THIRD PARTY PICKETS. In the event that any other Employee of the Employer, or employees of Ryerson University who are members of CUPE and/or OPSEU, engage in a legal strike and maintain a legal picket line: (a) The Employees covered by this Agreement will have the right to refuse to cross said picket line, without pay, provided the individual Employee has given the Employer twenty- four (24) hours notice. (b) Failure to cross said picket line by Employees will not be considered a violation of the Agreement, nor will it be grounds for disciplinary action. It is understood that loss of pay will be incurred as a result of duties not performed. This will not be considered to be discipline. THIRD PARTY PICKETS. In the event that any other Employees who are members of either CUPE or other parties that are engaged in a strike and/or maintain a picket line that is legal under the Labour Relations Act: Employees covered by this Agreement shall make every effort to report for work under such circumstances provided such reporting will not require any physical risk. Where a physical risk is present, employees have the right to refuse to cross picket lines that directly interfere with the performance of their duties. In such circumstances of refusal, where Management cannot provide them safe passageway across the picket lines, with or without necessary escort, an employee failing to report for duty shall be considered to be absent with pay. Failure to cross such picket lines when management has provided safe escort shall result in the employee being absent without pay. Such absence shall not be grounds for disciplinary action.
THIRD PARTY PICKETS. In the event that any other Employees who are members of either CUPE or other parties that are engaged in a strike and maintain a picket line: Employees covered by this Agreement shall have the right to refuse to cross picket lines that directly interfere with the performance of their duties. Failure to cross such picket lines shall not be grounds for disciplinary action. Salary shall not be deducted for any time not worked as a result of such refusal. If the Employer requires, Employees who refuse to cross picket lines that directly interfere with the performance of their duties shall en devour to work in an alternate location.
THIRD PARTY PICKETS. In the event that any other Employee of the Employer, or employees of Ryerson University, the Student Campus Centre or the Ryerson Students’ Union who are members of CUPE and/or OPSEU, or the Continuing Education Students’ Association of Ryerson (XXXXX) engage in a legal strike and maintain a legal picket line: (a) The Employees covered by this Agreement will have the right to refuse to cross such picket line, without pay, provided the individual Employee has given the Employer 24-hours notice. (b) Failure to cross such a picket line by Employees will not be considered a violation of the Agreement, nor will it be grounds for disciplinary action. It is understood that loss of pay will be incurred as a result of duties not performed. This will not be considered to be discipline. THIRD PARTY PICKETS. In the event that any employee of the Employer in the course of their work encounters off site strike and/or lockout action that has resulted in a picket line, employees covered by this Agreement will have the right to refuse to cross such picket line, provided the individual employee advised the Employer of the situation. The Employer supports employees rights to not cross a picket line. Such employees will suffer no loss of pay or other negative consequences.

  • Third Party Products 12.1 Third-party products provided to you by NCR Voyix for use with your subscription to the Service are subject to any terms provided by their supplier, including but not limited to those terms and conditions set forth in the exhibits attached hereto. Third-party terms and conditions are subject to change at any time by the supplier, and you agree that your use of such third-party products and services is governed by such supplier’s terms and conditions. ACCORDINGLY, NCR Voyix EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY NATURE WITH RESPECT TO ANY SUCH THIRD-PARTY PRODUCTS, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF ANY THIRD-PARTY RIGHTS. 12.2 Third-party products and services may be advertised or made available to you for purchase directly from their supplier by email or other electronic communications, including notifications made through the Service or the Account Portal. Any representations or warranties that may be provided in connection with any such third-party products or services are provided solely by their supplier. NCR Voyix will not be responsible for any of your dealings or interactions with any of those third-party suppliers.

  • Third Party Programs This Licensed Software may contain third party software programs (“Third Party Programs”) that are available under open source or free software licenses. This License Agreement does not alter any rights or obligations You may have under those open source or free software licenses. Notwithstanding anything to the contrary contained in such licenses, the disclaimer of warranties and the limitation of liability provisions in this License Agreement shall apply to such Third Party Programs.

  • Third Party Products and Services Any third-party hardware, software and/or services that is delivered by ResMed for use either standalone or in conjunction with ResMed products and/or services, shall be subject to the third-party terms and conditions and/or license agreements between Customer and the third party. Such third-party hardware, software and/or services is provided by ResMed "AS IS," without any warranty of any kind. Any representations or warranties as to such hardware, software and/or services shall only be as granted by the applicable third parties, if any, that accompany such products and/or software and/or services. Any representations, warranties, or other similar obligations with respect to such third-party hardware, software and/or services flow directly from the third party to Customer and ResMed shall have no responsibility at all for any such representations, warranties, obligations or lack thereof.

  • Third Party Vendors Nothing herein shall impose any duty upon DST in connection with or make DST liable for the actions or omissions to act of the following types of unaffiliated third parties: (a) courier and mail services including but not limited to Airborne Services, Federal Express, UPS and the U.S. Mails, (b) telecommunications companies including but not limited to AT&T, Sprint, MCI and other delivery, telecommunications and other such companies not under the party’s reasonable control, and (c) third parties not under the party’s reasonable control or subcontract relationship providing services to the financial industry generally, such as, by way of example and not limitation, the National Securities Clearing Corporation (processing and settlement services), Fund custodian banks (custody and fund accounting services) and administrators (blue sky and Fund administration services), and national database providers such as Choice Point, Acxiom, TransUnion or Lexis/Nexis and any replacements thereof or similar entities, provided, if DST selected such company, DST shall have exercised due care in selecting the same. Such third party vendors shall not be deemed, and are not, subcontractors for purposes of this Agreement.

  • Third Party Users If required by Applicable Laws and Regulations or if the Parties mutually agree, such agreement not to be unreasonably withheld, to allow one or more third parties to use the Connecting Transmission Owner’s Attachment Facilities, or any part thereof, Developer will be entitled to compensation for the capital expenses it incurred in connection with the Attachment Facilities based upon the pro rata use of the Attachment Facilities by Connecting Transmission Owner, all third party users, and Developer, in accordance with Applicable Laws and Regulations or upon some other mutually-agreed upon methodology. In addition, cost responsibility for ongoing costs, including operation and maintenance costs associated with the Attachment Facilities, will be allocated between Developer and any third party users based upon the pro rata use of the Attachment Facilities by Connecting Transmission Owner, all third party users, and Developer, in accordance with Applicable Laws and Regulations or upon some other mutually agreed upon methodology. If the issue of such compensation or allocation cannot be resolved through such negotiations, it shall be submitted to FERC for resolution.
