Unavailability of Services. You understand and agree that the Services may at times be temporarily unavailable due to system maintenance or technical difficulties. In the event any of the services included in our Mobile Banking Services are unavailable, you acknowledge that you can deposit an original check at our branches or through ATM that accepts your deposit, or by mail.

We cannot assume responsibility for any technical or difficulties or any resulting damages that you may incur. Some of the Services have qualification requirements, and we reserve the right to change the qualifications at any time without prior notice. We reserve the right to change, suspend or discontinue the Services, in whole or in part, or your use of the Services, in whole or in part, immediately and at any time without prior notice to you.

However, we will email notification of items that are rejected by the next business day following rejection. Business Days. For purposes of this Disclosure and Agreement, our business days are Monday through Friday. Saturdays, Sundays and federal holidays are not included. Funds Availability. You understand that following our receipt and processing of the image, funds from the check will be made available for your withdrawal and/or use in accordance with the terms and conditions of our Funds Availability Policy previously provided to you, as amended from time to time, which is incorporated herein by reference. For purposes of determining the availability of your deposits, every day is a business day, except Saturdays, Sundays, and federal holidays. If you transmit a check image through the Services before 1:00 p.m. HST on a business day that we are open, we will consider that day to be the day of your deposit. However, if you transmit a check image through the Services after 1:00 p.m. HST, or on a day we are not open, we will consider the deposit to have been made on the next business day we are open. You understand and agree that, for purposes of deposits made using the Services, the place of deposit is Honolulu, Hawaii. You understand that we may make such funds available sooner based on such factors as creditworthiness, the length and extent of your relationship with us, transaction and experience information, and such other factors as we, in our sole discretion, deem relevant. You also understand that credit is provisional until settlement is final. Accountholder’s Warranties. You make the following warranties and representations with respect to each image of an original check you transmit to us utilizing the Services:

I understand and agree that the Services may at times be temporarily unavailable due to the Bank’s system maintenance or technical difficulties including those of the Internet service provider, cellular service provider and Internet software. In the event that the Services are unavailable, I acknowledge that I can deposit an original check by mailing the original check to the mailing address on the Bank’s website. It is my sole responsibility to verify that items deposited using the Services have been received and accepted for deposit by you. However, you will email notification of items that are rejected by the next business day following rejection. Your business days are Monday through Friday, excluding Federal Holidays. Your business hours are 9:00 a.m. to 5:00 p.m., Pacific Time, each business day. I understand deposits received after 3:00 p.m. will be posted the following business day. I agree that items transmitted through the Services are not subject to the funds availability requirements of Federal Reserve Board Regulation CC. Funds deposited using the Mobile Deposit services will be available the fifth (5th) business day after the day of your deposit. The Bank may, but is not required to, make such funds available sooner based on such factors as credit worthiness, the length and extent of my relationship with the Bank, transaction and experience information, and other such factors as the Bank, in its sole discretion, deems relevant. Deposits received before 3:00 PM (PT) Monday through Friday, excluding Federal Holidays, will post that same day. Deposits received after 3:00 PM (PT) will be posted the following business day. It is the sole responsibility of each customer to verify that items deposited using the Services have been received and accepted for deposit. Customers understand that any amount credited for items deposited using the Services is provisional credit and agree to indemnify the Bank against any loss suffered because of acceptance of the remotely deposited check.
Unavailability of Services. If the Services are unavailable for four (4) hours or more in any calendar month, REAL TIME shall be entitled to a credit equal to one (1) day's Service for each full four (4) hour period of unavailability, to be taken by REAL TIME as a credit against subsequent invoices for such Services, anytime within the immediately following two (2) months. In the event that Services are unavailable for more than four (4) hours at any one time, QUEST NET shall, at its sole cost, switch REAL TIME to another provider of the Services until such time as QUEST NET can resume providing Services. The period of unavailability will commence when REAL TIME notifies QUEST NET of unavailability or when QUEST NET notifies REAL TIME of same, and shall end when QUEST NET restores availability of the Service. If QUEST NET is unable to resume providing Services for a period of 5 days or more, REAL TIME shall have the option, at its sole discretion, to terminate this Agreement. The term "unavailable shall mean that the Services are not available for use by or being provided to REAL TIME. Services shall not be considered unavailable because of (i) any regularly scheduled downtime or preventive or other maintenance of which REAL TIME has been notified of in advance and has agreed to; (ii) any maintenance or service interruptions requested by REAL TIME; (iii) downtime or Service interruptions resulting from REAL TIME's acts or failure to act in a timely and/or proper manner when notified to do so by QUEST NET, including, without limitation, failure to install or properly use updates or to make available the Facilities or components for testing or repair or to otherwise comply with QUEST NET's instructions and service requirements; or (iv) regular configuration or re-configuration periods.
