical Center. It is the Physician-in- Training’s obligation to select and enroll in the benefit program(s) he/she desires.

Employees will have the option of receiving full benefit coverage for semi-private hospital, extended health benefits, and/or dental benefits, by using payroll deduction to reimburse the IESO the cost consistent with the appropriate pro-ration. Upon Executive’s termination under Section 5.1, 5.2, 5.3, or 5.7 hereof, the Company shall continue to provide the Executive and Executive’s spouse and children (in both cases, as of the time of termination), as applicable, with health and dental benefits on the same terms and conditions as are provided to active executive employees from time to time. Eligibility for such benefits shall be conditioned upon (i) the Executive continuing to pay the active employee premium for such coverage as applicable from time to time and (ii) enrollment and payment of any applicable premium (and continued participation) by the Executive and the Executive’s spouse in Medicare Part A and Part B when eligible. In the case of the Executive and the Executive’s spouse, such benefits shall continue for the remainder of their respective lives. In the case of the Executive’s children, such benefits shall continue until such child reaches age 19 or age 25 if such child is a full-time student and unmarried. The Company shall not reduce such health and dental benefits following the Executive’s termination of employment, nor shall the Company increase the deductibles or co-pays applicable to such benefits except to the same extent such changes are made to the coverage provided to active executive employees.
Health and Dental Benefits. 6.3.1 As a goal the District will attempt to provide all eligible employees with the best possible fringe benefits.
6.3.2 The benefits will be provided by participation in the PERS Health Benefits Program, PEMHCA (The Public Employees’ Medical and Hospital Care Act); or through alternative insurance plans agreed to by the negotiating parties.
6.3.3 Subject to CalPERS rules and requirements, the CalPERS health benefits program will be available to a CalPERS qualified domestic partners of bargaining unit members to the same extent as the health benefits program is available to dependents of bargaining unit members under this Collective Agreement. Bargaining unit members are solely responsible for informing themselves about and complying with CalPERS requirements for establishing eligibility for domestic partner health coverage, enrolling a domestic partner in the benefits plan and canceling a domestic partner’s coverage.
6.3.4 According to California Government Code Section 22892, the District will contribute thirty-two dollars and twenty cents ($32.20) per month per eligible full-time bargaining unit member for each approved PERS health plan option. This amount shall be the District’s basic employee only medical benefits contribution. Effective January 1, 2005, the basic amount will be increased to forty-eight dollars and forty cents ($48.40); and starting January 1, 2006, this amount will increase to sixty-four dollars and sixty cents ($64.60). This basic contribution is required only to the extent it is mandated by the law and only as long as the District participates in the PEMHCA plan.
6.3.5 The District shall provide to each eligible active full-time employee, a monthly contribution up to a maximum of: (1) the cost of the highest priced HMO available in the PERS Health Plan toward the single party premium in which the employee enrolls; and (2) the cost of the current vision single party premium. The monthly basic contribution provided above in Section 6.3.4 is included within this maximum monthly contribution to medical insurance and the vision plan. The District shall provide a prorated contribution for each active part-time employee working half time or more toward the cost of fringe benefits. Unit members that were enrolled in the CalPERS PPO plan on June 1, 2004, will continue to receive a District contribution equal to the cost of the single PPO and the vision care.

In addition to the compensation provided for in Section 3.1 and Section 3.2 hereof, Employee shall be entitled to all rights and benefits for which Employee is eligible under any health and dental insurance policies that IXC provides to its employees or officers in comparable positions during the term of this Agreement.
